Tuesday night Indiana Governor Mitch Daniels signed the Right to Resist bill into law and the policemen of the United States went completely apeshit. There’s really nowhere better to go to write this article than the hangout site for cops called PoliceOne.com. Alot of people I know have changed their opinions of police after reading what the officers say on that page.

Indiana Gov. Mitch Daniels said Wednesday that he shares police groups’ concerns that some people might misinterpret a new law that lays out when residents could be legally justified in using force against police officers.

Daniels said he thought carefully before signing the bill Tuesday night. The legislation was passed by strong majorities in the House and Senate in response to public uproar after the state Supreme Court ruled last year that residents couldn”t resist officers even during an illegal entry.

Obviously Mitch wants to please both sides in this debate, but let’s just take a look at what the police are saying.

I think you see the point, police really think people are that evil, that they will now just play real life Grand Theft Auto and start killing at will. Which begs the question, if people are really that inherently evil, why give so many of them the power of the badge over everyone else? It always appears to me that the worst of the worst are in gangs, whether it be Blood, Crypts, or Thin Blue Line.

But will people really just start killing at will? I can give you one fact, the law and/or a guy in a funny costume with a badge doesn’t stop me from killing someone. I don’t kill or use violence because I believe it is wrong morally. Even if murder were legal I wouldn’t kill anyone and most people wouldn’t either.

This whole clamor that people will just start killing cops for sport because this law was signed is complete bullshit. People are good, not evil, and it’s not just because of cops and laws. Just look at this study done by the Institute for Science of Complex Systems.

Fundamentally people behave in a social and rather compassionate and “good” way rather than aggressively, even without specified rules. That is the result of a study from the Institute for Science of Complex Systems at the MedUni Vienna under the leadership of Stefan Thurner and Michael Szell. They analysed the behaviour of more than 400,000 participants of the “Virtual Life” game “Pardus” on the Internet. The findings are that only two percent of all actions are aggressive, even though the game would make it easy for war-like attacks with spaceships, for example.

It takes alot of horrible circumstances to turn a person bad. Charles Manson was tormented growing up, the Unabomber was abused at a young age, John Wayne Gacy was beaten constantly by his alcoholic father and suffered serious head trauma. People are not born evil, they learn it or adopt it after a horrible circumstance warped their mind.

The report goes on to say

Millions of human interactions were assessed during the study which included actions such as communication, founding and ending friendships, trading goods, sleeping, moving, however also starting hostilities, attacks and punishment. The game does not suggest any rules and everyone can live with their avatar (i.e. with their “game character” in the ) as they choose. “And the result of this is not anarchy”, says Thurner. “The organise themselves as a social group with good intents. Almost all the actions are positive.”

The interactions were fed into an “alphabet” by the researchers, “similar to how the genetic code of DNA was decoded 15 years ago”, says Thurner. “From this we get a pattern which reflects how people tick”. However, there is quite a high potential for aggression: so, for example, if a negative action is inflicted, the probability that the player will subsequently also act aggressively shoots up more than tenfold, even to about 30 percent.

Thurner and his team were also able to present by means of the pattern that the whole game is a reflection of reality. “For example, we could adopt measured values one for one for communication networks. A further measurement is that almost no one has more than 150 friends, the so-called Dunbar’s number, regardless of whether in the real or the virtual world.” The study has now been published in the specialist journal PLoS One.

The long-term aim is to detect “phase transitions in societies” early on using these measurements and the behavioural patterns researched in the virtual world in order to be able to forecast group dynamic social processes and to be able to react in the event of these cases in good time. “It is possible, for example, that through certain conditions the aggression level, that has increased tenfold, remains extensively in place and therefore systemically for a longer time, which bears comparison with a drastic radicalisation in societies. Consequently, we could react to it in good time.” A current example for such a phase transition in society has been the relatively surprising “Arab Spring” with its many protests, uprisings and revolutions, which, as is well known, were targeted against the ruling totalitarian regimes in many countries.

