UNLAWFUL POLICE SHOTING!

I am the victim that is getting no attention from the media! Notice how they put non-life threatening I was just at the wrong place, wrong time I ending up getting shot in the neck FEB 06 2011 as i was sitting shot the officer came & still put the handcuff on me while there was a 40cal bullet in my left joint I am thankful for surviving I owe the lord my life but what im upset about is I owe 100,000 in medical bills with insurance covering 90% which when they investigate will rise to a million dollars! today i just ask for support from anyone thats been through this police brutality i am forever scared and just wish justice would really be served.. i need advise im sewing RPD but I doubt ill win =’/ there was no hit and run and there was no second shooter!!

The man was arrested and another suspect was being sought, the Press- Enterprise reported on its website.

Police were called about 1:15 a.m. about a hit-and-run accident and a person with a shotgun in the 9400 block of Miller Street.

Arriving officers saw a man with a loaded shotgun who pointed the weapon toward a crowd of people who were running away and an officer shot at him, the newspaper reported.

Two people were taken into custody, and one was hospitalized with a non- life threatening gunshot wound.

Jose Oyarce, 18, of Corona, was booked into the Robert Presley Detention Center on suspicion of assault with a deadly weapon and illegal possession of a loaded firearm.

Meantime, another officer encountered a male shooting toward the responding officers and a second officer-involved shooting occurred, but the male escaped on foot, the newspaper reported.

A few of my thoughts:

This is a difficult, but potentially important scenario playing out.

SETTING THE SCENE:

A halfway house (SCADD) has a highly intoxicated individual attempting to be dropped off by his girlfriend. Before being let inside, he blows a 0.385 on a breathalyzer according to the intake nurse. Protocol for someone that intoxicated is to call 911 and have them transported to the hospital. The SCADD nurse calls 911.

Ambulance and Fire are first to arrive at scene. The 6 staff members of SCADD are also outside with the intoxicated man and his girlfriend. The man, barely able to speak, let alone walk, is attempting to plead for his girlfriend to take him home. Apparently, someone from Fire or Ambulance relays a message to PD dispatch that the man is heavily intoxicated and arguing with his girlfriend.

POLICE ARRIVE:

The NLPD are last to arrive on scene. According to a sworn witness statement (acquired and released by the newspaper covering the story) the 1st Officer on the scene, parked and sprung from his car, ran right for the drunk man, grabbed his short from behind and threw him to the ground. The 2nd Officer has arrived by this point and allegedly starts punching the “suspect” (at this point VICTIM) in the face as 1st Officer cuffs the “suspect”. Even after cuffing, it is alleged that the 2nd Officer slammed the “suspect’s” head into the concrete several times. It was also reported that one of these officers had kicked the “suspect” in the gut, but that was not included in the one witness statement that the newspaper acquired. a 3rd & 4th Officer arrived and maced an already handcuffed “suspect”.

It should also be noted that it is alleged that Officer 1 did NOT identify himself nor ask the “suspect” to step back and speak to him. It is alleged he entered the scene determined to take the “suspect” down. The nurse who called 911 stated that she never indicated that the “suspect” was a danger to anyone, only that he needed to be transported to the hospital because of a dangerously high blood alcohol content.

A Seargant arrives on scene and Officer 1 was allegedly heard stating that the “suspect” was attacking his girlfriend as justification for his actions. All 6 non-emergency witnesses (SCADD staff) maintain that ‘suspect” was NOT attacking his GF and at no time did anyone believe he was a threat to anyone but himself.

The “suspect” was thrust into the back of a Police cruiser. The SCADD nurse who had placed the 911 call reiterated to the Officer that she had called because the “suspect” needed to be transported to the hospital – and with a BAC of .380, he STILL needed to go especially after the ordeal he had been put through. The Officer responded, “he’s going to jail”.

