You got served and protected #4: how Portland Police Bureau Officers Joseph Cook and Judy McFarlane used a “welfare check” to throw Contia Orsby out on the streets

Here’s something I wrote about last year in my article for The Freeman:

Had the city government not made use of its supposed title to the abandoned land [to fence off the lot that the Umoja Village shanty-town had been built on], it no doubt could have made use of state and federal building codes to ensure that residents would be forced back into homelessness—for their own safety, of course. That is in fact what a county health commission in Indiana did to a 93-year-old man named Thelmon Green, who lived in his ’86 Chevrolet van, which the local towing company allowed him to keep on its lot. Many people thrown into poverty by a sudden financial catastrophe live out of a car for weeks or months until they get back on their feet. Living in a car is cramped, but it beats living on the streets: a car means a place you can have to yourself, which holds your possessions, with doors you can lock, and sometimes even air conditioning and heating. But staying in a car over the long term is much harder to manage without running afoul of the law. Thelmon Green got by well enough in his van for ten years, but when the Indianapolis Star printed a human-interest story on him last December, the county health commission took notice and promptly ordered Green evicted from his own van, in the name of the local housing code.

Or, hell, they might not even bother with the regulatory formalities. Sometimes the cops just roll up on you for a welfare check and then take the opportunity to steal your home.

For example, Contia Orsby is a 58 year old black woman, who has spent most of her life helping sick people and, as far as I know, never did any real harm to anybody. She’s originally from Louisiana, and now living in Occupied Portland. She used to work as a geriatric nurse, but three years ago, she hurt her back so bad on the job that she couldn’t work anymore. The hospital gave her $14,000 to live off of for the rest of her life and then pawned her off on the state welfare bureaucracy, because they could, and the state welfare bureaucracy gave her the usual waiting time of forever, because they could. (They stay paid no matter how they act, and where else is she going to go?) When the money ran out, she got some help from her church, and when that ran out, she started living in her car. Which is cramped, and unpleasant, but sometimes safer and easier than trying to find people to put you up, and certainly safer than living on the streets.

Until July 4, 2008, when a pair of Gangsters in Blue decided to roll up on her and search her as part of a welfare check. Here’s how they looked out for her welfare—by stealing her car and throwing her out on the street.

On July 4, Portland Police Bureau Officers Joseph Cook and Judy McFarlane rolled up on Orsby at 2 pm as she was slumped in her car outside an apartment complex on SE 122nd. They searched Orsby and found a pair of brass knuckles in her pocket, which she claimed she was using as a key ring. The officers charged Orsby with having a concealed weapon, driving with a suspended license, and driving without insurance. Instead of taking her to jail, they towed her car, handed her the citations and drove off, leaving her homeless on the street.

All three charges against Orsby were thrown out last Thursday, September 11, after the district attorney’s office declined prosecution.

In real life, outside of statist power-trip La La Land, if you fuck something up that doesn’t belong to you, for no good reason, you pay for it. Normally, if a pair of gang-bangers rolled up you and rousted you out of your car, against your will, when you weren’t doing anything at all to harm a single living soul, sanctimoniously claiming it was for your own good, then searched you, and rifled through your papers, then demanded to know why you were carrying a pair of brass knuckles (as if it mattered—if she were carrying them for her own protection, what’s wrong with that?), then called you a liar and declared your papers insufficient justification for your existence, and then, finally, used all this as an excuse to jack your car and threaten you with a fine you can’t pay or forced confinement in a jail—if they did all this, I say, and they got caught out, those gangsters would be in jail and they would be expected to return the car they’d stolen and pay for what they did out of their own pockets. But because these gang-bangers were Gangsters in Blue, and because they acted with the biggest gangster of all, the State Law-and-Order Protection Racket, at their back, when these charges were dropped, and the whole thing declared a big mistake, Portland Police Bureau Officers Joseph Cook and Judy McFarlane are virtually guaranteed never to suffer a single adverse consequence for their obvious, pointless, and cruel violation of poor people’s property rights. And neither they nor their bosses, the collaborationist puppet government of Occupied Portland, will do anything to make it right, beyond an Oops, our bad; in fact, they feel perfectly happy to force Contia Orsby to pay hundreds of dollars that she doesn’t have, just to recover her own property from the fence they sold it to.

CONTIA ORSBY, 58, stood with the deacon of her church on the lot of Andy’s Towing on SE 82nd last Friday afternoon, September 12. She was there to retrieve her all-white 1988 four-door Cadillac Brougham, bought five years ago for $4,700 from a used car lot up the street, during more fortunate times. It had briefly been her home, until police confiscated the vehicle on Independence Day.

Orsby had already handed over $400 to the towing firm, and $225 to get a release for her vehicle from the courthouse. Still owing $600 more, the manager of the towing company had generously cut her a deal.

He told me if I promised him $200 from my next disability check, I could come and get the car today, she said.

Too bad, because the towing firm had lost the keys: They called a locksmith, and tried to charge Orsby for the cost of cutting some new ones.

We’re doing you a favor, the manager told her. We’re only supposed to keep the car, technically, for 30 days.

Orsby refused to pay for the locksmith, and ultimately, the towing company handed over her car. Her deacon, Albert Woods, from the Emmanuel Church of God in Christ United on NE 30th, had taken the afternoon off to drive Orsby to the towing lot. He shook his head.

They wouldn’t treat her like this if she were the president, that’s for sure, he said.

It’s true, and the management were certainly acting like dicks to her. But why can they get away with that kind of behavior? Simply because, as the fence for the cars stolen by the State, they have no reason to care about making things easy on you, or Contia Orsby, or anybody else. Why should they? They get most or all of their business from people like the President, not from people like you—people who are part of the State, a monopoly outfit which pays for itself through extortion rackets and robbery just like the screwjob they pulled on Contia Orsby, and who use their positions of political power to evade taking any responsibility for their own violations of the liberty and security that their cops and their so-called Law and Order are supposed to protect. Like any other fence, this one doesn’t much care about your life or your livelihood, and he doesn’t much care about helping you recover your stolen property. He serves the racket, not you. Do away with the racket, and you’ll do away with the other petty criminals and hangers-on that take their cuts from the loot.