All the claims that this new law, which took effect immediately, will lead to a bloodbath, is completely unfounded. Maybe the police are the ones pushing it, with all their drug war home invsasions in the middle of the night or early morning when people are sleeping. Alot of times people think they are being robbed when these raids happen and reach for their gun and point it at the officers and sometimes start shooting. And the response is always justified by the fact “They drew a weapon”

Human psychology and history shows no indication that violence against police will escalate because alot of people will always be afraid. But police and government history shows every indication that violence against citizens will always escalate.

Just remain vigilante, peaceful, and always stick up for your rights. Violence always begets violence, just remember that. Time to see now which side will be proven right, and I hope it’s our side, not the police.

Here’s a story from a few days ago in Orlando, Florida.

An internal investigation by the Orlando PD decided that an officer used excessive force when he threw a 100-pound woman violently to the ground face first, smashing her front teeth out on the sidewalk.

Go figure.

It doesn’t take a doctor or an expert in restraint techniques to realize that his actions were far too extreme to deal with a petite woman who might have had a couple of drinks in her.

I read this story and watched the video (above) and was horrified as always when we hear stories like this that have become all too commonplace, but it was the comments at the bottom of the page, nearly all left by cops, that really got my blood boiling. You can go read them for yourselves, but here are some priceless gems that I’d like to make sure none of you miss out on:

Hey I have an idea…how about this POS female doesn’t fight with her POS boyfriend and act like a POS criminal and get assaultive with police when they show up to deal with her POS self?
This guy must have missed the ‘Protect and Serve’ memo.

Had it been a controled takedown, with an arrest afterwards…this wouldn’t be an issue.
Hmm, another cop suggesting that you arrest your victim to avoid scrutiny. I’m sensing a pattern here.

March 15 is International Day Against Police Brutality. Cop Block is growing in size, and our support is ever increasing. Even so, there remains a great deal of ignorance with regard to the institution of police and its systemically brutal effects. Over and over again, those who are aware insist the militarization of police is absurd and dangerous. The use of tanks, grenade launchers, tasers, and constant surveillance has undoubtedly ensured the United States’ reputation as a police state.

Those who have been paying attention have noticed the militarization of police for years, but most people and news outlets in the mainstream have not been, and are not paying attention.

While the government has provided no statistics that crime has suddenly run rampant, or is imminently on the rise, police are increasingly armed with state-of-the-art weapons to use upon the populace. Indeed, even if “crime” were running rampant, it would likely be because everything has become a crime in this country – from throwing frisbees, to studying whales with inappropriate techniques, to selling raw milk. The laws are countless; 40,000 were passed in 2011 alone.

Having the wrong books on your bookshelf can get your business raided. Believing in what is perceived as bizarre ideology puts you on law enforcement watchlists. Americans are guilty until proven innocent; in almost all 50 states, it is a crime to resist unlawful arrest, and innocent victims must submit to illegal arrest under the penalty of law (more here).

The year has hardly begun, and already police in the Bronx have murdered a young boy for the heinous crime of marijuana possession (and in a city in which marijuana is allegedly decriminalized, no less).

An Orange County sheriff’s deputy shot and killed Sgt. Manuel Loggins Jr., who was sitting in his parked car with his two daughters, also for inexplicable reasons. Police in Culpepper, VA murdered a woman who rolled up her car window in response to an officer’s commands.

Of course, in each case, it does not appear charges have been filed against the murderers. Yet, Cop Block continues to receive naive and downright stupid comments such as the following -

 If you really believe that the present laws protect the police and you the citizen are having your rights violated, then you truely are nuts!  Police officers have a code of conduct and their job is to uphold the law. When they break this code/law, then they should be judged in a court if law!   — Sharon

Well, unfortunately for Sharon, wishful thinking does not reality make. The reality is that the laws do protect police. They have qualified immunity in civil suits. Resisting arrest charges literally allow police to make illegal arrests because innocent victims are not legally permitted to fight off unlawful restraint by a police officer. Assault on an officer and homicide of an officer are treated differently than normal assaults and homicides, meaning the law assumes the person and life of an officer is of more importance and value than that of everyone else. These are just a few examples of how the law most definitely protects police.

