  • To-day in Anarchist history: The pacifist-Anarchist Gustav Landauer was martyred 90 years ago today, on 2 May 1919, when he was imprisoned and then stoned to death by soldiers sent on the orders of state socialist politician Gustav Noske, to crush the independent Bavarian worker’s councils and force the Bavarian Free State back under the political control of Germany.

  • To-day in Right to Keep and Bear Arms history: On May 2, 1967, 42 years ago today, the California State Assembly debated the Mulford Act, a bill to ban the open carrying of firearms. In response (since the bill was largely targeted at criminalizing their practice of openly carrying while on cop-watching patrols), the Black Panther Party staged a march to the state capital and walked onto the Assembly floor openly carrying rifles, shotguns, and holstered handguns. (The weapons were unloaded and were kept pointed either at the ceiling or at the floor.) Bobby Seale then read a declaration written by Huey Newton and Eldridge Cleaver, urging that The Black Panther Party for Self-Defense calls upon the American people in general and the black people in particular to take careful note of the racist California Legislature which is now considering legislation aimed at keeping the black people disarmed and powerless at the very same time that racist police agencies throughout the country are intensifying the terror, brutality, murder, and repression of black people. After they left the capitol building and began to head home, they were surrounded by a battalion of cops and arrested en masse for conspiracy to disrupt a legislative session.

    NRA-approved, anti-gun-control conservative politician-saint Ronald Wilson Reagan was governor of California at the time all of this went down. When the Panthers showed up, Reagan ran and hid inside the capitol building. Shortly thereafter, he showed his commitment to the right to keep and bear arms by signing the Mulford Act after the state legislature passed the bill.

    Leftists and liberals have a word for polluters who pose as careful environmental stewards: greenwashing. We need a similar word for times when the eager beneficiaries of the corporate state pose as free-market entrepreneurs. A word, that is, for propaganda like the Enron ad.

    Of course, I’ve promoted the use of the word privateering for something that’s roughly in the neighborhood, but privateering is really suited to a different purpose (it has to do with a critique of phony privatization, which is often bundled with, but not identical to, phony deregulation; and it focuses on the phenomenon, not the use of rhetoric around it). So, what’s your best suggestion for a left-libertarian counterpart to greenwashing, when state capitalist firms pose as free-market entrepreneurs?

    My own best effort, to date, is gold-plating. Thoughts? Comment away.

Institutionalized sadism

See if you can figure out what all of these cases have in common.

Trigger warning. The stories below involve verbal descriptions, and a news video below includes repeated displays of silent but very graphic footage, of extreme physical violence by adult teachers and male police officers against young men, young women, and girls under their authority.

In Idaho, an eight-year-old girl who has been labeled with Asperger’s Syndrome was taken out of a class Christmas party at her government-run school, because she was wearing a hoodie with cow ears and a tail, which she refused to take off on the arbitrary orders of her teacher. For this minor dress code violation, she was stuck in a separate room and intervened with by a pair of teachers. While she was under their power, she peacefully tried to walk out of the room through an open door, so the adult teachers physically grabbed her and forced her down into four point restraint; when she screamed and tried to get out of the painful hold they had put her in, the teachers then called in the county government’s police, who came in, grabbed this 54-pound girl, handcuffed her, marched her out to a police car, and took her to a juvie prison, for battering the teachers who were physically restraining her when all she wanted was to be left the hell alone. This sustained assault by several different adults, some of them heavily armed, on an upset child, which has left her with bruises, is dignified as a scuffle by the newspapers:

The mother of an 8-year-old autistic girl who was arrested after a scuffle with her teachers said it was horrifying to watch her daughter be led away in handcuffs from her northern Idaho elementary school.

Police in Bonner County, Idaho, charged the girl, Evelyn Towry, with battery after the arrest Friday at Kootenai Elementary School.

Even though prosecutors dismissed the case Tuesday, the family is considering legal action against the school. They say their daughter was physically restrained to the point of causing bruises and is now tormented by memories of the incident.

… Towry said Evelyn, who loves Spongebob Squarepants, told her she was put in a separate classroom away from the party, but when she tried to leave, the teachers told her to stay put. Evelyn did not listen, Towry said, and the adults physically restrained her.

She reacted in a violent way to the physical restraint, Towry said.

Towry said her daughter demonstrated for her how she was held down by her arms and legs. And Towry videotaped the thumb-sized bruises she says were left on Evelyn’s legs from the incident.

She said I was very scared, Towry said. She told me she was being hurt.

Dick Cvitanich, superintendent of the Lake Pend Oreille School District, which includes the school where Evelyn was a student, said the school called police because there was escalating behavior that resulted in what we perceived to be an assault on staff.

No doubt; but who, in this situation, was doing the escalating?

Teachers and the principal wished to pursue charges because they felt there were ongoing problems and this was the only way to resolve it, Lakewold said.

But Towry said her daughter thinks she got into so much trouble simply because she didn’t want to take off her cow costume.

When asked what she likes best about school, Evelyn responded quickly and emphatically.

Nothing, she said. I don’t like school.

Sarah Netter, ABC News (2009-01-04): Parents Consider Legal Action After Autistic Girl, 8, Arrested at School

Meanwhile, in Occupied Seattle, a 15 year old black girl was taken to a government jail by the county government’s cops after she and a friend went on a joyride in her friend’s mother’s car. While under their power, according to the cops, she got quote-unquote real lippy over how they were treating her, and went so far as to call them some unkind names. Then, when she was being locked in a cell, the cops ordered her to take off her shoes; she kicked off one of the shoes towards the heaily armed cop who was about to lock her securely in a room she couldn’t escape from. Instead, he decided to take this escalating behavior as assaulting a police officer, which is of course a perfect opportunity for intervention — in this case, rushing the 15 year old girl, kicking her in the gut, slamming her against the wall of her cell, pulling her back by her hair, slamming her to the ground, pinning her down, and smashing her repeatedly with his fist while she was physically restrained by himself and his gang brother.

Meanwhile, in Texas, at the Corpus Christi State School [sic] — it is actually a government-run institution where about 360 people, ranging in age from 18 to 77 years old, are legally committed, temporarily or permanently, with or without their consent, for being labeled as mentally retarded, especially if they severe behavioral and/or emotional problems — about a dozen workers are under investigation after cell phone videos surfaced in which they rousted up some of the young men under their power, late at night, surrounded them, shoved them, kicked them, and goaded them into fighting each other for the entertainment of the trained, professional staff.

At a state institution for people with mental retardation in Texas, six staff members have been charged with taking part in staging what have been called human cockfights, using residents with mental retardation. […]

The fights became known only because one of the workers lost his cell phone. It was found and turned over to an off-duty police officer. The phone had videos of more than a year of staged late-night fights, some as recent as this past January.

Joseph Shapiro, NPR Morning Edition (2009-03-18): Abuse At Texas Institutions Is Beyond ‘Fight Club’

The criminal charges stem from allegations this week that Corpus Christi state school employees forced disabled residents into orchestrated, late-night fights over the course of more than a year. They were caught after they captured at least 20 of the episodes on a cellphone camera, one turned over to police.

Five of the suspects – Timothy Dixon, 30; Jesse Salazar, 25; Guadalupe Delarosa, 21; Vince Johnson, 21; and Dangelo Riley, 22 – are charged with injury to a disabled person, a third-degree felony. Their bail has been set at $30,000. A sixth suspect, 21-year-old Stephanie Garza, is charged with a state jail felony for allegedly failing to intervene in the fight clubs. Her bail is set at $15,000.

Arrest warrants obtained by The Dallas Morning News allege five of the employees encouraged, filmed or narrated the fights – which were documented in dozens of still images and 20 videos taken over six months in 2008. Riley is allegedly seen kicking a resident during a fight, while Dixon, who appears from the warrants to be the phone’s owner, is accused of doing much of the filming and narration. Four of the videos show residents sustaining injuries.

Texas authorities are outraged. But they would like us to know that this is an Isolated Incident:

He said he hasn’t heard of fight club scenarios at any other state schools.

I haven’t heard any other allegations yet, he said. So far, these circumstances, these staffers, appear to have been the exception.