I’ve said before that urban poverty as we know it is exclusively the creation of the State, and now I’ll add that this is especially true of homelessness as we know it. I don’t mean to claim that in a genuinely free society, with freed people, freed labor, and freed markets, with freedom for the poor and with no political patronage for the rich, that nobody would ever have to scratch by on short money. And I don’t mean that nobody would ever have to live without a house or apartment for a while due to short money. That would be a lot less common if people were free to scratch money together through creative hustling, to lower their fixed costs of living, and to join together for voluntary, neighborhood-based mutual aid, without having to bear the burdens of State-imposed taxes, usury laws, vagrancy laws, prohibition laws, border laws, business license laws, zoning laws, business laws, professional licensing laws, building codes, health and hygiene codes, fines and forfeitures, eminent domain land grabs and politicized development rackets, welfare bureaucrats, social workers and cops, and the rest of the whole taxation-and-regimentation government apparatus that constantly robs, cages, and busybodies poor people, all while sanctimoniously declaring that it’s all For Their Own Good, like one big welfare check on the Contia Orsbys of the world. If people were free of all that, hard times would be a lot less hard, but nobody can realistically promise an end to all tough times or shitty situations, whether by Anarchy or by any other means. Some people might lose their jobs, some people might go hungry, and some people might lose the roof over their heads. But homelessness as we know it — as a long-term, self-reinforcing downward spiral of destitution, in which hard times force people out onto the street, exposed to the elements and to danger from other people, or into overcrowded and dangerous institutional shelters — only exists because the State — the city and state governments, in particular — has a fixed policy of repeatedly sending gangs of thuggish police and busybody case-workers and bureaucratic inspectors around to hassle so-called vagrants; to subject them to constant citations, fines, arrests, and pointless humiliations; to roust them up out of any place that they settle in to stay; to violate their rights to homestead unused land, and to obstruct, invade, trash, or tow away any transitional, intermediate, or otherwise informal sort of shelter that poor people might try to arrange for themselves. It’s one thing not to be able to afford the sorts of houses and apartments and long-term rooming arrangements that journalists and economists and sociologists count as homes for the purposes of statistics and public debate. It’s quite another to be thrown out on the street without any kind of reliable shelter, and we all ought to recognize that as the child of the State. In that sense, all homelessness is forced homelessness, and all homeless people are the internally displaced refugees of the State’s ongoing War on Poverty and campaigns of economic cleansing.

That’s how Contia Orsby got served and protected by Portland cops: by being thrown out of the car that is her home, on the excuse of a bunch of petty so-called crimes with no identifiable victims, having it towed away, and then, months later, when the State magnanimously allowed her to be left the hell alone, by being forced to pay to get it back even though she was never convicted of any crime, victimless or otherwise. If you’re baffled that cops could get away with these kind of outrages, it may help to remember that in a lot of American cities, there just is no such thing as a civil police force. What we have would be better described as thuggish paramilitary units occupying what they regard as hostile territory: like any occupying force, the people they go after the first and the hardest are generally the people who are most vulnerable, and like any other occupying force there is no real recourse for anything they may choose to do on their patrols. Here as elsewhere, they are going to serve and protect us, whether we want them to or not, and if we don’t like it then they’ve got plenty of guns and clubs and cuffs to make sure they can protect the hell out of us all anyway.

Re-usable Anarchy and A-Cafe updates

Here’s a couple of updates on local anarchist organizing in Las Vegas.

First, follow-up on the A-Cafe. As I mentioned a few days ago:

We’re starting a Las Vegas A-Cafe. (By we, I mean both Southern Nevada ALL and some other local anarchists I’ve contacted. Look out, we’re conspiring.) The Anarchist Cafe is intended as an informal gathering for anarchists (of all stripes, sects, and creeds) to meet and talk with each other—which is free-form enough to allow people just to meet up and hang out if they want to hang out, but y also where they can talk some shop, spread some news, and float some ideas for action. The idea comes from events in Califas (SoCal, NoCal). For the time being, we’re being rather literal by holding the event in an actual coffee house, because they have good meeting space, comfy chairs, and don’t expect us to do anything more for it than buy some of their drinks. Hopefully the first meeting will bring together some new faces and old.

We did heavy flyering on Monday, a little on Tuesday, and quite a bit more on Wednesday. Due both to planning and to some accidents of who was available when, pretty much all of our flyering was concentrated on UNLV campus and the neighborhoods immediately surrounding. About half of the flyers were put up were ALL flyers on police brutality and taxation. About half were advertisements for the A-Cafe specifically. (The latter had the advantage of an eye-catching circle-A, and a specific action item — attending the meeting.)

Here’s the results.

  • The flyers got some attention: the Southern Nevada ALL website got about 350 unique visits on Monday, about 180 on Tuesday, and about 210 on Wednesday.

  • The A-Cafe went well. Based on past experience, I figured ahead of time I’d count the event as a success if we got a few of the old folks together and made at least one or two new contacts. As it turned out, we had three ALLies (including myself) and one other anarchist we’d already met with pass through the room. We made five new contacts, passed out quite a bit of ALL literature and flyers (including multiple copies to a couple people who were planning to distribute them to friends). We also got in contact with three others who could not make the first meeting but are interested in future events and local organizing. So count this as quite the success, if we can make something of it.

The Cafe itself mostly involved introductions, passing around some small sheets we are using to build a contact list and poll people about the projects they’re interested in working on. A couple of the people who attended were interested in anarchist ideas but not committed anarchists, so we talked about the basics of anarchism with them; and chatted up those who were already committed anarchists about possible local projects.

The next meeting of the Las Vegas A-Cafe will be:

As before, if you are in the Las Vegas area (or you know someone who is) and are interested in the A-Cafe or in Southern Nevada ALL, be sure to come, or to let the interested parties know about it. (You can use Vegas A-Cafe’s Tell-a-Friend form, if you like.) I should be at the A-Cafe on Wednesday, and I hope that several other ALLies will be there too. If you’re interested but can’t make it to the face-to-face, by all means drop us a line so we can put you on our contact list.