Certainly, one can hope police officers “have a code of conduct” and that they report on themselves, keep themselves accountable, charge their friends when they commit murder, and use their fancy tanks, tasers, and dangerous weapons only as needed (i.e. hope that they possess super-human abilities to behave like saints) – just like I can hope that I get a pet unicorn for Christmas this year. However, this is obviously unrealistic, and it is frightening that a grown woman can believe in such impractical and naive fairytales.

To everyone else – thank you for your support of Cop Block. Please think of the many victims of police brutality in America and around the world today. Your awareness is rational, compassionate, and important.

So what?

I just had to share a story. In the city of Umatilla, in Umatilla County Oregon. I was open carrying when I stopped to gas up my bike. I was inside the store waiting in line to pay for my fuel. A Umatilla County Deputy entered the store and got in line to purchase a sandwich at the Subway Shop that was inside the same market. I over heard a lady tell the Deputy in a quiet voice “That man in the motorcycle jacket has a gun on his side”. I braced myself for whatever was going to come next. Out of the corner of my eye I saw the Deputy look my way then turn back to the lady and said ” So?”. She looked all flustered but walked back to her seat and sat down with her companions. I looked directly at the Deputy at that point and just smiled. He was looking at me smiling and just shook his head and went back to what he was doing. I did not get his name, I took my good luck with me and left the store. Thanks for being a good guy Deputy!

**Editor’s Note by Ademo: It’s nice to hear that police can, at times, do what’s right. I wish more officers would act in such fashion, like when receiving calls for noise complaints. Why don’t officers say, “Have you gone over there and asked them to turn it down yet?” If they haven’t say, “try that and call me back.”

Seabrook NH Police target Albert Abramson for Speaking Out

When a candidate for any office is confronted by the threat of 48 years in prison, a decent respect for the voting public obligates some kind of explanation.  While I can’t discuss the details of the bloody fight that occurred in my home on December 19th, 2010, I feel that I must inform readers, in some detail, about what is already published in Rockingham County Attorney’s Office own documentation.

At least three witnesses notified the police that one woman was wielding a knife, stating that she intended to kill someone.  Several partygoers admitted that people had been repeatedly told to leave, some refusing to do so.  At least one witness noted that the leader of an area gang tried to grab my gun during the fight, and has at least two previous convictions for attempted murder.  At least four partygoers had previous convictions for assault, battery, and other violent crimes.  Police photographs and statements show blood on the floor and damage to property, “indicative of a physical fight.” Eight indictments appear to accuse me of firing a round into the ground outside, “in an attempt to break up the fight,” which is not, as most read the law, a criminal act.

Witnesses admitted that I did not set up the party, nor was I the one who invited people.  I have many years of experience in safe handling of firearms, and did not act recklessly at any time.  Many others have asserted that the charges brought against me by the Seabrook PD were motivated by my open questioning of their bloated budget–three times the size of similar towns–lack of response to calls for service, and acts of dishonesty by certain officers (including falsifying reports and stealing from the gun range fund and Toy Bank Fund).  The truth is that the Seabrook police did not file charges against those involved in the fight, and they made a number of statements to the press and public that they knew to be untrue.  RCAO has a history of prosecuting people they know to be innocent, even suborning perjured testimony.  The truth is that I did the best I could with the crisis in front of me, and that some members of the SPD were reckless and out of control in their response to the call.  Jury selection is Monday, March 12th, and the trial will occur at Rockingham County Courthouse in Brentwood for those wanting to see the truth.  Video will be uploaded to CopBlock.org

Judge Edward Burke Misconduct Overview To Be Released On Friday

On Friday I am commissioning my first ever official “overview” of government misconduct. The presentation will detail my case as to precisely how Keene Circuit Court-District Division Presiding Judge Edward Burke violated state law, the state Constitution, and judicial canons by telling a lie to have someone arrested. A lie that constituted False Reports to Law Enforcement, a crime under state law. A crime that if the exact facts and circumstances were brought before him in a criminal case where you did the same thing, he would find you guilty.