Emily Ramshaw, The Dallas Morning News (2009-03-12): Texas officials make surprise visits to state schools after Corpus Christi fight videos surface

Right — an exception. Just like the literally hundreds of other exceptions that we were discussing here less than a year ago, which The Dallas Morning News, among others, have documented at Texas state mental institutions in the last 4 years — the use of physical threats, headlocks, chokeholds, tackling, dragging, beating, raping, to please the whims of Mental Health staffers or to dominate and control the patients unwillingly forced to endure their care. Meanwhile, at Corpus Christi alone in 2008 alone, there were nearly 1,000 allegations of abuse, neglect or mistreatment in 2008; 60 reports were confirmed by the administrators. 60 confirmed reports is bad enough, but what’s worse is how many of those unconfirmed reports must surely be the result of the usual institutional cover-ups and white-washes. How much do you think you could get away with if all your coworkers could be counted on to get your back, and if reports of abuse by your victims could be waved off as literally the product of insanity or feeble-mindedness?

AUSTIN – Cellphone videos of Corpus Christi State School employees forcing mentally disabled residents into late-night prize fights have left Texas families and advocates for people with disabilities in search of answers – not just about security but about human nature.

How can one human being treat another in such a wicked way? Experts disagree on the roots of such abuse. It might be a byproduct of the stressful situations people are in. It could also be innate sadism.

We are also told that maybe it’s a lack of education; maybe there’s something about the impersonal nature of large institutions; maybe it’s all peer pressure. But really, once the hand-wringing about human nature and peer pressure and all the rest is gotten out of the way, one explanation is always put forward, by those who have access to the media, as a matter of unquestionable consensus: obviously, Experts tell us, it’s the lack of training, the poor pay, and the lax supervision of the personnel who are put in the position of de facto prison guards for hundreds of institutionalized people. This is used as an entre into asserting the alleged need for more tax money, more prison guards, more Expert training — and insisting that these state institutions don’t have enough privileges and money from the state government; that they need even more money to hire and pay the very people who have turned their institutions into dangerous hellholes. E.g.:

But they [Experts] concur that the formula at Texas’ 13 institutions for the disabled – young, inexperienced and underpaid workers in charge of the state’s most vulnerable residents – lays the groundwork for disaster.

Left alone, human beings will engage in the most surprising kinds of misconduct and adjust their mentality to fit, said David Crump, a University of Houston Law Center professor who specializes in the psychology of evil behavior. We should expect this unless we take concrete and meaningful steps to prevent it.

Of course, if you’ve read this far, you’ll have no trouble believing that people are capable of all kinds of cruelty. But if you’ve read this far, you’ll also know that this kind of non-explanation is the worst sort of hogwash. People don’t, as a rule, pin and handcuff random little girls on the street; they don’t beat the living hell out of customers at their workplace who cop an attitude; they don’t run into college dorms late at night to intimidate and goad groggy students into fights for the purpose of bloodsport. Nobody but a lunatic does this sort of thing to people who can choose to interact with them or not to interact with them, or in social contexts where they are dealing with equals who have a right to make their own decisions about what’s for their own good and who can expect to be taken seriously if they complain about ill-treatment.

These horrors do happen, and people do them, over and over again, and they are perfectly predictable — but they are perfectly predictable only in a very specific social and political context. The NPR story acts surprised that in government institutions like jails and schools and mental wards — institutions that people are forced into, against their will, when they have been marginalized by their age or their psychiatric labels or by the socio-legal processes of criminalization — the people who, as the legally-designated enforcers of the government institution’s prerogatives, enjoy unaccountable power to restrain and order around the most vulnerable people in society, might abuse that power with this kind of cruelty. But in fact this is only surprising if you forget the fact that the people under their care have been made vulnerable, legally vulnerable, precisely in order to make the institution go on running with or without their consent, and if you forget everything you ever knew about how people act when they enjoy unaccountable power over victims who cannot leave, even if they pose absolutely no physical threat to anybody, and who will not be taken seriously if they should protest. This only looks like a surprise if, in short, you go on imagining that this sort of violence is an abuse of the systems of government institutionalization, rather than part and parcel of what these institutions represent. These things happen over and over again, not at random but specifically in nonconsensual government institutions, in the dedicated facilities of social marginalization and segregation under the auspices of State power. They happen not because of peer pressure or intrinsic sadism but because of power pressure and institutionalized sadism — and we hear about them, in every state of the Union and on every day of the week, one more Outrage after another, but without the dots connected, indeed with the dots carefully left un-connected, because of the enduring, and grotesque, faith that with just enough nonconsensual funding, with just enough careful training and professional dedication, you can somehow make a nonconsensual government institution run the right way, and you can somehow maintain the conditions of a prison camp without the violence that prison guards always exercise. In fact, these institutions are already running the right way, in a manner of speaking — this is Situation Normal. And there is only one thing that will ever change it — abolishing the conditions that nurture and sustain it.

The reality is that what is needed is not more money, or more guards, or better training, or even a culture change. A culture change would be a step forward, but the real solution that is needed is something that goes far deeper: a solution that strikes at the root from which that culture and these conditions grow. What is really needed is a power change, so that psychiatric wards are no longer artificially packed by court order, so that patients can leave and seek help through other means if conditions become unbearable, and so that supposed patients are no longer treated against their will and held down at the mercy of their helper-captors. If you make a hospital into a prison camp, then it should be no surprise when the hospital caregivers start acting like prison camp guards. The only thing to do — the only thing you can do that will not just recreate the same problem in a superficially different form — is to respect the will of patients, to treat violence against them as a real crime worthy of punishment, to repeal the laws that privilege and protect their captors, and to break open the doors and tear off the straitjackets that hold them back from living their lives as human beings, rather than as objects of pity and coercion.

Government cops protect you by dragging a bunch of unarmed young Black men out of a train and lining them up against the wall — in response to an alleged fistfight — and then forcing one of them down to the ground and shooting him in the back. While he is lying prone on the ground, surrounded, and physically restrained both by the shooter and by a gang of other heavily-armed uniformed cops.

Then government cops protect you from being tainted by knowledge of the incident by rounding up everyone in the crowd that they can get their hands on and seizing the cellphones they had been using to take videos. You have only seen these videos because some dastardly criminals hopped back on the train before the cops could grab them, and then set out to taint us all with the truth.

The cop in the video is a Bay Area Rapid Transit cop named Johannes Mehserle. His victim, Oscar Grant, was either shot in the back when he was already handcuffed, or handcuffed by Officer Johannes Mehserle after he had been shot in back, depending on which witness accounts you listen to. I’m not sure which is worse. In any case, no-one has produced any reason whatsoever why Oscar Grant — who was unarmed, who was clearly showing his hands just before he was forced down and shot, who was forced down on his back, who was being searched and held down by two cops, with a third standing by and a gang of other cops standing around only a few feet away — could pose any credible physical threat to anybody at all, let alone the sort of physical threat that would justify standing up and drawing a gun on him.

We are told that (of course, of course) it’s a terrible tragedy what happened, and we should feel in our hearts for all the people who suffered so much because of this incident, but Officer Johannes Mehserle didn’t really mean to shoot Oscar Grant in the back. Maybe he pulled his gun and pointed it directly at a completely helpless victim who was clearly unarmed and under the complete physical control of the police, and then — oops — slipped and fired his gun into an unarmed man’s back by accident. Maybe he meant to pull out his taser so that he could torture a completely helpless man lying prone on the ground who clearly posed no physical threat to anybody with powerful electric shocks, but — oops — he just got so freaked out by The Situation that he couldn’t tell his hay-foot from his straw-foot and he accidentally whipped out his handgun instead, from a holster on the opposite side of his belt, even though it’s a completely different size and shape and weight, and then pulled the trigger and shot an unarmed man with a bullet instead. And, of course, none of this means a goddamned thing.

As I have said, and at the risk of controversy I will repeat: it doesn’t matter if Mehserle meant to pull the trigger. He had already assumed the role of sole arbiter over the life or death of Oscar Grant. He had already decided that Grant, by virtue of his skin color and appearance, was worth less than other citizens. And rather than acquitting the officer, all of the psychological analyses and possible explanations of the shooting that have been trotted-out in the press, and all the discussion of the irrelevant elements of Grant’s criminal history, have only proven this fundamental point.