The next question then, is, now that introductions are out of the way, what future A-Cafes will involve, at least for those who have been at least one A-Cafe and met other folks already. A large component is supposed to be informal, based on chatting with each other rather than having some kind of agenda to work through. Partly because that kind of thing is boring as hell, and partly because, insofar as it serves a purpose, it only serves a purpose for groups with a much more well-defined set of projects than A-cafe, which is mainly just intended as a space for people to meet each other, network, and have a bit of pleasant and possibly useful conversation. But it will definitely help to have some kind of prompts to get people talking with each other, and potentially things for people to work on individually or in small groups, if that’s what they want to do. Any suggestions? If so, I’d definitely appreciate any proposals down in the comments section….

Second, I’ve received some requests for editable versions of the flyers that ALL has used in its two flyering events. I’ve been dragging my feet a bit, in part because distributing editable content over the web is actually somewhat more complicated than distributing print-ready content. Basically, because print-ready PDFs are designed to be portable — that’s what the P in PDF stands for — and so carefully embed all the data that you might need to reproduce their content exactly. Editable formats don’t provide the same guarantees. But, I realize that editable versions will be much more useful to those of y’ALL who are outside Vegas than a print-ready version that you’d have to use physical cut-and-paste to customize for local needs. So, here is what I’ve done. From here on out, each new action that we post to the Southern Nevada ALL website will have a Re-use section at the bottom of the page, which will include editable copies of all the files we used to produce the material for that action, as well as any auxiliary files that you need to download to make the whole thing work. All of the materials that Southern Nevada ALL has already distributed so far for Tax Day and Radical Re-orientation are now available in their original, editable OpenDocument Text format (which you should be able to edit with OpenOffice.org Writer, Google Docs, and most open-source office software). These flyers all make use of at least one custom font face not included with your operating system; the fonts are all freely available for download, though. Here’s the full set of the fonts you might need (in TrueType format):

And, once you’ve got those fonts downloaded and installed, here’s the full collection of flyers and handbills that we’ve used. I’ve also included a copy of the short form we used for the networking project — for contact information and polling about interest in local projects — in case you might find that useful, too. As usual, all of this is copylefted and made freely available for your re-use. (It would be a courtesy to add a small attribution to Southern Nevada ALL somewhere if you should re-use the flyers we made while changing the contact information. I’d also love to hear about it if you use the designs in your own agitprop. But it’s not like I’m going to sic the Anarchy Police on you either way.) Enjoy!

For myself, I’m going to try to encourage everyone to sign on for some networking projects, bring a lot of ALL literature to set out on a table, and chat people up about possible local actions and projects.

In order to announce the upcoming A-Cafe, to raise awareness about the domestic and foreign and perpetrated by the State, and to reach out to incoming and returning students at UNLV, Southern Nevada ALL took its second flyering action today — the first day of classes for the upcoming semester at UNLV. We’re calling this outreach action Radical Re-Orientation. Right now, we’re limited mainly to posting flyers and distributing handbills. In the future, if we gain more of a foothold on campus, I hope that we can really trick the event out, through some strategic use of tabling, more extensive first-week events, and hopefully coordination with other groups on campus. But, in any case, for now, there is the A-Cafe, and there are the flyers and handbills. The numerical majority of the paper that we’ve been pushing has been a pair of new flyers on police brutality, a handbill on anarchy, and a flyer announcing the A-Cafe event. In addition, we also have some fresh copies of existing flyers on how we are forced to pay for war and torture through government taxation.

A-Cafe invitation

Vegas Anarchy / What Is Anarchy?

The handbills are designed to be printed out as a double-sided 4x4 sheet, with the logo on one side and the What Is Anarchy? text, with a link back to the A-Cafe website, on the back. We’ve dropped a few in public places, and spread the rest around under car windshield-wipers and on doorknobs; the idea is for the front to catch your eye with the logo, and the back to give some idea of what we’re all about. I hope to re-use the design with a bunch of different texts on the back; for the first one, I tried a capsule summary of what anarchism is about. Thus:

What is Anarchy?

Anarchy means lawlesness. It does not mean riot or chaos. The government schools and the corporate media have taught you to believe that Anarchy means disorder because they need you to believe that order and peace can only exist where they are imposed by government laws and enforced by government police. The elite few who pull the strings in the government and in the corporate media need you to believe that social order requires social control. After all, they intend to do the controlling. They expect you to surrender your freedom to their authority. In exchange they promise you peace, protection, security, and order. But what they deliver is fear, war, police brutality, and humiliating “security” checkpoints. Their “order” means taking orders. Their “protection” is a prison.

In Anarchy there is another way. Instead of a coercive order imposed by government, we believe in consensual order. Instead of “protection” from brutal government cops, we look to individual and neighborhood self-defense. Instead of “relief” from indifferent government welfare bureaucracies, we look to fighting unions, worker solidarity and cooperative community-based mutual aid. Instead of “order” imposed by obedience to government laws, we look to voluntary contracts and agreements between free people negotiating as equals.

We oppose all government prohibitions, government taxes, government borders, government police, and government wars, because we are for peace, freedom, and social harmony. These can only exist between people who come to agreements as equals, not between people who are forced to obey out of fear. It is government law that produces violence, riot, and disorder. Only in Anarchy can there be true order, real peace, individual freedom and social harmony.