The FD Chief was alleged to have told SCADD staff that the State’s Attorney has assured him and the PD that this type of force is acceptable whenever dealing with an intoxicated individual. It’s important to note that the FD Chief was reportedly NOT yet on the scene to witness the Officer running to and slamming the suspect to the ground. Also the FD Chief has not responded to media requests for clarification of his statements since the incident.

WHAT TO WATCH:

The Mayor is brand new and just assumed office a few weeks ago. He is the City’s first elected Mayor in 80+ years under our new Charter. He is a Progressive/Libertarian type and well liked among the young professionals, artists and students. One of his very first acts as Mayor was issue an Executive Order to the PD to look the other way when they observe marijuana use on private property. New London, like many urban municipalities are strapped for cash, and focusing PD resources on violent crime and gang activity are far more a priority than dealing with minor marijuana infractions. Posession of a half ounce or less is now a misdemeanor in CT. (The States Attorney eventually ruled that the EO wasn’t in line with State law. No harm, no foul).

The Chief of Police has been on the job for 3 years. She has spent her entire career with the NLPD. She is also considered a Progressive who has tirelessly attempted to root out bad/under-performing Cops, improve relations with the community through outreach (ex: answering emails directly, actually walking through neighborhoods and speaking with residents), and is not a fan of force without justified provocation. It is also believed that she was fully on board with the Mayor regarding the EO on marijuana enforcement.

The caveat here is that, if not for the new Mayor, she was going to retire because there were factions within the NLPD (ol’ boys club) and the old City Council that were trying to force her out by undermining her authority. The voters clearly sent a message to the PD’s old guard with the election of the new Mayor who very publicly supported the Chief during the campaign.

They Mayor and Chief immediately began an investigation and now we await word on what their findings are.

In my view this potentially is a case study on what happens when good people assume positions of authority and leadership and are just beginning to shape how to lead their administrations.

More importantly, it could serve as a rebuke of the kind of tactics that are alleged to have occurred.

The Chief is known for wanting more compassionate policing. She see’s no advantage in intimidating the very citizens that employ her and her Police force. Yet, this situation is the type that can be marred by internal politics (i.e. Police Union) and community relations calculations.

Through all of this, the mugshot of the “suspect” (victim) still has not been released to the public.

Why would an Active LEO disclose the “Tricks of the Trade”?

I have been an Active LEO since long before the existence of this website and many others like it. I have said in previous posts that I am an Advocate for filming the Police and all Government Officials at work.  While I may not agree or understand with everything I have read here or in conversations with people, I respect their opinions and their right to demonstrate against what they believe is wrong. In fact I support some of those demonstrations.  I am also ON THE RECORD now as saying that whether or not I understand a persons position, I respect it and support their right to protest. I have also read and heard some things that warrant my saying something.

It’s been said that” all LEO’s are corrupt and criminals”. To that I say we forget that while Police,Judges,Meter maids, and politicians are LEO’s, so is the Defense Attorney that represented you in your own cases before any court.  If you have traveled the country for business or pleasure you may have noticed that while all marked law enforcement vehicles say “POLICE” on them, they also say what city,town, or state in which that particular vehicle belongs to. with that in mind how can the LAPD Officer that was killed while engaging the  bank robber who came out shooting wildly be treated the same as the Fullerton Cops who beat a man to death? or the Miami Officer that took a bullet in the spine and is now paralyzed because he threw himself on top of a 5yr old who was playing in his yard when a gang shooting erupted be held in the same regards as the the “COP” that shot the guy in the bar over a dart game? I understand the contempt for the system and Law Enforcement in general but to lump all LEO’s into the same category and to say things like ” all cops should be killed” or “The better idea is to kill the officer’s family because it makes a bigger impact” is mind blowingly stupid. to refer to all LEO’s children as ” Demon Spawn who will eventually become Demon’s themselves” is equally stupid.  but here I sit, at the ready to protect those same individuals from being killed or abused and while I dont WANT to take a bullet for anyone, I will if need be to save them just like I would those that think we are good people.