If a young black or Latino male pulls a gun and someone winds up dead, intention is never the issue, and first-degree murder charges are on the agenda, as well as likely murder charges for anyone of the wrong color standing nearby. If we reverse the current situation, and the gun is in Oscar Grant’s hand, then racist voices would be squealing for the death penalty regardless of intention. And yet when it’s a cop pulling the trigger, all the media and public opinion resources are deployed to justify, understand, and empathize with this unconscionable act. One side is automatically condemned; the other automatically excused.

George Ciccariello-Maher, CounterPunch (2009-01-09): Oakland’s Not For Burning?

Of course, there are two kinds of privileges: sometimes the problem is that a select class of people get consideration that everybody ought to be getting, but other people, not in the privileged class, are unjustly denied. And sometimes the problem is that a select class of people get special consideration that nobody ought to be getting, no matter their social class. Ciccariello-Maher doesn’t make it clear which kind he means, but in this case, the handwringing and We’ll never know chanting and endless excuse-making in the effort to convert manslaughter or murder into nothing more than another Oops, our bad is an example of the second kind. Given the observable facts of the case, there is nothing that could possibly have been going through Officer Johannes Mehserle’s head that could justify this execution-style shooting. If he went drawing his gun on an unarmed and prone and physically helpless man, who posed absolutely no credible threat to him or anyone else in the vicinity, and then, in the course of swinging his gun around, ended up firing it off, somehow, by accident, then he is guilty of criminally negligent homicide. If he planned to shock the hell out of someone who he had no reason to shock and ended up shooting him instead, by accident, then he is guilty of committing felony murder in the course of committing assault and battery. If he shot Oscar Grant intentionally, then, whatever may have been going on in his head about combs in Oscar Grant’s pocket or the folks in the crowd who were booing him from several feet away behind a line of other cops, or the hard, stressful life of a transit cop, then he is guilty of murder in the first.

And then we are told by self-righteous cops and their sado-fascist enablers that (of course, of course) it’s terrible what happened, and maybe Officer Johannes Mehserle overreacted, and zigged when he should have zagged, but really, we shouldn’t rush to judgment, and really, it’s not his fault, because, after all, there was a crowd of unarmed people several feet away, behind a line of other heavily-armed cops, yelling unkind words at him and making allegations as to the character of the police and watching what they were doing; maybe he became so confused and terrified by all this that, consummate professional though he may have been, he just lost all control of his rational faculties, and — oops — it just seemed like a good idea at the time to stand up and draw on an unarmed man being held down face-first on the ground in front of him. So it’s really the crowd’s fault:

We can wait for the official report on the shots fired but the earlier parts of those amatuer [sic] videos are also chilling for the hate-filled crowd reactions to what was, prior to the gunshot, a routine police encounter. We cannot long continue to police in a nation full of antagonists toward law and order. You can find it in videos all over the internet - crowds taunting, jeering, threatening, and obstructing police officers who are engaged in taming disorder.

Well, great. Then let government cops quit. Please. As if anybody ever asked them to go around policing like that in this nation. When government cops go around like this, protecting the hell out of us all, then they need to be taunted, jeered, threatened and obstructed until they stop.

It’s not entirely clear yet what happened during the incident, and it may never be. [Oscar Grant] was apparently not one of the initial group dragged off the train—one of the videos shows him unrestrained and standing up, trying to intercede with the police. According to witnesses, he was trying to de-escalate the situation between the cops and his friends. This is not an isolated incident, not by a long shot. This kind of thing happens all the time: out-of-control police violence in response to non-violent communication. It happens to people of color, and to queer folks too. It happened to me and Jack a little more than a year ago, along with a group of colleagues and friends, for asking the police why they were making an arrest. An officer decided to pepper spray our group, without any real provocation. We’re lucky, and privileged, that it wasn’t a gun.

Who knows what’s going through these cops’ heads? Are they freaking out, paranoid, fearful, are they untrained, do they have no idea what to do? What really matters to me is that they’ve been given weapons to use, and they’re wiling to use them at the slightest provocation, up to and including lethal force. What matters is that any questioning of their authority, whether you’re holding a camera or trying to de-escalate a situation, is seen as a challenge that has to be put down, by taking your stuff away, or crowd-controlling you, or killing you. We should all be scared. Especially if you’re part of a frequently-profiled community.

I want to stress one more thing. The news is reporting that the police felt outnumbered. This is exactly the same reason they gave for pepper-spraying the crowd that Jack and I were in. But let’s be clear — it doesn’t have anything to do with numbers. If it had been a quiet crowd ignoring the police and just sitting on the train, the numbers wouldn’t matter. They felt outnumbered because a lot of people watching were demanding to know what was going on, yelling, and refusing to just mind their own business. People who were demanding to know what was happening, because they know that abuses happen far too often and take far too many lives, and that someone has to watch the watchers.

Unfortunately, to police this makes you the enemy, especially if you’re making your voice heard, yelling, demanding to know what’s going on. The police, whether because of training or inculcated philosophy or temperament, see this as a potential riot, and they escalate the situation.

The plain fact is that what we have here is one of two things. Either we have a professionalized system of violent control which tacitly permits and encourages cops to handle any confusing or stressful situation with an attempt to dominate everyone in the vicinity by means of threats and overwhelming force, including attempts to retaliate or terrify people into submission by using violence — up to and including lethal violence — against powerless people under their physical control. Or else we have a system of government policing which has clearly demonstrated that it can do nothing effectual to prevent this from happening, over and over again. The Las Vegas Metro police department has a new mobile gang of cops devoted to a saturation strategy in targeted inner city neighborhoods:

Here are three things that you ought to know about how Metro decides who doesn’t belong, and how they get the bad guys off the street.

First, cops in the saturation team gangs pick and choose whether or not to come down on any given person who is breaking the law. They openly state that they make these decisions based on who they want to hassle and bust and pull off the street, and they openly state that they decide that based on where you’re from, how much money you make, and other proxies for racial and socio-economic status.

Second, as you may have already guessed, if one of Metro’s sat gangs decides that you’re the sort of person they want to lock in a cage, rather than the sort of person they’ll shake hands with and let go, they will use any chickenshit charge they can make up in order to justify getting in your face, demanding that you explain yourself and justify your existence to them, and, if they aren’t satisfied, grabbing you off the street and throwing you in jail.

They use whatever laws are at their disposal because, of course, they don’t actually give a damn about the law. This is outcome-driven policing, and the law is just an excuse to bust the people that they’ve already decided don’t belong. That’s because the purpose of these teams is not to stop or respond to crimes; it’s to control people, and in particular to force the the socio-economic cleansing of undesirable people from the cop-occupied neighborhoods. This kind of arbitrary rousting of someone, based on absolutely nothing other than a paper-thin pretext and the cop’s conviction that somebody’s probably up to trouble, is dignified by Las Vegas Metro cops and their sycophants at the Review-Journal as old-school policing with professionalism and an innovative, proactive approach to policing.

Third, here is how members of the saturation gangs talk about themselves to a sympathetic press:

Well. I feel safer already.

I should say that when I refer to cops as a street gang or Gangsters in Blue or what have you, I’m not indulging in metaphor. I don’t mean that cops act kinda like gangsters (as if this were just a matter of personal vices or institutional failures); I mean that they are gangsters — that is the policing system operating according successfully to its normal function — that they are the organized hired muscle of the State, and that the outfit operates just like any other street gang in terms of their commitments, their attitudes, their practices, and their idea of professional ethics.

The Nine have decided, without explanation, to let the State of Georgia go ahead with its proposal to murder Troy Davis at a time and place of their choosing. They are apparently acting in the belief that making sure all the paperwork stays settled, preserving the institutions of monopolistic legal finality, and practicing due deference to other judges’ turf, matters more than something as paltry as whether or not an innocent man is about to be killed for a crime he did not commit.

Here is what I got last evening from Amnesty International USA:

Dear Charles,

Today, the U.S. Supreme Court declined to hear Troy Anthony Davis’ appeal. His fate is back in the hands of Georgia authorities who may seek a new execution date at any time.

The Supreme Court’s decision to deny Troy Davis’ petition means that no court of law will ever hold a hearing on the witnesses who have recanted their trial testimony in sworn affidavits.