You got served and protected #2: Halifax cops tackle a 17 year old girl and taser her while she lies helpless in her own bed

Last year in Halifax, Nova Scotia, a gang of three cops — Phillip MacKenzie, Tara Doiron and Brendan Harvey — showed up to intervene in a fight between a seventeen year old girl and her mother. The mother called them in when the girl threatened to damage some property in the house. By the time the police arrived, the girl was calm and it’s likely that the cops could just have left things be, or spent a little bit of time talking to everyone like civilized people in order to make sure that everything would be alright. But, of course, this is completely unacceptable from the standpoint of the police, when there are Bad Teens on the loose, so instead they escalated the confrontation and tried to force her out of the house, so they could proceed with whatever they imagined they needed to proceed with. She argued with them, which a fair number of cops seem to have been trained to treat as a criminal offense, and when the cops decided to arrest her for daring to talk back, there was what the papers call an altercation. When an altercation goes on between a 17 year old girl and three armed, professional cops, what that means is that she struggled briefly and the pigs responded by tackling her, and then, just for good measure, blasting her twice in a row with a 50,000-volt electric shock from their tasers while she was lying helpless in her own bed. After having three armed cops gang up on a teenaged girl to beat and shock her into submission, they then charged her with resisting arrest and assaulting a police officer — the first charge a bogus non-crime when the arrest itself was completely arbitrary, and the second charge an apparent exercise in dreadful farce.

Of course, when The Matter Is Investigated by the police, they will either (a) act as if the cops did nothing wrong, fabricate some incredibly tortured military-necessity excuse without questioning whether the goal of arresting the girl ever needed to be accomplished in the first place, and cite some incredibly vague Official Procedures for the use of force, as if that unquestionably ended the argument; or else (b) failing that, issue some mild administrative sanctions against the cops and write the whole thing off as Yet Another Isolated Incident. In fact, the case is entirely typical — because a massive sense of entitlement; a habit of barging in where you’re not needed and refusing to leave until things are settled to your own satisfaction; a contemptuous indifference to the perceptions, interests, needs, or consent of those you are putatively there to serve and protect; a strategy of needlessly escalate confrontations; a habit of using belligerence to take control of situations that your own actions have made hostile; the casual use of techniques that inflict incredible pain on your victims in order to make them comply with arbitrary orders; a willingness to hurt or arrest your victim in order to end an argument; and an expectation of more or less complete administrative, civil, and criminal impunity, no matter how senseless your orders, no matter how needless your use of violence, and no matter how obviously helpless or harmless your victim may be — are part and parcel of the environment that cops do their dirty work in, from the first day of training to the buddy-thug culture of their departments to the cultural excuse-making and overt legal privileges that insulate them from the expectations that anyone else would be held to outside of the world of rampaging statist power-trips. We already know that cops have no problem electrifying prepubescent children and alleged salad-bar thieves; no problem serving and protecting the hell out of 82-year-old women as part of a care check or repeatedly shocking a young man sleeping in his own house; no problem beating the shit out of teenaged girls in order to arrest them for not cleaning up spilled cake well enough or being out too late at night, and then charging the girl that they violently confronted, and who they outweigh by a hundred pounds or more, with criminal assault. So, while this case is outrageous, why should it be surprising? The only thing that’s unusual is that, for once, somebody in the legal system — Anne Derrick, the youth court judge who took the girl’s resisting-arrest and assault case — actually drew back the veil of Law Enforcement, acquitted the girl of all charges, and called the police on their shit:

A Halifax Youth Court judge criticized three police officers Tuesday for their arrest of a teenage girl, who was tackled in her own bed and shocked twice with a stun gun last February.

The spectacle of a 17-year-old girl being Tasered in her bedroom is a very disturbing and disconcerting one, Halifax Youth Court Judge Anne Derrick said in her ruling on the charges of resisting arrest and assaulting a police officer.

I find the police acted outside the scope of their authority in arresting [the girl] and that she was entitled to resist and committed no offence in doing so, and I acquit her of the charges before the court.

Derrick also found that the police escalated the situation leading to the arrest.

Meanwhile, the young woman, now 18, having spent an entire year of her life trying to clear away this nonsense, plans to file a complaint with the police department, now that she has finally been vindicated in court. She is also considering a civil suit. I hope that she sues the pigs personally and takes them for everything they’ve got. Unfortunately, if a suit is filed, what will probably happen is that the police or the local government will settle the case out of court, and then, public servants that they are, they will send the bill straight to a bunch of perfectly innocent taxpayers, while the thugs MacKenzie, Doiron and Harvey go on terrorizing innocent people in the name of public safety, suffering some mild administrative sanction at the worst.

If you’re baffled that cops would go on committing these kind of outrages, over and over again, in so many different cities in the U.S. and Canada, never exhibiting any interest at all in introspection or critical re-evaluation of their institutional culture beyond a bureaucratic review of whether cops should be carrying tasers (as if this were some kind of equipment failure!), and never addressing any issues that this might raise other than the P.R. problems that it causes for the police department, well, that’s pretty much why. Why would they ever try to act accountably or responsibly when the existing framework of immunities and legal privileges granted them by the State virtually guarantees that they will never personally be held responsible or called to account for what they do?

In which I fail to be reassured

The other day, I posted some remarks on why the Freedom Train metaphor bugs me, and why I think that market anarchists should generally think about aligning themselves with, you know, anarchist organizations, rather than minarchist efforts like the Libertarian Party and Chairman Ron’s Great Libertarian Electoral Revolution. Brian Doherty kindly took notice of my post over at Hit and Run. Like most posts at Hit and Run, it provoked a lot of comments, mostly from the usual suspects, and mostly not going much of anywhere productive. (Several minarchist commenters apparently didn’t bother to read the post, as they would rather spend their time rehashing the minarchist-anarchist debate from the get-go. Did you know that anarchy might work on the small scale, but will never work in a big, industrialized society? Or that anarchy will never work in practice because people will have to recreate the State to keep the Mafia from running everything? Man, I never heard that stuff before. Sign me up for some of that limited government!)

However, there are a few that are worth some remark.

NoStar offers the following encouraging thought on anarchist-minarchist unity:

How about we both fight and defeat them before we then turn and fight each other.

Think of Mao’s communists and Chang Kai-Chek’s nationalists combining to fight the Japanese.

Once the common foe is gone, we can nitpick the details.