Now your probably wondering after that last statement why I would want to expose the tricks SOME cops use to get “Business”. Well the answer is simple. Despite my occuaption I am still a citizen and tax payer afforded the rights and protections from harm and abuse just like you are. I dont agree with alot of what others in my profession do and say and I think giving you some insight into things falls under the blanket of my Oath.

Ever gotten pulled over and the Officer claims he “Clocked” you going “X” amount of speed and you knew there was no way you could have been going that fast?  well here’s how.

on the Dash of the Patrol car there is the Radar unit that has 3 boxes. 1 marked “YOUR” speed which is the speed in which the patrol car is going. “Target Speed” which is the speed of the vehicle caught in the beam of the radar, and “LOCKED” which is what the target speed is when the officer hit the “LOCK” button on the remote. Depending on the RADAR Model, There is a Button for “Stationery” and “Moving” located either on the Remote or the box itself. In order for the RADAR unit to compute how fast a car is going it has to know what the patrol vehicle is doing hence the “Stationery/Moving” button or switch. If the officer is sitting still and running radar he is in “Stationary” mode and if he is running radar while driving down the road “MOVING” is the mode his RADAR unit should be in.  Now let’s say Officer Jackboot is bored and isnt getting any speeders. He see’s a car traveling about a mile ahead and moving away from him. Officer Jackboot puts the RADAR unit in “Stationery” mode and kicks the cruiser into overdrive. while the cruiser is in motion with the RADAR in “Stationery” whats happening is the “TARGET” window mentioned above is now registering the Speed of the cruiser and not the speed of the car he is chasing down.  So Officer Jackboot gets his cruiser up to a speed over the limit, hits the lock button and BAM your busted.  You can ask to see the radar and he is most likely let you because what your going to see when you look at it is he locked you in at “X” MPH. fighting the ticket is futile because he is going to bring the dash cam video where it “clearly” shows he is behind you and the Camera isnt showing you what the RADAR is reading at the time he is behind you.  Do ALL LEO’s use this trick?  NO but it does happen.

Another “Speed” trick. The Radar is calibrated with 2 tuning forks.  Bang the first one on the dash and hold it in front of the Antennae ( thats the round box either on the dash and rear window or hanging on the side windows ) and the Radar should lock at 44MPH depending on what the fork is set to read. so, Officer Jackboot is sitting on the side of the road in a school zone. Car goes by going 20MPH, He bangs the tuning fork and hold its to the antennae and YOU are now going 44 in a school zone. again fighting the ticket is futile for the same reason as before.

Common Interrogation trick is what I call “Sugar Coating” the Miranda Warning.”  The Law provides that before being questioned about a Felony investigation or after a Felony Arrest you must be given the Miranda Warning. You’ve all heard it 1000 times on TV or maybe you’ve been read the Miranda Warning. Under the Law the Officer giving the warning does NOT have to read it verbatim. As long as the whole warning is read it CAN be broken up with other things. Example: ” You have the Right to remain Silent but we are just talking here. Anything you say can and will be used against you in a court of law but if you didnt do anything wrong then you have nothing to worry about, you have the right to an attorney but I’m not going to ask you tough questions so why would you need one, if you cannot afford an attorney one will be provided at no cost but I gotta tell you I have seen judges order people to repay the state for that attorney and its expensive” see how I gave the WHOLE Miranda Warning while not only minimizing it’s importance but also making a person afraid that they MAY have to repay the services regardless of guilt? and it’s all legit under the law. I dont agree with doing any of these things and I personally dont do them. I dont do traffic work anymore but A LOT of Felony/Federal Investigations and I ALWAYS encourage suspects to avoid talking to me without an attorney and read them the Miranda Warning in the manner in which it was intended. I have the burden of proving your guilt and should be able to do it without any help from the accused.