I am quite familiar with the crime as I have arrested people and prepared prosecution cases for it before. Judge Burke should have been arrested by now for what he did… but lucky for him, it appears that his friends in government are protecting him.

The presentation I will be burning to DVD and distributing to Governor John Lynch, the Executive Council, and every member of the New Hampshire General Court. Every mainstream media outlet in New Hampshire will also be receiving a copy.

Judicial Canon #2, the code of conduct for judges, reads as follows:

A JUDGE SHOULD AVOID IMPROPRIETY AND THE APPEARANCE OF IMPROPRIETY IN ALL OF THE JUDGE’S ACTIVITIES

I presume that includes impropriety and the appearance of impropriety in all of the judge’s interactions with members of the free press who are asking constitutionally protected questions.  Especially when our own Constitution says:

FREE SPEECH AND LIBERTY OF THE PRESS ARE ESSENTIAL TO THE SECURITY OF FREEDOM IN A STATE: THEY OUGHT, THEREFORE, TO BE INVIOLABLY PRESERVED.

Oakland Cop Identified in Scott Olsen Incident

One of the most indelible images of the Occupy movement to date is that of Marine veteran Scott Olsen being carried away from a skirmish line of riot police at 14th Street and Broadway on October 25 in Oakland. Stunned and bleeding from an ugly gash on his forehead, the 24-year-old Wisconsin native had been struck in the head by an unknown projectile during the first salvo of tear gas, flash-bang grenades, and less-than-lethal munitions fired at hundreds of Occupy Oakland supporters facing off against Oakland police and several other Bay Area law enforcement agencies called in on mutual aid.

Video from the tear gas-soaked night of the 25th shows a prone Olsen lying in front of metal barricades and police in riot gear. As several protesters ran to Olsen’s aid, someone from the cluster of police appears to lob a flash-bang grenade into the crowd gathered around the young veteran. The stun grenade explodes amid a cloud of tear gas and deafening noise, scattering Olsen’s rescuers.

The footage of the flash-bang grenade exploding practically on top of Olsen and his rescuers, as well as dramatic video of a stunned and bloody Olsen being carried away from the intersection, went viral within hours, propelling Occupy Oakland to international attention and setting the stage for the November 2nd General Strike.

In the weeks and months afterward, rumors and accusations flew about the identity of the officer who fired the projectile that wounded Olsen, and the one who threw the concussion grenade on top of him. Rumors circulated on the Internet that either a San Francisco sheriff’s deputy or an officer from the Palo Alto Police Department was responsible. Members of Anonymous even went so far as to publish pictures and the personal information of a San Francisco sheriff’s deputy they believe tossed the stun grenade at Olsen.

But an extensive review of video footage and Oakland Police Department records by this reporter indicates that Robert Roche, an acting sergeant in the Oakland Police Department and member of OPD’s “Tango Teams,” threw the flash-bang at Olsen and his rescuers. It’s also not the first time that Roche’s actions have come under scrutiny. Police records show that Roche had previously killed three people in the line of duty.

In one clip of footage shot on October 25 by KTVU, the camera zooms in on a helmeted, gas-mask wearing officer in OPD insignia pointing a shotgun at the crowd. Olsen’s inert body is also visible in front of the barriers. Another video clip shows the same officer training his shotgun on the crowd, lowering the firearm as a crowd gathers around Olsen, and stepping back behind a line of San Francisco sheriff’s deputies on the barricade line. A grenade is then tossed at Olsen’s body as rescuers arrive.