Doubts about his guilt raised by these multiple witness recantations will never be resolved. An execution under such a cloud of doubt would undermine public confidence in the state’s criminal justice system and would be a grave miscarriage of justice.

The state of Georgia can still do the responsible thing and prevent the execution of Troy Davis:

As I said in my earlier post:

First, I should say that, as a matter of fact, it does not matter to me — and it should not matter to you — one bit whether or not Troy Davis really is responsible for the killing he’s alleged to have committed, or, if he is responsible, whether or not the prosecution legitimate proved their case in the midst of what appears to have been a very dirty bit of business by the Gangsters in Blue. There seems to be good evidence for massive police misconduct, and for the likelihood of Davis’s innocence. This evidence is important, and let’s go ahead and scream about it as much as possible to the men and women sitting in the court and corrections system, if it will save Troy Davis from the gallows.

But, just between us, we need to remember that even if he were obviously guilty as hell, the State has no right to commit premeditated murder in order to make him pay for it. The penalty of death is the ultimate, definitive expression of the State’s cold and sadistic violence, exercised with no defensive purpose and against women and men who no longer pose any threat to any living soul, on the theory that in the end your body and your life belong to the State, and can be mutilated and destroyed by it, at its pleasure, for its own special purposes — whether to exact blood vengeance, or to send a message to unrelated third parties, cut into your body by the Harrow of the criminal justice system. It is nothing more and nothing less than State-sanctioned murder, and it ought to be abolished immediately, completely, and forever.

Second, you should also note, from this story, that in the view of the Georgia Supreme Court, final arbiter that it is, getting all the paperwork settled once and for all is apparently more important than whether or not an innocent man will be slaughtered on the basis of lying testimony extracted by intimidation and coercion at the hands of an overzealous police department, desperately seeking a black cop-killer to lynch. You may find this appalling; but it should not be surprising. This approach to The Law is essential to the very nature of the State and its legal system. Authority is held to take precedence over fact and evidence; imposed finality is held to take precedence over justice, even when it comes to punishments that are utterly irreversible, destroying forever any hope of appeal. Otherwise, anyone might just go around any old time and prove somebody’s innocence and spring them from the prisons or the gallows, a judge’s say-so notwithstanding; a journalist’s expose or an ad hoc committee’s discoveries and reasoned decisions might be just as good as that the Nine. Without sovereign authority to stand between the people and justice, doing justice would be nothing a mere human institution, open to anybody who can do some research and submit facts to a candid world. Why, it’d be Anarchy! So instead, paying due deference and having the right stamp on the right papers and uttering the right ritual incantations is held to be more important than somehing so paltry as a man’s life. That is the Majesty of the Law; that is its morality; that is its justice.

Trigger warning. The following videos of local news stories include graphic footage of extreme physical violence by a male police officer against a woman in his custody.

Cops are here to protect us by arresting a black trans woman on charges of possibly being willing to engage in consensual sex acts that violated nobody’s rights, then throwing her in a booking area as a lead-up to locking her in a cage, then using transphobic and homophobic slurs when ordering her to get up in order to be fingerprinted for having allegedly committed this non-crime, and then, should she refuse to get up in response to that kind of language, and instead go on sitting in her chair, threatening nobody, cops are here to protect the hell of of her by getting up in her face, wrapping a pair of handcuffs around their knuckles and bashing her head in with them over and over again, while sheriff’s deputies stand around and do nothing, and while a fellow cop runs up to hold her down in her chair — stopping eventually to pepper spray her, handcuff her behind her back, and then leave her lying helpless on the floor.

Please note that, according to Memphis Police Officer Bridges McRae, refusing to immediately follow a police officer’s bellowed command over a minor matter of paperwork is a crime which can rightfully be punished by a vicious gang beat-down. And according to the rest of the Gangsters in Blue on the scene, it’s a situation which calls for standing aside, or actively rushing to the aid of, their gang brother — and to hell with the suspect woman being assaulted.

MEMPHIS, TN (WMC-TV) — Video obtained by Action News 5 shows a Memphis police officer beating a suspect at 201 Poplar in an apparent case of police brutality.

The video, recorded February 12th, shows Duanna Johnson in the booking area at the Shelby County Criminal Justice Center after an arrest for prostitution. The tape clearly shows a Memphis police officer walk over to Johnson — a transsexual — and hit her in the face several times.

Actually he was trying to get me to come over to where he was, and I responded by telling him that wasn’t my name — that my mother didn’t name me a faggot or a he-she, so he got upset and approached me. And that’s when it started, Johnson said.

Johnson said the officer was attempting to call her over to be fingerprinted. She said she chose not respond to the derogatory name the officer called her.

He said, I’m telling you, I’m giving you one more chance to get up. So I’m looking at him, and he started putting his gloves on, and seen him take out a pair of handcuffs, Johnson said.

The officer hit Johnson several times with the handcuffs wrapped around his knuckles. In the video, you can see the flash of the metal. The tape shows another officer holding Johnson’s shoulders as she tries to protect herself.

After taking several blows, Johnson stands up and swings back.

I was afraid. I had had enough. Like I said, I thought the other officers that were witnessing this would at least try to stop him, Johnson said. I mean, he hit me so hard. Like the third time he hit me, it split my skull and I had blood coming out. So I jumped up, Johnson said.

But then she sat back down, and the officer her in the face again. Then he maced her. On the tape, other people in the room are seen turning away and fanning their hands because of the smell.

[…] On the tape, Duanna is eventually handcuffed and left on the floor. A nurse comes in, and goes directly to the officer.

I couldn’t breathe, and they just made me lay there, Johnson said. Nobody checked to see if I was okay. My eyes were burning. My skin was burning. I was scared to death. Even the nurse came in and she just ignored me, and I begged her to help me.

After this brutal gang assault committed in full view of a security camera and several witnesses, McRae had the audacity to file a charge of assault against Duanna Johnson. And then to file an internal affairs complaint against the detective in the booking area for standing by and doing nothing, instead of joining in on the beating.

This happened back on February 12th. At the time that it happened, the D.A. dropped all charges against Johnson. The rookie cop who held Johnson back in her chair during the beating, James Swain, lost his job. On the other hand, Bridges McRae, the thug who was actually bashing the poor woman’s head in, was given a paid vacation from street duty (at a $49,000 / year salary) for four months, pending an administrative disciplinary hearing, which he repeatedly delayed using sick leave and other excuses, after which he finally lost his own job. Neither of these brutal and dangerous thugs has yet faced any criminal charges for this videotaped assault.

Meanwhile, the Fraternal Order of Pigs has provided McRae with a lawyer, who is helping him appeal the decision to fire him from the police force. The lawyer wants you to realize that the mere evidence of your senses is no reason not to give a violent cop the benefit of the doubt:

McRae is the officer seen in the video repeatedly hitting Duanna Johnson in the booking area at 201 Poplar. McRea had arrested her for prostitution, but the charges were later dropped.

In the video, you can see McRae hitting Johnson with what appears to be handcuffs. Memphis Police Association attorney Ted Hansom, representing McRea, said Thursday that handcuffs were not used as a weapon by the officer.

Once it starts, the handcuffs were out to handcuff that person, Hansom said. You don’t have time to say let me put these down and then we will resume this.

Hansom said the video shows a different story when it is slowed down. […] Hansom said the video is not the whole story, and it will be his job to explain it all.

[…] The video shows McRae hitting Johnson in the face. She was also pepper sprayed. But it also shows Johnson hitting McRae at least once.

Hansom points out that there is no audio on the video so you do not know what is being said.

He also said McRae had reason to believe the 6 Feet 5 inch Johnson was a threat. Hansom said he has studied the video.

I saw some actions on the complaining party. So if they are coupled with statements or prior conduct or dealing with this person and knowing the size of that person might put you in apprehension of what’s going to happen, Hansom said.

Along the way this class act demonstrates his sensitive awareness of issues surrounding police brutality in some communities:

The way he is being depicted with just this video tape. It doesn’t tell the story. It’s the Rodney King approach [sic!]. Lets look at a few minutes of video and make our decisions. It’s not that simple, Hansom said.

And informs us that merely refusing to refuse an order to stand up, while you are in a secure area, is apparently enough to count as a threat to the safety of a heavily armed cop surrounded by other cops:

Hansom said the video shows a different story when it is slowed down. He said it is clear Duanna Johnson could easily have been considered a threat, because she was in a secure area and was refusing orders from Bridges.