Call me a nattering nabob of negativism, but somehow I fail to be entirely reassured by the thought of being Chiang Kai-shek to the minarchists’ Mao Zedong. Or, for that matter, vice versa.

Moderate or pragmatist limited government libertarian Nick has this to say:

The way to effect change is to build a coalition of people who are dedicated to the change you want to make and then work to convince the normal people in the middle. Ron Paul is a great example of getting a coalition together, altho his campaign could use some work in convincing moderates to his side.

Well then.

In the interest of diplomacy, I will just kindly suggest that if Ron Paul’s triumphant single-digit, third-to-fourth place primary campaign is your idea of a great example of getting a coalition together and making change through the power of numbers, I will be holding out for a better proposal.

Meanwhile, limited governmentalists are just full of suggestions for how anarchists can help the cause of anarchy by … not talking about anarchy, and spending their time and energy on building up limited-government organizations instead. Apparently wanting to work on promoting your own cause, rather than other causes with fundamentally different ideas about ultimate goals, is a sign of a self-destructive fetish for purity. Of course, the fact that this going-along-to-get-along in the name of political realism only seems to go in one direction — I don’t hear any minarchists talking about how they plan to swallow their love of small governments in order to sign up for going anarchist efforts, like, say, CopWatch — might lead one to be just a little suspicious of the motives behind the appeal. But, anyway.

Brandybuck, for example, is not an anarchist. But he’s sure that if he were an anarchist, he’d be perfectly happy to spend his time working on achieving minarchy rather than anarchy. He asks:

He is unwilling to compromise any of his political points. But such an unwavering demand for pure anarchy is going to net him only misery. Is this a man who would reject a 50% tax cut because it would leave the remaining 50% of taxes in place? I think it might be.

Brandybuck’s got another think coming.

I would quite happily take a 50% tax cut, if I could get it; and I would consider a 50% reduction in Leviathan’s pirated wealth to be a massive step in the right direction. I would much rather that the whole thing were done away with, but in the meantime, I will take what I can get.

But what I would not do is waste my time trying to build up a think tank or political party that are devoted to the goal of cutting taxes by 50% and no further. That’s hardly the only way in the world to make concrete progress towards cutting taxes by 50%, and if you think that it is, you need to think harder about how social change, or even basic negotiations, actually work in the real world. (As for negotiations, if you start out asking for what you actually want, rather than what you think you can get, you’ll often end up getting less than you wanted in the end. But you’ll do a damn sight better than if you start out asking for what you think you can get, and then bargain down from there. As for social change, there are a hell of a lot more movements that have made substantial social changes than there are political parties or party caucuses. If you think that the only way to get things done is to jump into a political party, then your lack of creativity is a problem for you, not a problem for me.)

Brandybuck is also incensed that I would claim that limited government libertarians actually do believe in government:

Personally, I have no desire to join any movement whose members [minarchists] will turn around and shoot me in the end.

This is a vile mischaracterization of minarchists. Minarchists are not statists. They are anti-statists. What makes them different from anarchists is the pragmatic realization that anarchy is not viable. If a state is inevitable, then let’s see to it that it will be as small and as unobtrusive as possible.

This is, to be blunt, complete nonsense. If minarchists believe in limited government, then they believe in the right to make anarchistic arrangements not viable by prohibiting at least some individual people from seceding or otherwise withdraw their allegiance from the minimal state in favor of competing defense associations, or in favor of individual self-defense. If Brandybuck believes that I have the right to tell his limited government to go to limited hell, and to withdraw entirely from it to make my own arrangements, then his imagined minimal state is really not a sovereign state at all, but rather one voluntary defense association amongst many, and Brandybuck is no minarchist, but rather an anarchist. (In which case, welcome, comrade!) But if he does believe that a limited government has some right to make me use or pay for its services, even if I would prefer to withdraw from it and make arrangements of my own, then, like any other government program, this one is going to take the use of force or the threat of force by limited government cops. In which case my characterization of the minarchist political platform as including a plank on shooting anarchists, whether vile or not, is an accurate one. There is no third option. (Of course, minarchists accept a right of free speech, meaning that they will not shoot anarchists who just talk about anarchy. But in order to maintain a minimal state, they have to be ready to shoot anarchists who actually attempt to do something about it. And I care about the latter at least as much, if not more, than I care about the former.)

A bunch of people seem to have misinterpreted my argument as an argument for not doing anything, or for anarchists never to work together with minarchists on issues of common concern. Thus, for example:

Of course, if I had made an argument to the effect that working together with limited statists was always and everywhere destructive to the cause of freedom, then replying to the argument this way would be about as sensible as saying Great. Let’s stop trying to put out this fire by pouring gasoline on it. Well, yeah, that’s what you should do. If working together requires you to make trade-offs that actively impede the goals you’re supposedly working for, then you should stop trying to work together. The primary goal of libertarianism ought to be freedom, not maximizing the number of self-identified libertarians working together. The two are not the same, and if latter interferes with the former, then the former is always more important.

That said, that’s not the argument that I made. I’m not proposing that anarchists sit around and do nothing; I am proposing that they choose different means in order to get things done. Nor am I proposing that anarchists never work together with minarchists on anything. I’m willing to work with all kinds of people. I am proposing that we reconsider the scope of the cooperation, and the terms on which we do the work. As I said in the original post:

I would certainly agree that market anarchists should be willing to work together with coalition partners on particular issues of concern — the drug war, corporate welfare, the war on Iraq, etc. — whether those coalition partners are minarchists, or state Leftists, or whatever else. But who you’ll work with in issue-based coalitions is a different question from whose movement you’ll participate in, or what formations you’ll make the primary venue for your broader organizing and activism.

Here, as elsewhere, I’d argue that there’s a lot to be said for making things with small pieces loosely joined. There are plenty of times when it makes sense for anarchists to work together with statists of various stripes, as part of a common front for a common cause. But when we do, I’d suggest that the cooperation should be limited to fighting to win on the issue at hand — not spending years building up multi-purpose, long-term institutions or political parties whose goals have nothing in particular to do with anarchism. And I’d suggest that when we work in coalition, we do so through organizations of our own, on our own terms, and speaking for ourselves, not through centralized, non-anarchist smaller-government organizations that require us to spend our time talking about everything but, y’know, anarchy, in order to participate.