I would love for someone to show me where in my Oath or in the Law it states that I am only obligated to enforce the laws I agree with. I hear time and time again about “Victimless Crimes” and while I believe those type of Crimes exist, and I also believe there are victimless crimes that shouldnt be crimes at all. I also believe that when it comes to traffic law that if the PC isnt a ticketable offense then it shouldnt be PC to stop the car. But if someone can show me or point me in the right direction where it says anything about only enforcing laws I agree with it would help me greatly.

As 2011 winds to an end, Policeone.com’s Senior Editor, (“I shoot stuff and I read stuff”) Doug Wyllie has published his annual book list of recommended reading for cops.

1. BEAUTIFUL LIFE by Robyn Walensky, a book on the Casey Anthony case and trial.

2. TELL TO WIN by Peter Gruber. Wyllie writes:

“I recently received my copy from Amazon and just from perusing the inside front jacket I’m pretty sure I’m going to love this book. It says, in part, ‘Historically, stories have always been igniters of action, moving people to do things. A clear psychological profile emerges of Mr. Wyllie from his reading list. Obviously, Wyllie sees the world as cops (the good guys) against everyone else (the bad guys) and he seems to relish books on violent death.

Traffic Stop Involving Hanover County Sheriff Department

Today, as I normally do on a daily basis, I ran a red light, safely, and with no more risk had the light been green. There was clear break in traffic, I looked both way, and to my front and rear and decided it was safe to proceed and make a U-turn through the red-light. Unfortunately, I didn’t look hard enough to see the one car an 8th of a mile (or more) behind me, was a guy with a gun and a badge – who from my experience, extorts money and kidnaps people whom are peaceful.

So I get pulled over and the video captures the short conversation we had.


The “No Victim, NO Crime” reasoning in brief: (Facebook No Victim No Crime)

Police are public servants, who’ve for the most part, conveniently forgotten they are “Peace Officers”, they are out to “keep the peace”. Well, “Peace Officer” “L.T Norman” broke MY Peace, when he pulled me over. He claims I committed a “crime”, yet when asked who’s life, liberty or property did I harm, he could not answer me.

I consider myself a contributor and activist with the (decentralized) organization called “Cop Block“. Cop Block is nothing but a (scattered) group of individuals who want to hold police and other public officials accountable, and transparent. They/ we also wish to put an end to immunity for public officials as well as double standards; hence “Badges don’t grant extra rights”.

Contributors of Cop Block understand the extreme importance of FILMING the police; that is your ONLY defense/ weapon against the police. I highly encourage you to film the police ANY TIME you talk to them. We also try to get them to realize that not ALL “Laws” are “good laws” or “just (justifiable) laws”, not all laws are Constitutional. MANY laws undermine our freedom (and we are supposed to be okay with that because it’s in the name of “safety”. So we encourage them to use discernment oh what laws to uphold and that if they can not identify a victim to a particular “crime” – then it’s not a crime… aka “No Victim No Crime.” Examples include (seat belt laws, speeding, drug use, prostitution, gambling, and the list goes on and on and on.) We also encourage them to keep their oath, and to remember they are a public servant, aka a Peace Officer. 

I did not harm anyone, and if I had, I would take responsibility for my actions. I am a strong advocate for PEACEFUL civil Disobedience and Non-Cooperation. Just KNOW that ANY and ALL individuals should be held accountable, w/out a doubt for harming someone else or their property or taking their liberty from them using some degree of aggression/ coercion. I safely and responsibly ran a red light. Just because Your light is “GREEN” does NOT mean it’s safe to go, but so many times people are stuck in the “OBEY” mind-frame, where they become dependent on being told what to do & when to do it all the time – they stop thinking for themselves and therefore become less responsible for their actions.

“In cases where you claim there is a real threat of danger, the “victim” (potential victim) needs to be personally identified. For instance, if Nathan had run a red light carelessly and almost hit an old lady crossing the street, that old lady can be identified as the potential victim. Making blanket “anyone could be a victim” statements applies to almost any behavior, so we would all be criminals under that theory. Being treated as a criminal at all times is NOT “freedom”.” –Says Meg McLain a well known Liberty Activist.