According to former San Francisco Sheriff Mike Hennessey and Sergeant Kara Apple, a Palo Alto Police spokeswoman, officers from neither agency were equipped with less-than-lethal shotguns or flash-bang grenades that night. A list of OPD crowd-control munitions published by Al Jazeera last year includes the Remington .357 shotgun and two types of CS or pepper spray-loaded blast grenades.

Two stripes and a star, OPD’s insignia for acting sergeants, are visible on the officer’s left sleeve. In both clips, the officer is holding his shotgun with his right hand on the trigger, his helmet visor is up and the numbers “35″ are visible on his helmet. According to an OPD roster of the three-digit helmet numbers assigned to individual officers and the personnel detail for October 25, Officer Robert Roche is the only one with a helmet number beginning with “35″ who was assigned to a Tango Team that night. Roche’s helmet number that night was “357,” according to OPD records.

Three attorneys who reviewed the two clips mentioned above concur that the shotgun-wielding officer is the same in both clips. “From the positioning of that officer in the line and his weapon, it appears it was likely the same cop who tossed the grenade at the medics trying to help Scott Olsen,” said R. Michael Flynn, president of the San Francisco Chapter of the National Lawyers Guild. Jim Chanin, one of the two attorneys who have overseen OPD’s federal consent decree since 2003, concurred. “His movements and appearance strongly suggest that it’s the same officer that threw the grenade,” Chanin said. Chanin also observed that the officer’s helmet number began with “35.”

Rachel Lederman, another NLG-affiliated attorney, also believes the officer is the same and identifiable by the “35″ on his helmet. Lederman characterized the officer’s actions as “illegal” and “evil.” Tossing a flash-bang grenade into a crowd and at a wounded person is “not only improper under [OPD's] crowd control policy — the guy should be fired,” Lederman said.

Sergeant Chris Bolton, chief of staff to Police Chief Howard Jordan, said the investigation into the Olsen incident is ongoing. “Any known or alleged uses of force against Mr. Olsen are assigned to an independent investigator,” Bolton said in a statement. “Based on available video, photographs, and reports, the department has identified several officers that they are subjects of those open investigations.” Bolton added, however, that “no investigative findings or discipline have been announced or imposed.”

Roche is a rifle officer who has also served in gang enforcement units. He has been involved in three fatal shootings during his career. In 2006, he fatally shot seventeen-year-old Ronald Brazier after the teenager fired on Roche and two other officers. In 2007, Roche shot and killed an unarmed Jeremiah Dye in a crawlspace under an East Oakland house. Dye had run from police after his cousin shot and wounded an OPD officer during a traffic stop. In March 2008, fifteen-year-old Jose Buenrostro was shot to death by Roche and two other officers while in possession of a sawed-off rifle on 79th Avenue in East Oakland. Buenrostro’s family received a $500,000 wrongful death settlement from the City of Oakland in 2010, even though police claimed that Buenrostro pointed the weapon at them. Buenrostro’s family contended that he did not threaten the officers.

Alameda County District Attorney’s Office records indicate that Roche was cleared of criminal conduct in both the Brazier and Dye shootings.
Roche and Sergeant Ronald Holmgren, who supervised Tango Team 2 during the October 25 crowd control actions, were not assigned to the Tango detail on the evening of the November 2 General Strike, according to Oakland Police Department records. However, Roche was photographed on the street during the January 28 confrontation with Occupy Oakland protesters, shotgun in hand.
OPD’s “Tango teams,” or tactical teams, have been at the heart of some of the most intense clashes of the Occupy Oakland movement (see “Oakland Used Violent Cops Against Occupy,” 12/21/2012, “). Aside from the Olsen incident, video from the evening of the November 2 General Strike shows an unidentified OPD officer wearing a rucksack emblazoned with “Tango Team” striking US Army veteran Kayvan Sabeghi with a baton. Sabeghi was later hospitalized for a ruptured spleen.