Probably the most common critical reply, though, is a claim that anarchists should work to build up minarchist parties because (1) in the current political climate, the practical differences between anarchistic and minarchistic politics are triflingly small (minarchists want to get rid of about 99% of existing government; anarchists want to get rid of the remaining 1% too); (2) where there are differences in ultimate goals, in the current political climate, the stuff that only the anarchists want to get rid of can’t realistically be gotten rid of, whereas some of the stuff that both anarchists and minarchists want to get rid of can realistically be gotten rid of (the war on drugs, or marginal tax rates, or whatever); and (3) once we have gotten rid of the 99% of stuff that anarchists and minarchists agree on, whenever that happens, then getting rid of that last 1% will be much easier for anarchists to pull off than it would be to get rid of that stuff now.

Thus Zeph, in comments here:

A minarchist system would have minimal ability to block the tracks, even if it had an interest in so doing.

And Brandybuck, who, while a minarchist, is ever helpful to inquisitive anarchists:

Ummm, when we get to a government that is about 1% the size it is now, this will become a relevant question. Not exactly holding my breath over that happening. Until we effing reverse the growth of government, the 0%ers and the 0.01%ers and the 1%ers and the 50%ers and even the 99%ers should all be pretty solid allies.

But accepting this argument would depend on my accepting a number of premises whose evidence is weak at best, or which are definitely wrong.

I would, for example, have to accept that a smaller, more limited government would have a harder time suppressing anarchistic activity than a larger, less limited government would. It might seem like this is obvious: bigger governments have more money, more hired thugs, more surveillance spooks, and more tyrannical laws that they can exercise in order to suppress anarchists than smaller governments do. But, on the other hand, bigger governments also have much more to do than smaller governments do. Under the present system, government cops fritter away time, attention, and energy trying to enforce all kinds of asinine laws. Under a minarchy, the government police forces would still exist, but they would have basically nothing to do with their time other than (1) dealing with small-time property crime, and (2) suppressing anarchistic activity. I think there’s very little guarantee that it would be easier to establish and sustain institutions that counter certain kinds of state power when the state is lean and mean, than there is now when it’s large, bloated, and corrupt.

In a similar vein, I would have to accept that the most likely way to significantly reduce the scope and power of government is to spend the next several decades working from within the state system in order to prune away this or that invasive policy — drug laws, abortion laws, immigration laws, the war in Iraq, especially stupid provisions of copyright law, egregiously high taxes, the most outrageous parts of immigration law, or whatever — and then only to go after the supporting pillars of state power — government policing and prisons, government courts, government military, government border control, the existence of even minimal taxation, etc. — once all the policy issues have been cleared out of the way. That may seem obvious, but actually it’s a substantial claim in need of defense, and I have not yet been given any reason to believe that this is true.

Of course, it’s true that if you have already committed yourself to making change through the vehicle of electoral politics, then partial reform on the particular policy issues is going to be much closer to being within your grasp than, say, abolishing government policing in favor of voluntary defense associations. But that’s only if you’ve committed yourself to electoral politics already; it certainly can’t be invoked as an argument for jumping into the Libertarian Party without assuming part of what it needs to prove. In point of fact, if options other than electoral politics are allowed onto the table, then it might very well be the case that exactly the opposite course would be more effective: if you can establish effective means for individual people, or better yet large groups of people, to evade or bypass government enforcement and government taxation, then that might very well provide a much more effective route to getting rid of particular bad policies than getting rid of particular bad policies provides to getting rid of the government enforcement and government taxation.

To take one example, consider immigration. If the government has a tyrannical immigration law in place (and, just to be clear, when I say tyrannical, I mean any immigration law at all), then there are two ways you could go about trying to get rid the tyranny. You could start with the worst aspects of the law, build a coalition, do the usual stuff, get the worst aspects removed or perhaps ameliorated, fight off the backlash, then, a couple election cycles later, start talking about the almost-as-bad aspects of the law, build another coalition, fight some more, and so on, and so forth, progressively whittling the provisions of the immigration law down until finally you have whittled it down to nothing, or as close to nothing as you might realistically hope for. Then, if you have gotten it down to nothing, you can now turn around and say, Well, since we have basically no restrictions on immigration any more, why keep paying for a border control or internal immigration cops? Let’s go ahead and get rid of that stuff. And then you’re done.

The other way is the reverse strategy: to get rid of the tyranny by first aiming at the enforcement, rather than aiming at the law, by making the border control and internal immigration cops as irrelevant as you can make them. What you would do, then, is to work on building up more or less loose networks of black-market and grey-market operators, who can help illegal immigrants get into the country without being caught out by the Border Guard, who provide safe houses for them to stay on during their journey, who can help them get the papers that they need to skirt surveillance by La Migra, who can hook them up with work and places to live under the table, etc. etc. etc. To the extent that you can succeed in doing this, you’ve made immigration enforcement irrelevant. And without effective immigration enforcement, the state can bluster on as much as it wants about the Evil Alien Invasion; as a matter of real-world policy, the immigration law will become a dead letter.

When anarchists participate in compromise efforts, such as the LP or the Ron Paul campaign, those efforts pretty much always only allow one of these two routes: the policy-reform-first route. They don’t allow for the evasion-first route because to set up and sustain the kind of resources that are necessary to enable evasion and resistance of government laws, you’re already trying to take the train to a station where the minarchist passengers don’t want to go: that is, you’re creating counter-institutions that are directly competing with, and attempting to undermine, precisely those state functions (law enforcement, the courts, military and paramilitary defense of the state against its declared enemies) that minarchists intend to keep. But why should we prejudge the contest in favor of the minarchist-friendly route? After all, which of these is the better strategy for getting rid of immigration laws? Well, as far as effectiveness goes, I don’t actually think that that’s a very hard question to answer. Look at all the practical success that the immigration reform movement has had in liberalizing immigration laws over the past thirty years or so. Here, I’ll make a list for your convenience:

Now, compare the success that illegal immigrants, state-side family members, coyotes, good samaritan ranchers, off-the-books employers, et al. have had in getting people across the border in defiance of immigration law, while avoiding or minimizing government interference:

From a practical standpoint, if I’m looking for a going concern, I’d say that the root-striking approach seems to be making a lot more concrete progress than the branch-pruning approach, at least on the specific issue of immigration.