Several folks from Keene, NH (FreeKeene.com) decided to pay the Keene Police a little visit on Friday, the day before Christmas Eve. Our, yes I was present as well, intention was to bring some Holiday cheer and a message to those at the Keene Police Station.

This holiday season I hope all those who are employed by tax dollars ask themselves one question, “If our job is so important why must the government force people to pay for it via taxation, whether they like the service being provided or not?” And if you come to the conclusion that individuals would pay you (voluntarily) to do what you do now, then quit your job and start your own business – without the government’s permission. Cause all I want for Christmas is a choice, something ALL police officers take from a person when they choose to work for Uncle Sam.

John Connell, whom we interviewed during the FreeState Friendship tour, attended my arraignment last week in Manchester, NH. There were 48 people scheduled to be arraigned that morning but just before court started the court woman said, “If you’re not here for the State vs. Adam Mueller you’ve been move to the court room downstairs.”  While the number of bailiff’s remained the same – as if there were still 50+ people in the room. John took the moment to address the government agents – ‘the bailiffs.’ Most of whom I would guess were around his age.

What do you think? Are cops, and/or government agents, acting more and more like the countries the government claims to be protecting you from?

Support drug reform? If you do these, you’re not helping your cause.

I spend quite a bit of my free time reading news articles, blogs, and other internet media about the war on drugs. While it’s great that there’s so much support out there for ending prohibition, I can’t help but notice that a lot of my fellow anti-prohibitionists are doing a lot of things that hurt the cause. Here I’ll list three of these things and try to explain why, at least in my opinion, they’re not helping.

Stop making drug reform a partisan issue

One of the biggest things I see – especially on message boards and in comment sections on articles – is well-intentioned Democrats putting all the blame on Republicans for prohibition and for less restrictive drug laws not getting passed. It’s obviously true that Democrats support drug reform at a higher rate than Republicans. I’m not arguing with the results of pretty much every poll out there on the subject. However, the GOP or even conservatism in general is NOT the problem. In fact, both 2012 presidential hopefuls that have explicitly stated their support for pot legalization (Ron Paul and Gary Johnson) are Republicans. Obama constantly dodges the issue when he’s asked about it and even on the rare occasion that he actually answers questions about it he gives a canned answer or flip flops around and changes the subject.

What I’m trying to say is, let the Republicans in on our efforts! If we keep drug reform as an exclusively liberal issue, it will be a hell of a lot harder to get anything done. For one, there are plenty of prohibitionist Democrats out there – just as there are plenty of anti-prohibition Republicans out there. The only thing accomplished by making this a partisan issue is the alienation of a lot of conservatives who would otherwise at least consider supporting an end to prohibition. There are several good arguments against prohibition on both sides of the two-party coin – in fact, I tend to favor the conservative-leaning arguments for reform myself – so why shut out a good chunk of people and arguments that can only help the cause? Getting rid of the liberal “flavor” drug reform has in a lot of people’s minds can do nothing but increase support.

Quit hiding behind medical marijuana laws

This is related to my last point about shutting out good arguments. A lot of people I’ve seen interviewed about medical marijuana (which we should really be calling medical cannabis – I’ll touch on that point later) insist that “we only support sick people having access to marijuana and are completely against personal use!” First off, 99% of the time you pretty much have to be an idiot to actually believe that. Second, people who do support legalization of personal use have an awful lot of explaining to do later on if they use that line. It would be infinitely better for them to say something along the lines of “I personally think recreational use should be allowed, but this particular bill we’re talking about now only applies to medical use.” Medical cannabis laws are a good first step towards full legalization, but it’s a lot harder to get beyond that first step if supporters have already established themselves as only supporting medical use.

Stop calling it marijuana!