The Shelby County Sheriff’s Department, which runs in the jail in which McRae beat the hell out of Duanna Johnson, is mainly concerned to deny any responsibility (because their flunkies stood by and did nothing but watch in the course of this brutal beating), and to launch a criminal investigation into who finally made this tape, which should have been public knowledge four months ago, available to the newsmedia.

I know, I know. In any big police department there are A Few More Bad Apples, and every now and again there is just going to be Yet Another Isolated Incident. Sometimes life is like that. Terrible things like this just happen. Sometimes there are no red flags, no real warning signs.

McRae was fired after an administrative hearing for beating a transgendered woman he arrested Feb. 12 for prostitution. The video, which didn’t record sound, showed the officer repeatedly hitting Duanna Johnson in the intake area of the Shelby County Jail at 201 Poplar. Johnson said McRae made derogatory remarks. McRae is shown hitting Johnson and then using pepper spray.

McRae’s personnel file showed only three reprimands for minor offenses during his nearly four years on the force. His latest evaluation said he exceeds expectations.

When Catholic bishops engage in this kind of practice with priests accused of child sexual assault, it’s called a conspiracy and a massive cover-up. When the boss cops do it, it is treated as if it were a perfectly mundane bit of bureaucratic detail, as just so much business as usual.

The comments on the local Memphis newspaper stories are actually more encouraging to me than I expected them to be. I’m heartened to see as many people as I do with the empathy and the courage necessary to speak out about this kind of outrage in public, and to call out the Mephis Police Department as an institution. But there is also the usual sado-fascist howling that you would expect, and the usual efforts to use absolutely any prejudice available against the victim of violence in order to smear her, ridicule her, and exonerate the cops for absolutely anything they might do to her. If you needed any more convincing on this point, take this as evidence that, even if it is on tape, even if it is in a public place in front of a crowd of witnesses, if you fall under one or more demographically suspect categories, there is absolutely nothing a cop could do to you that would be so low, so vile, so obviously over-the-top, or so brutal that cop couldn’t still count on hordes of Law-‘n’-Order creeps to befoul every public forum with victim-smearing and fabricated excuses on his behalf. He can fully expect that no matter what he might do, in full view of other police officers and a camera, still other officers will either stand by and do nothing, or come running to his aid, and that unless the tape reaches the media, he will almost certainly never face any personal consequences whatsoever for doing it. If he had walked up and shot her in the face I wouldn’t expect anything more to happen to him than what has happened to him so far. The Gangsters in Blue get each other’s backs, and it’s likely that nothing would ever have happened to him at all, beyond yet another unfounded complaint being recorded in his closed IA file, except for the fact that somebody bravely defied the law to get this tape out to the newsmedia.

The truth is, when every fucking week brings another story of a Few More Bad Apples causing Yet Another Isolated Incident, and the police themselves almost invariably doing everything in its power to ignore, cover up, excuse, or minimize the violence, even in defiance of the evidence of the senses and no matter how obviously harmless or helpless the victim may be, it beggars belief to keep on claiming that there is no systemic problem here, that cops ought to be given every benefit of the doubt, or blanket condemnations of policing in major American cities are somehow a sign of hastiness or unfair prejudice against good cops. The plain fact is that what we have here is one of two things: either a professionalized system of violent control which tacitly permits and encourages cops to exercise this kind of rampant, repeated, intense, and unrepentant abuse against powerless people—or else a system which has clearly demonstrated that it can do nothing effectual to prevent it. In either case, it is unfit to exist.

One of the things that I said in my speech about ALL to the Libertarian Party of Clark County, which was deliberately provocative and carefully worded, was I am here today to bring you two messages. So let me cut to the chase and deliver both of them right now. They are the point of this entire talk, and I can put them both in ten words or fewer. Here’s the first: Las Vegas will be free soil in our own lifetimes. And the second is: We are all going to make it happen. That may seem ridiculously optimistic, given the immensity, the scope, the pervasiveness, and the ruthlessness of the many-headed monster we call the modern State. I try to discuss a bit in my speech why it is not overly optimistic, focusing on the second claim — that we all, meaning not ALL or the Libertarian Party, but just about everybody in Las Vegas — can and will take part, if those of us who care about these things play our cards right, through the use of populist organizing, coalition building, direct action, and counter-economics.

But another thing that I didn’t focus on much, which I’d like to mention, is the importance of the first thing I said, when I said Las Vegas will be free soil. I said that, and not something else (the U.S. will be free soil; the word will be free soil) because I think that’s an achievable goal. It’s not that I don’t want the whole U.S., or indeed the entire earth to be free soil; it’s not even that I think either couldn’t be free soil in the forseeable future. They could; I hope they will; if I can help, I will. But Las Vegas is where I live, and where Southern Nevada ALL intends to act, and I think it’s immensely important to begin there, and not to sell yourself on the idea that action has to be directed against the largest possible targets, or, more importantly at trying to strike some decisive blow at those targets that will somehow defeat Power everywhere and forever. Real empires almost never fall that way, unless they are conquered by some outside force, usually another rising empire, and for anarchists that’s not an acceptable option. So we need to think about getting the empire to crumble, not to implode, and to help it along by chiseling wherever and as hard as we can. If we win, it will crumble in some places faster than it will crumble in others. The basic problem is that a central aim of the imperial State has always been to get people to forget, effectively, about their neighborhood, their friends, their family, and everything else actually around them, and to understand their homeland in strictly political terms, in terms of a flag and a set of lines on the map and a capital hundreds or thousands of miles away. If anarchists ever want to get anywhere, we’re going to need to break that link, to pry people’s notion of home from out the talons of the State and its notion of political citizenship. Which strategic point brings me to a really excellent recent post by Jeremy at Social Memory Complex (2008-06-13), which is working towards some of the analysis that goes along with:

I think it does. Is the lobbyist-driven agenda of corporations, special interests, and political culture really any less distant than U.S. foreign policy? Do we have any authentic control over the decisions in our society that affect us? Or are we just treated as fungible units of polity that have only to be deftly mobilized by public relations wizards in pursuit of an agenda fundamentally alien to us? What, in other words, is the difference between our powerlessness within the borders of the U.S. and the powerlessness endured by the residents of Iraq and Afghanistan?

Instead of contrasting our experience under our government with that of its foreign victims, we might do well to compare the experiences. We’ve been taught from a very young age to distinguish American citizenship from that enjoyed by citizens of other countries, chiefly by virtue of our unique institutions of governance. But it is these same institutions that are being built in Iraq: a democratic, constitutional government with corporate control and obedience to international capital, with an established U.S. military presence to ensure stability in the region. These features are proving just as confounding to their freedom as their American counterparts are for us.

Through overwhelming military force, claims of moral privilege, and alleged threats - not unlike the P.R. which allowed the U.S. to conquer the west and the south in the 19th century and frame it as liberation - the U.S. government is imposing a democratic government and a market economy on an unwilling people. Meanwhile, the U.S. government is also continuing to ratchet up the police state at home even as it practices martial law in Iraq. Just as there were Tories and other people loyal to the crown during the American Revolution, the federal government finds plenty of lackeys in the fifty states, Iraq, Afghanistan, and indeed throughout the world to do their dirty military or paramilitary (law enforcement) work. Legislative creep and sheer audacity constantly expand the scope of lawful authority, defining down the degree of liberty an individual can expect to enjoy. Participation in the decisions that affect us is framed as a set of predetermined choices provided by the establishment rather than a direct say at the local level. And all of these features bring more and more of the world under direct control of Washington - both the world within U.S. borders and the world outside them.

For it is into Washington, in the District of Columbia, that all the spoils of these policies flow. The D.C. metro area is among the fastest growing in the nation, despite having no productive civilian industry to speak of (except perhaps I.T., but no more than any other city if you discount government contracting). Not only is it the seat of governance for the country, it is the clearing house for the international policy of most nations. By enticing Americans to “work within the system” to influence policy, citizens legitimate the process by which power and authority are steadily concentrated. An entire lobbying industry has sprung up from the need to have some say in this process; doing business in the empire has a high cost of entry, and once you get a seat at the table it’s plunder or be plundered. As more people see D.C. as the place where decisions are made, rather than local governments or foreign capitals, the amount of money and people pouring into the city will continue to grow, while localities and other countries become bureaucratic appendages of D.C. policy.