Of course, there are concerns other than practical success. For example, many minarchists are likely to believe that there is a moral advantage to working from within the political system, and convincing those around you to change their votes, rather than consorting with criminals and making an end-run around the law. That’s reasonable enough, and may be a reason to stick to electoral reform — if you are a minarchist. But, of course, I’m not: I’m an anarchist; I think that government laws have no color of authority whatsoever; and I don’t think that people who evade or defy immigration laws are criminals in any sense worth caring about. And my earlier post was directed mainly towards other anarchists on a point of anarchist strategy; so if your counter-argument starts out by presupposing a certain level of respect for government law, then it’s going to be a non-starter as a response to my argument.

Setting moral concerns aside, there is a pragmatic concern that strategies that bypass legal reform in order to evade the law are more risky. Electoral reform campaigns may not get the results as quickly or as extensively as black markets do, but they’re also less likely to get you shot or thrown in jail by the government. That’s true enough. But, on the other hand, it’s easy to overestimate the risks of black market activities; the fact is that tens of millions of people get away with this stuff every day already, and the more talented and resourceful people turn their attention towards evading and resisting tyrannical laws rather than pouring their resources down the toilet of political reform campaigns, the more people will be able to get away with, and the more reliably they’ll be able to get away with it. Moreover, just as there is far more to political campaigning than just the act of voting or declaring a candidacy or lobbying or filing suit — there’s also fundraising, crafting and running ads, house parties, holding debates, canvassing, op-eds, buttons, bumperstickers, and the rest — there is also much more to an evasion strategy than direct participation in black market activities. There is also moral agitation and advertising aimed at convincing people of the legitimacy, or at least the unimportance, of so-called criminal activity, with the usual set of op-eds, buttons, bumperstickers, debates, etc.; there’s legal education and legal defense funds; there’s nonviolent civil disobedience; there are grey market activities that provide arguably or completely legal services that nevertheless help black market operators evade detection; and any number of other things, too. No doubt lots of us can’t or won’t take the risks involved in direct black market activity — because our circumstances or our temperament prevent us from taking it on — but if you can’t take on that much risk, you can still do plenty of things to concretely aid the broader strategy, without putting yourself in the path of the law.

Now, for all that I’ve said, it still may be the case that, for some other issues, the branch-pruning approach is more likely to be effective than the root-striking approach. But if you are an anarchist, then I think it would behoove you to think carefully about whether this really is the case, before you start putting your limited time and energy into a branch-pruning political campaign. Certainly there are plenty of examples I could cite other than illegal immigration. Compare the concrete progress of lobbying and litigation for liberalizing copyright law to the concrete progress of music and movie pirates in simply evading the enforcement of copyright law. Or compare the concrete progress of lobbyists at liberalizing drug laws to the concrete progress of drug smugglers and drug dealers at moving drugs to willing customers in spite of the laws against it. However many policy issues there may be that will be more easily addressed by the route of legal reform, rather than by the route of undermining the state’s capacity to detect and retaliate against law-breaking, I think there is every reason that they will be few enough, and far enough between, that it just doesn’t make practical sense for anarchists to spend their limited resources on open-ended, long-term commitments to building up smaller-government institutions. Not if the price is deferring talk about the illegimacy of the State as such, or about the right of people to evade its laws, or about the right of people to create counter-institutions to defend themselves against its law enforcement, in order to keep our outreach palatable to more or less limited statists. Anything that is worth getting through that kind of co-operation can be got through limited-scope, issue-driven coalitions. And we can do that kind of outreach and activism without signing onto intra-party Accords that sacrifice anarchist rhetoric or practical action in the name of taking one for the party.

Anarchism is about anarchy. The activism, agitation, and organizing that we do ought to reflect that. If it doesn’t, then you may very well be wasting your time and talents.

In Lawrenceburg, Indiana last week, Kayla Irwin, a young single mother, got served and protected by a paramilitary police attack squad:

A SWAT team raids the wrong home in Lawrenceburg, Indiana, now the homeowner wants some answers.

Police said they were led to the Village Apartments on the trail of fugitive Sean Deaton.

Convinced he was inside apartment 407G, the Lawrenceburg SWAT unit surrounded the building.

It looked like they were ready to go to war, one neighbor said. Some of the ones out here had AR15’s and shotguns.

Neighbors said police spent hours, ordering Deaton to surrender.

But when that didn’t work, they responded with tear gas and forced entry.

Only one problem. It turns out that the reason he didn’t come out to surrender is because he was never fucking there in the first place. They had the wrong apartment.

It looked like my apartment was on fire. The smoke was just blowing out of my windows, Kayla Irwin, the tenant of 407G said.

Irwin, a single mother of two, said she is unable to live in her apartment and didn’t even know the man police were searching for.

Now, she said, she has been left with the mess and no apology.

It’s all covered with poison. I don’t know where to start over with two kids, said Irwin. How do you start with replacing the items that your kids have had since the day they were born?

You can see what the assault squad left when they were done in the video news story. The windows are all boarded up. The inside looks like a disaster area. The reporter who did the story still couldn’t stay in the apartment for long before the lingering tear gas residues made it intolerable to stand inside. Ms. Irwin’s neighbor, Emanuel Brightwell, a soldier who had just come back from clearing landmines in Iraq, said that he’d never seen anything like it, and that while the cops were ransacking her place, it looked like they were enjoying what they were doing. They did not need to do all this.

Irwin said she appealed to the police, but hasn’t gotten anywhere.