Waukesha Police Officer Stalks Videographer

Walking up Arcadian St. in Waukesha I saw 2 cop cars. I filmed one going through the intersection. She drove by and I decided to film the other. Once he saw me with the camera he stopped cold in the gas station parking lot and starred me down for several minutes. He then adjusted his dash cam to fixate on me. I stood there for a bit and decided to approach this man with most likely, multiple guns, starring me down. I walked down to the crosswalk and the cop pulled out. I got a profile picture of him though he refused to look at me at close range.

The reason I film police is to protect myself and others. Waukesha police have a recent history of beating a 51 year old man with no record trying to comfort his daughter after a bad accident. After repeated requests for the video from the prosecution and defense, the police destroyed the 2 videos. They assure us it was a legit beating but a civil lawsuit is pending. They charged the beating victim but the judge dismissed it after seeing that the Waukesha police bosses and others accessed/showed the 2 videos at least 20 times then deleted them. She stated the custodian of those records acted in, “bad faith” insinuating a coverup.

My concern is that the first amendment to the Constitution is the first for a reason. What I mean is that it isn’t the 5th, the 18th, or even the 21st. Gathering information on government then disseminating it is the core right in this society and that in itself is substantial. People understood 240 years ago that the government will grow and will attempt to repress the natural rights of humans.

With the relative ease of reaching a wide audience with video, citizens now have the ability, and in many cases, the determination to expose the many injustices and violations of rights that occur on a regular basis within the police community. The fact that currently my state to the south threatens to imprison a middle aged man for life for simply recording the actions of police is certainly relevant.

Although my camera which I wear around my neck everywhere I go doesn’t properly capture the look on this cop’s face, the look on my wife’s face told me she was thoroughly fearful. We’re homeowners and have never been convicted of any crimes. We should suffer no more scrutiny by filming police than a child riding her bike. That is not the case in Waukesha WI, though we will try to change that.

Pete and Ademo Continue LiveStream Friday – Week Two Tomorrow

Last week Pete and I conducted our first weekly livestream, it went over well and we’re going to do it again this Friday at 4pm est. We’ll be livestreaming from one of our MAC’s at http://justin.tv/copblock and on Qik.com/copblock via my iPhone (see Qik video below of last weeks broadcast).

As Pete stated last week:

The impetus for our streaming this Friday is two-fold.

Firstly, we’ve long-discussed doing a regular segment. The benefit – discussing relevant content in another medium, especially one that allows for interaction (via chat) – is clear. We can all learn from each other and in the process safeguard our individual rights while growing larger and more tight-knit as a community.

Secondly, it will allow us to test the functionality of various streaming applications, which will be of use for those of you who have a smartphone. A couple of weeks ago I downloaded a number of streaming applications with the intention of writing a comparison post. When I’ve used each app, I’ve kept notes about the experience (quality, whether the stream fed correctly to the Internet, etc.). This Friday’s upcoming segment and future segments will allow for more data to be collected.

Again, we hope other CopBlockers join in, ask questions and seek accountability in policing today. We’ll see you there tomorrow.

Update Antonio Buehler

Antonio Buehler was doing the right thing when he questioned officers being overly aggressive with a non combative female. Antonio even took photographs of the officers for documentation, which lead to officers arresting his – see original CopBlock.org post here.

Now it’s time for Antonio to go to court, and he’s lawyered up, see video below.

It will be interesting to see the “City’s” stance on this case. I’m guessing that they’ll drop the charges and wait for Antonio to sue them. Once he does it will take two years to settle (or win in court) and Antonio will give “the city” (or taxpayers) a black eye, or about $20,000. I’ll keep you posted as this case develops and hope Antonio will blog updates here in the future.