But it’s not just that Washingtonians rule over an overseas empire; it’s that domestic U.S. territory is increasingly treated as part of the conquered territory, rather than as the source of state legitimacy. Sure, we have elected representatives we send to D.C. from all over the country, but experience shows that only in the rarest of occasions do they not adopt the Beltway outlook of going along to get along with the system. Instead, they play the game to bring home as much of the spoils of empire (taxation and government contracts for further imperialism) as possible. In the process, they cease to represent their constituents in D.C., preferring to represent the Washingtonian agenda in their respective localities. They become little Paul Brehmers, advocating policies that promote the more effective rule of the domestic and foreign empire. They measure success in terms of how they can coax or coerce the locals into compliance with necessarily foreign interests.

If it is policies in Washington, D.C. that are changing this country into an empire, it is inaccurate to label the empire American. Clearly, the vast majority of Americans are not participating in it, but are merely preferred subjects in territory as occupied as that in Iraq and Afghanistan. The Washingtonian Empire is the largest, richest, most powerful, most hierarchically distributed, and most subtly maintained in history. We should stop trying to get people to take responsibility for the decisions of a foreign city-state, because this only encourages the conflation of their American identity with an alien one.

By drawing on our revolutionary, anti-colonial legacy, we can frame the American political experience as one of historically consistent subjugation. We can then find common ground with other victims of American imperialism while articulating an authentically decentralist agenda.

Let me just add that one of the most important dimensions in which to emphasize the nature of America as occupied territories is the connection with the daily lives of the most thoroughly oppressed and exploited people under the bootheels of the United States government and its praetors and proconsuls: especially black people, brown people, poor people, immigrants, people labeled crazy, women (especially the women most marginalized and criminalized by the government and civil society), etc. etc. etc. During the 1960s, the Black Panthers, the Young Lords, and many other New Left liberation groups explicitly linked the conditions and struggles of people in the brutally police-occupied, white-controlled ghettoes of the U.S. — which were founded in slavery, lynch law, apartheid, and immiserating land grabs, which were treated politically as presumptively criminal, unruly elements of the body politic, to be reformed, contained, or eradicated; which were regimented and patrolled on every street corner by the occupying paramilitary forces of the white government — with the conditions and struggles of colonized peoples throughout the so-called Third World, recognizing that just because the lines on the map separated Harlem and Watts from Johannesburg and Nairobi, the people in each had far more in common with each other than any of them had with the handful of white men sitting in the halls of power in D.C., in London, and elsewhere. The false dignity of a morally and practically meaningless imperial citizenship was dismissed; in its place was offered self-understanding for people facing the violence of colonization and solidarity with people rising up against Power in their own homelands throughout the world. In the 1970s, Detroit feminists elaborated the thought by pointing out that, in an important sense, women throughout the world constituted a Fourth World, which faced subjugation and colonization at the hands of petty patriarchs and male States, whether those sites of colonization were located in the capitals of First, Second or Third World regimes. Anarchists can and should learn these lessons well, and take the thoughts to their logical completion, by showing how the State, just as such, always and everywhere, operates as a colonizing force, against all its subjects, and for the profit of the handful of beneficiaries who constitute the ruling class. (Of course, the fact that it operates like this against us all does not mean that it operates this way against all of us to an equal degree. The point here is not cheap sympathy; it’s solidarity, especially with those who are the most trodden upon by this monster State.)

While the legacy of 1776 is worth understanding and learning from, and an important weapon to turn against the power in Washington; but so are many other things, and I think it is vital for the Libertarian Left to take up and learn from this tradition in articulating our anti-imperial theory and practice.

You talk of simplification. But if you can simplify in one point, you can simplify in all. Instead of a million laws, a single law will suffice. What shall this law be? Do not to others what you would not they should do to you: do to others as you would they should do to you. That is the law and the prophets.

But it is evident that this is not a law; it is the elementary formula of justice, the rule of all transactions. Legislative simplification then leads us to the idea of contract, and consequently to the denial of authority. In fact, if there is but a single law, if it solves all the contradictions of society, if it is admitted and acceptedby everybody, it is sufficient for the social contract. In promulgating it you announce the end of government. What prevents you then from making this simplification at once?

There are a couple of different kinds of malign spontaneous orders that need to be differentiated here.

The first are malign undesigned orders that emerge, in part, from diffuse forms of violence — what I called “invisible fist” processes, as with the socio-cultural ripple effects of stranger-rape and other prevalent forms of violence against women.

The second are malign orders that don’t emerge from diffuse forms of violence, but rather from voluntary interactions. Unlike some libertarians, I believe that there are plenty of examples of these, too (for example, certain kinds of widespread credentialism and elitism that have emerged over the past century, and which have a big effect on education and on the workplace). These malign undesigned orders are often intimately connected with social orders that have coercive elements (for example, I’d say that certain pernicious forms of credentialism and managerialism, which contribute to classism and to the exploitation of working folks, have an awful lot to do with consistent government intervention on behalf of the managerial class and against the deskilled proletariat over the past century — cf. for examples my essay Scratching By at http://www.fee.org/publications/the-freeman/article.asp?aid=8204 or Kevin Carson’s Mutualist Blog at http://mutualist.blogspot.com/) — but, while intimately connected, are not identical with them (it’s likely that even without that government intervention they might live on through institutionalized cultural prejudices, unless deliberately confronted and undermined).

Libertarians and anarchists can consistently endorse the use of physical force as part of the response to the former (violent) sort of undesigned order; they can’t consistently endorse the use of physical force as part of the response to the latter (non-violent, but still ugly) sort of undesigned order.

In the second case, though, I ought to stress that not abandoning the use of force doesn’t mean abandoning the use of confrontation or hardball tactics—they just have to be carried out through tactics and institutions outside the political arena, the legal arena, or the regulatory bureaucracy. (On what should be done instead, I’m really an old Leftist at heart: I think people should form fighting unions and community organizations, build counter-institutions and mutual aid societies, use targeted and general strikes, boycotts, work-to-rule, hardball forms of social ostracism, stage sit-ins, etc. etc. etc. Forget about the government; we can do this ourselves.)

In the first case, the use of countervailing physical force in defense of self or others is defense, not aggression, so it need not offend any libertarian or anarchist sensibilities (unless one is a principled pacifist—which I’m not, and which most libertarians and anarchists aren’t either). You worry that that force will need some agreed on norms of justice and enforcement. I’m inclined to agree with that (although we might disagree on what the importance of agreement is here). But supposing that we do agree, I don’t think it tells against Jim’s point. Agreed-upon norms of justice and enforcement aren’t in and of themselves a problem for anarchism or libertarianism. The question is how the agreement on those norms is brought about: whether the agreement comes about by general acquiescence to privileged demands, or whether it comes about by means of a broad consensus among equals.

Government ensures agreement upon these norms by erecting privileged institutions which are legally empowered to force everyone else to acquiesce to the norms they propound and act on.

Anarchy, on the other hand, doesn’t mean chaos or the break-up of any agreed-upon norms of justice or enforcement. (At least, that’s not what anarchy means in the mouths of anarchists who use the term.) What it does mean is that any agreement upon those norms should be brought about through the free interactions among equals and by the emergence of a broad social consensus.

Further, anarchists generally believe that that kind of consensus can rightfully be acted on by any free association that puts reasonable norms for justice and enforcement into practice — rather than being limited to a privileged class of government-approved cops, judges, etc. The idea here being that the justice of judgments and the righteousness of enforcement are things that ought to be assessed on the merits of the conduct itself, not according to the identity or the political status of the judge or the enforcer. That is to say, that it should be considered as a matter to be resolved by appeals to the content of the norms, rather than to the political status and prerogatives of the body propounding them.

So the ideal here is not to abolish any general norms of justice or enforcement, but rather to keep the ideal of consensus on norms while detaching the crafting of the consensus from the imposition of exclusive government-granted prerogatives.