They basically just said, sorry for the inconvenience. Go ahead and clean it up. Clean up our mess, Irwin said.

She said she’s had to borrow everything from family in the week since the incident.

She also said she can’t stay in the apartment because of the acrid gas residue.

An assistant chief and another officer were at the Village Apartments talking to Irwin telling her that they would try to get some money so she could clean her clothes and furnishing on her own.

This is the first time this has happened. I’m surprised the incident has not been remedied. We will take care of it the best we can, the assistant chief said.

Note that the boss cops had refused to do this, and barely even offered an apology for the damage that their own employees had caused, until the local TV news got involved. Once a reporter called the police department for a statement, it took about 30 minutes for an assistant police chief to make his way down to her apartment complex and make some vague offers to try and rustle up some petty cash to help her get her clothes and furniture cleaned.

In the real world, outside of statist power trip la-la land, when you fuck up somebody’s life like that and trash their house, all due to a mistake, you pay for what you did. That’s how civilized people step up and try to make it right. At a minimum, that would mean paying her expenses and her rent for the time she was unable to live in her own home, paying for a professional cleaning of the apartment, paying to replace anything that their goon squad destroyed, and paying restitution for the family pet that they killed in the process. Also, in the real world, when you have make this kind of thing right, you pay for it; you don’t just get to send a bill to a bunch of unwilling third parties who never agreed to get involved. Here, the people who pay for it should be the cops who trashed her house and the police commanders who ordered them to do it. And I mean pay for it out of their own personal accounts. Of course, public servants that they are, they will instead pass along whatever costs their fuck-up may incur straight to a bunch of innocent taxpayers who had nothing to do with the raid.

If you want to know why cops keep forming heavily-armed elite goon squads, and keep on indulging in this sort of macho paramilitary dick-swinging exercise, no matter how many times they end up ruining, hurting, or killing innocent people in the process, well, that’s the reason right there.

I Used To Not Be Anti-Cop

There was a time when I used to believe that the police had a duty to serve and protect, to care for our property and to keep criminals away. Over the years, however, I have come to realize that though real crime exists in society, it is the cops who commit most of it.

This was not a very easy decision to make. Whenever I saw injustice and brutality, I would brush it off as a sporadic episode and move on. Having seen (and this is another reason why it’s very important to keep the internet free) video after video of people being tasered, shot, beaten, executed, roughed up, fined, ticketed, jailed, harassed, insulted, and being subjected to an infinite number of abuses, it’s hard to stay optimistic about the police and the system that runs it.

Government police is subject to the same ethical and economic analysis that is applicable to other government functions. Given that the state has no incentive to protect; that it can always count on taxes; that it is institutionalized aggression; that it legislates and therefore steals and plunders – given all these things, I had to change my tune. What I had thought to be random incidents of abuse were nothing but the normal, symptomatic function of the government at work: a series of inefficient and unethical monstrosities committed against society, allegedly for its own good.

I understood, then, that police departments are just another government program. Government programs, because they rely on taxation and legislation, are not wanted by society. And we know this is true because by resorting to taxation and regulation we have eliminated competitors who in the market would otherwise be free to meet the demand for security with a supply of such a service. Therefore, it is impossible to know that the quality and quantity of defense that is offered by the government reflects what people want. We cannot express our preference.

So far I have talked mostly from an economics perspective and determined that since there is no choice, there is no real efficiency to speak of for one cannot decide how to best spend money and allocate scarce resources for defense. Now I shall continue to develop the idea that started this short essay: most crimes are carried out by the police.

When I refer to “crime” I don’t mean crime as defined by state legislature but seen as the violation of property rights. Things like taxation and eminent domain are clearly theft. And so are conscription and minimum wage laws because the former constitutes theft of the use of one’s body while the latter violates the right to contract freely.

We are now in a position to recognize that most crimes are committed by cops. Since cops are the enforcement arm of the state, they are the ones who must physically interact with citizens. And what do they do? Well, it’s business as usual: raids, searches and seizure, the war on drugs, on immigrants, on various “inequalities” and the list goes on and on.

The amount of “public crime,” crime carried out by the government is overwhelmingly larger than “private crime.” Indeed, there are probably not many people alive who have not been forced to pay some sort of tax or been subjected to regulation. And taxation and regulations are ultimately enforced by the police or another police-like executive authority. The existence of the state (even a minimal one) guarantees that the amount of public crime will always exceed the amount of private crime because while one can chose not to be a criminal, the state is nothing but a criminal entity.

There is one last point that remains to be said, and that is whether the police can respect your rights and act legitimately in the occasion where they prevent a true crime from occurring. At first it would seem that this would be an exception of the criminality and inefficiency of the police. But let’s not forget that state-based defense is essentially socialist – you pay for it regardless of your need and often the cost is the same no matter how much you use it. Thus, one can be glad that in some instances the police do protect you against private criminals, but it would be unlibertarian to forget that your defense was financed by aggressing against everyone else. Sounds a little bit like welfare doesn’t it?

And what about the rights of the pacifist? To the extent that pacifists are taxed to support the police, they are being forced to support something they don’t believe: any kind of violence, aggressive and defensive. Here, too, we see inefficiency and unjustness (this is similar to the vegetarian who must still pay for government-mandated meat inspections and regulations). Finally, even the Supreme Court has ruled that the police do not have a duty to protect you.

Unlike juries and judges and unlike legislators and prosecutors, the cops are the ones ultimately doing the dirty deeds. The judicial and legislative branches must count on someone to carry out their edicts. Of course, that implies that they are also guilty in the causal chain of criminality and are not exempt of guilt. The reason why I am picking on cops is because they are the most visible branch. Almost every interaction between the state and serf occurs through the executive branch – police officers, tax collectors, the various inspectors, regulators, confiscators and so forth.

Police officers technically must enforce all laws. Given the number of laws out there, let’s be thankful that they are incapable of doing that. Let’s also be thankful that we don’t get all the government we pay for. If the state is institutionalized aggression, then the last thing we want is an efficient government, or, for that matter, efficient cops.