Thomas replied with some comments on professionalization and specialization in the law, which are the main thing that I want to focus on today. In part because the issue is interesting and important in itself; in part also because the way that police forces and the legal system operate today is, in many different ways, ideologically dependent on the idea that we need to turn a great deal of our lives and freedom over to a cadre of trained, specialized legal professionals for our own protection and in order to ensure justice and social peace. He wrote:

Probably so, although I’m inclined to think that there is, or ought to be, much LESS specialization and craft than the professionalized government enforcers and judges would have you believe. To be sure, the government laws that are on the books today are tremendously complicated and require years of specialized training and practice to even begin to get a good grip on a relatively small specialty. But I think that that’s precisely because the people who make and use the laws have a political and a professional interest in making those laws extremely complicated, and in having them cover an extremely wide and not very well defined scope of human affairs. Libertarians and anarchists believe that regularized enforcement should cover a much more precisely delimited and a much, much smaller field than it currently does, so to some extent the problem vanishes along with the laws that libertarians and anarchists believe ought to be abolished.

For example, labor relations law as it presently exists is extremely complicated — it requires making a lot of very fine distinctions, balancing many different prerogatives granted to and regulatory limitations imposed upon unions, individual employees, and employers, etc. etc. etc. It takes a lot to even understand the basics of the situation, and the tricky details of a concrete case often can’t even be resolved without hashing out the issues in bureaucratic negotiations through the NLRB or in federal court. But the complexity of the legal situation is clearly a function of its being channeled through the federal regulatory bureaucracy. That situation clearly benefits NLRB bureaucrats and professional labor lawyers; it’s much less clear that it benefits the rank-and-file workers for whose benefit this sort of thing was supposedly constructed, but who are substantially deprived of any real control over the process by putting so much of it into the hands of professional legal experts. If agreed-upon norms of justice and enforcement were (as anarchists believe that they should be) limited only to the issue of protecting innocent people from being attacked by physical force, or vindicating their rights after the fact if they should be attacked — with all the rest to be handled by free contracts between the individual parties, unregimented by a government bureaucracy, and by whatever forms of nonviolent leverage and activism that the creativity of organized workers and a fighting union might devise — then it’s much less clear what need for specialization or professionalization there would be. (There might still be a lot of need for impartial arbitrators; but impartiality is distinct from technical expertise, and is something you can get by finding any third party of good will and good sense for the duration of the arbitration; it doesn’t require a distinct class of professional arbitrators.)

Generalizing from that case, I agree with Lysander Spooner that if the realm of enforcement were strictly limited to questions of interpersonal justice, then, quote:

No objection can be made to these voluntary associations upon the ground that they would lack that knowledge of justice, as a science, which would be necessary to enable them to maintain justice, and themselves avoid doing injustice. Honesty, justice, natural law, is usually a very plain and simple matter, easily understood by common minds. And I would follow up your second point by urging that it is dangerous, and to some degree irresponsible, to adopt large-scale systems of law and practice that practically require ordinary citizens to abandon the questions of political and interpersonal justice to a privileged, insular, and easily corrupted class of specialists.

But, secondly, I would also argue, further, that even if the requirements of justice ARE complicated enough in some particular case that it requires some specialized training and expertise to sort them out, or where correctly applying and implementing them requires specialized training and expertise in something else (e.g., for enforcers, training and expertise in de-escalating potentially violent situations may be a form of specialization well worth having), that seems to me like an argument for leaving the field open to many specialists, who can offer their services to anyone who is interested in retaining them (e.g. many private associations for arbitration and/or defense, which people go to on the basis of choice rather than being forced to go to one in particular on the basis of fixed territorial monopolies). Not so much an argument for limiting the field to a single fixed, institutionalized class of specialists (e.g. a government court or a government police force with rigidly and exclusively defined territorial or topical jurisdictions).

The first (non-monopolistic) solution really would make the business of law a skilled trade or profession, much like watchmaking or medicine, where people go to acknowledged experts freely, but aren’t forced to choose one particular expert on the basis of political status, and can choose another, on the basis of their own considered judgment and comfort levels, or for that matter can still choose none at all, if they decide to hazard the risks and trouble of doing it for themselves.

The second, monopolistic solution doesn’t make the business of law so much like skilled trades and professions, but rather like a feudal or command economy, in which people are assigned particular experts and forced to turn matters over to that particular expert rather than another, on the basis of the political status of the experts rather than on the basis of broadly and consensually acknowledged expertise. It’s that which, as an anarchist, I really object to.

In reply, Thomas raised some fairly common counter-objections and worries, especially about the dangers supposedly posed by the devolution of policing from public control to private defense — or, to spin it another way, from government to civil society.

This seems like blaming the chickens for the fox’s raid on the chicken coop. At least lately, the situation you refer to clearly benefits management in most NLRB disputes. I’d put down most of what’s wrong with NLRB to its being an easily subverted agency, most of the blame for that to corporations achieving via the back door of a compliant board what they couldn’t via the statutes authorizing the NRLB in the first place … and most of what’s wrong with those statutes to earlier corporate influence in making things like unionization far too difficult in the first place. Rightly administered and empowered, NLRB ought to be a counterweight to moneyed and propertied interests that have no interest in worker’s rights. The fact that it isn’t rightly administered and empowered seems to me a measure of the strength of the forces arrayed against it, not of the weakness of the idea of an NLRB itself.

At least for legal representation, that — in theory — is already the case, isn’t it? The problem is when the innocent can’t afford a Clarence Darrow, a Johnny Cochrane, or an F Lee Bailey to get them off but the guilty can.

I don’t see how to bid out for police functions, though, without that turning into yet another part of society baldly favoring the rich and privileged over the poor and disenfranchised. While that may be too much the case even with a police force as public monopoly, I think it would surely be worse in a “Deadwood“-type services-to-the-highest-bidder world. But maybe I’m misunderstanding you in how police functions ideally ought to work.

I’m not sure what you mean. I don’t blame rank-and-file workers for the way the NLRB functions. I blame the politicos, the “Progressive” bosses, and the conservative union bosses who pushed to create the system. (Radical unions, like the I.W.W., rightly opposed the system as an effort to promote conservative unionism and to capture and domesticate unions through a combination of government patronage and government regulation.)

Two things.

First, I have no confidence in anyone’s ability to craft a regulatory agency that successfully resists being substantially captured by the interests that it regulates. I can’t think of any example in the history of American regulatory bodies where this has been pulled off for any length of time, and I don’t think it should be particularly surprising that, since political entities respond to political incentives, they will tend to be administered in a way that systematically benefits the wealthiest and most politically-connected people.

Second, even if the NLRB were ideally administered, the system is designed from the ground up as a means of constraining union demands and restricting unions to the most conservative and least effectual methods. (Thus, the Taft-Hartley bans on secondary strikes, secondary boycotts, union hiring halls, wildcat strikes, etc. etc. etc.; thus the emphasis on a heavily regulated process of collective bargaining, controlled by very elaborate legal requirements that are often next to impossible for rank-and-file workers to understand, in place of extremely effective and very simple to understand tactics, like work-to-rule and other forms of direct action in the workplace.)

Well, not entirely — you can choose one lawyer rather than another, as long as you can afford their fees, but you can’t choose anyone as your advocate except those who have been officially approved for membership in the government-created and government-regulated lawyer’s guild. But lawyers weren’t the “experts” I was referring to; I was referring to the fact that the government forces people to take legal disputes before specific judges (with jurisdiction fixed by the issue in dispute and by accidents of geography), and excludes other no-less qualified and impartial experts from taking up the dispute simply because the privileged judge has a particular political status and the other would-be arbitrator doesn’t. If we are really talking about a form of specialized expertise here, like that of the watchmaker or of the doctor, then anyone should be able to take the case, not just a judge deemed to have that topic and that location within his bailiwick by the government.

Well, I don’t know. Isn’t that already how government policing works?

Tax funding doesn’t prevent government cops from treating poor people pretty shitty, or from acting as an instrument of class power. In fact, the fact that poor neighborhoods have no real control over who provides policing in their neighborhoods, and no way of cutting off their portion of the funding for neglectful or abusive police forces, is part and parcel of the problem.

Anyway, I’m not sure what you mean by bid out for police functions. If you mean the government outsourcing policing to private security corporations (Wackenhut, Blackwater, whatever), I’m not for that, and I don’t consider it an example of free market self-defense. I think that all government involvement in policing (whether in-sourced or out-sourced) should be abolished.

If you mean individual people choosing to cover the costs of policing, and having a choice about who, if anyone, they get police services from, then I don’t think there’s any guarantee that the result will be (even more) plutocratic policing. It’s true that, if all policing were based on free association and not on government monopoly, there might well be some policing that is done by private goon squads for hire, and those might have an incentive to favor the rich over the poor. But (1) again, I’m not convinced that they’d have more of an incentive to do so than government cops already have; and (2) there are lots of other ways of using free association to get self-defense and neighborhood defense done. For example, the Black Panthers and the Young Lords organized historically oppressed people to arm themselves, and to patrol and defend their own neighborhoods (including defending them from the predation of abusive white cops). In any case, where there are many, competing and countervailing associations that serve defensive functions, if one association becomes especially neglectful, or, worse, predatory, against marginalized people, other associations can move in to compete, or new associations can be formed, to check the first. But when policing is monopolized by a single institution, there is no real reason for them to try to please anybody outside of their firmest base of support (in the case of political monopolies, that means the ruling class—as is confirmed by how police departments already operate today). If they don’t please marginalized people, why would they care? They stay paid anyway, and there’s no countervailing force to hold them to account for their abusiveness.

My own view is that the need for any form of professional policing at all would be dramatically less in a free society than it is in the present day. (For example, in a free society there would be no drug laws, vice laws, or border laws, and thus no narcs, no vice cops, and no La Migra. There would also be much less entrenched urban poverty, because — for reasons I discuss in the Freeman article — ghettoized urban poverty as we know it is largely a function of interlocking government interventions against poor people’s survival strategies and attemtps to flourish through creative hustling; hence much less economically motivated crime, and also much less of certain kinds of antisocial behavior. So, again, this is, to a great extent, a problem that vanishes along with the needless government laws and endless government “wars” on consensual behavior, which I already favor abolishing. But, even if the demand for specialized policing were to remain just as high as it is today, I still think that it is far, far better to have a situation in which people are free to withdraw their support from abusive agencies, and where there are many acknowledged experts to keep each other in check, than a situation in which people are forced to pay for their own abuse, and in which cops are never held to account for wrongdoing by any means other than “handling it internally” and issuing the occasional “Oops, our bad”.

It’s a fairly wide-ranging discussion, and you ought to read the whole thing if you want to follow up on some of the sub-threads about, for example, organizing, class, tactics, immigration, and so on. For now, I want to highlight the discussion about specialization and professionalization in policing. On that note, I want to stress that it’s precisely those ideals in lawyering and law enforcement that lead directly to things like this, and this, and this. And the perceived need for specialization, professionalization, and expertise is a need which only exists because of the very system of law and enforcement it is invoked to justify. Without that system, without its politically-fabricated complexity, and without the tremendous latitude deliberately created by that complexity for government police to exercise arbitrary power in stopping, detaining, fining, and arresting suspect people — the 10,000 or more crimes that government law has fabricated, the crimes so numerous that not even the government itself can count them all anymore, and so potentially ruinous for anyone in trouble with the law that you have little choice but to regard anyone threatening to exercise their specialization and craft in the law as little more than a dangerous soldier in a hostile, occupying force — without all that, I say, there would be no basis, no need, and no call for that complexity or that arbitrary authority, or for the privileged, professionalized retinue of lawyers and enforcers who are expected today to go around navigating that complexity and exercising that arbitrary authority, in order to solve the very problems that the same complexity and arbitrary authority created in the first place.

But, well, the awful truth is that, as with so many other things in American politics, the answer to that rhetorical question can’t really be taken for granted, because it really depends on what kind of neighborhood you live in. The poster makes an important point addressed to, and about the daily lives of, people of a particular socioeconomic class (specifically, the people who most often spend their time reading blogs). For many if not most people in other social classes, the answer really is just, You bet it will. Or, It already is. Has been for decades. Where you been?

For example, consider the cops plans for improving neighborhood safety in the D.C. Ghetto. No, I’m not using that last word as a careless synonym for slum. I am using it in the most literal sense.


D.C. police will seal off entire neighborhoods, set up checkpoints and kick out strangers under a new program that D.C. officials hope will help them rescue the city from its out-of-control violence.

Under an executive order expected to be announced today, police Chief Cathy L. Lanier will have the authority to designate Neighborhood Safety Zones. At least six officers will man cordons around those zones and demand identification from people coming in and out of them. Anyone who doesn’t live there, work there or have legitimate reason to be there will be sent away or face arrest, documents obtained by The Examiner show.

Guess who decides what counts as a legitimate reason for being in the neighborhood — the people who live and work in that neighborhood, or the government’s goon squad?

Lanier has been struggling to reverse D.C.’s spiraling crime rate but has been forced by public outcry to scale back several initiatives including her All Hands on Deck weekends and plans for warrantless, door-to-door searches for drugs and guns.

Under today’s proposal, the no-go zones will last up to 10 days, according to internal police documents. Front-line officers are already being signed up for training on running the blue curtains.

Peter Nickles, the city’s interim attorney general, said the quarantine would have a narrow focus.

This is a very targeted program that has been used in other cities, Nickles told The Examiner. I’m not worried about the constitutionality of it.

Just so we’re clear, neither am I. I couldn’t possibly care less whether surrounding poor neighborhoods with cops, giving everyone the Ihre Papiere, bitte treatment, and chopping a community up into police-occupied strategic hamlets for the purpose of a government quarantine without any probable cause whatsoever for believing that any of the individual people you will be surrounding, stopping, hassling, and threatening with jail have ever committed any crime against any identifiable victim, is or is not countenanced by the United States Constitution. Who cares? The basic problem with terrorizing and brutalizing entire neighborhoods is that it is evil and incredibly dangerous, whether or not the Constitution allows for it.

Others are. Kristopher Baumann, chairman of the D.C. police union and a former lawyer, called the checkpoint proposal breathtaking.

Shelley Broderick, president of the D.C.-area American Civil Liberties Union and the dean of the University of the District of Columbia’s law school, said the plan was cockamamie.

I think they tried this in Russia and it failed, she said. It’s just our experience in this city that we always end up targeting poor people and people of color, and we treat the kids coming home from choir practice the same as we treat those kids who are selling drugs.

The proposal has the provisional support of D.C. Councilman Harry Tommy Thomas, D-Ward 5, whose ward has become a war zone.

They’re really going to crack down on what we believe to be a systemic problem with open-air drug markets, Thomas told The Examiner.

Thomas said, though, that he worried about D.C. moving towards a police state.

But what the hell did D.C. Councilman Harry Tommy Thomas expect, anyway? You can’t go around pushing your paramilitary crack downs with rhetoric about war zones and then act all surprised when you get a police state. If you plan for an occupation, you can expect that you are going to get lock-downs and de facto martial law.

Last week, I received the following email:

I live in Eckington, a transitional neighborhood in northeast DC. I got a knock on the door this morning from a guy with ACORN (looks like a lefty community group that I’d never heard of) saying that DC police would be coming around shortly asking to search homes in the neighborhood for guns, and explaining we had the constitutional right to refuse, etc. He added that anything the police find they can use against you because you never know what a friend of a friend might have left in your house Not sure if he told me this because I had just gotten out of bed and had answered the door in my bathrobe looking disoriented, but I digress. He was handing out a packet of info from the ACLU including a nifty doorhanger you can put out that says NO CONSENT TO SEARCH OUR HOME. One of my neighbors told me the guy told them they were only doing this in poor black neighborhoods, and this notice from the ACLU that I found online seems to bear this out.

I know it’s not exactly a wrong-door no-knock raid, but I am concerned because while I certainly don’t want the police (or any other strangers) rummaging through my junk, I’m kind of afraid of what would happen if I refuse the search. I already live on one of those streets with the surveillance cams installed. Does my address get marked for being uncooperative or suspicious? I should mention of course that I don’t own any guns and have never touched anything more powerful than a bb gun.

You are free to refuse the searches. But if a regular reader of this site feels uncomfortable asserting that right, you can imagine how other people subject to these searches might feel.

Please also keep in mind that this is the same metro police force which will toting around AR-15 assault rifles as they surround and cordon off and do door-to-door searches and raids in these inner-city neighborhoods.