This one will seem like I’m just nit-picking at first, so I’ll start off with a simple question: Who uses the word “marijuana” the most? I know it’s not the people who use it, at least not the ones I’ve met. Pretty much every pot smoker I know generally says “weed” or “bud,” with a few saying “herb,” “green,” or “ganja” in casual conversations amongst themselves. Otherwise, “pot” is overwhelmingly the word of choice. In fact, I don’t think I’ve ever heard any Joe Stoner refer to the plant as “marijuana” without a humorous undertone, with the possible exception of legal contexts. “Pot” (and to a much lesser extent “weed”) also seems to be the word of choice among non-users – non-users covering a wide range of demographics, from the guy who would take a toke from time to time if his job didn’t drug test him to the guy who has no interest or opinion on the plant to the guy who thinks all pot smokers are idiots.

So I’ll ask it again – who actually says “marijuana?” The answer is hardcore prohibitionists – the “drugs are bad, m’kay?” crowd. Politicians, prosecutors, police, people in the “treatment” and drug testing industries who want to make a buck off your “addiction” whether or not you’re actually addicted – these are the people who use the word “marijuana.” Why do they call it marijuana? Why not just call the plant cannabis, its actual name? When pot first became illegal in 1937, Harry Anslinger and his prohibitionist cronies used yellow journalism to plant the seeds (no pun intended) of fear in people’s heads. This included getting people to associate cannabis with blacks and hispanics, a problem still seen in the justice system today despite statistics that show drug use to occur at similar levels across races. Below is an example of Anslinger’s taking advantage of his era’s prevalent racism:

“There are 100,000 total marijuana smokers in the US, and most are Negroes, Hispanics, Filipinos, and entertainers. Their Satanic music, jazz, and swing, result from marijuana use. This marijuana causes white women to seek sexual relations with Negroes, entertainers, and any others.“…the primary reason to outlaw marijuana is its effect on the degenerate races.” Marijuana is an addictive drug which produces in its users insanity, criminality, and death.”Reefer makes darkies think they’re as good as white men.”Marihuana leads to pacifism and communist brainwashing”You smoke a joint and you’re likely to kill your brother.“Marijuana is the most violence-causing drug in the history of mankind.”

In fact, the word “marijuana” has its origin in the early prohibitionist movement. The word was invented not by hispanics but by racists trying to build an association between hispanics and cannabis. If you don’t believe me, I suggest you read up on early 20th century medications. Cannabis was a key ingredient in a lot of these medications, and I can guarantee you that the word “marijuana” is nowhere to be found on the labels. Instead, the labels called the plant what it is – “Cannabis sativa” or “Cannabis indica.” So be careful what words you use when you talk about the legalization movement – the word “marijuana” has a built-in negative connotation that permeates through its little-known origins even today.

I hope anyone who reads this finds it helpful, or at least puts more thought into their conversations about prohibition. Smoker or not, liberal or conservative, professional protester or barely pays attention, it doesn’t matter. As long as you believe the war on drugs is a failure, you can help move things in the right direction. It doesn’t matter if you email elected officials in your state, hold up signs on the capital steps, or even casually bring it up when talking to a friend. Anything that gets people to think is a step forward.

Suspected Prostitute Discarded; Actions of Emergency Responders Questioned

These officers, firefighters and EMT’s should be ashamed of themselves for the way they handled an unconscious woman in the video below.

First the police arrive and take their time to walk over to an unconscious woman laying on the ground. Then they kind of nudge her once and the other officer gives her a little kick (that was nice of him).

Do they not teach police even the most basic first aid, even something simple like CPR? ABC’s: Airway, Breathing and Circulation that should have been immediately checked.

Then the firefighters arrive and they are even worse. They whip her around by a leg and arm like a rag doll with no neck support only to take out their cell phone cameras to take pictures of her motionless body instead of checking her vital signs. Instead they all stand there like useless tools laughing about something.

Finally an ambulance arrives and I’m thinking she is going to get some help, but again I am wrong. They just flop her over on her back, no body roll and no neck support. Drop her on the stretcher and roll her away.

I know the police have no obligation to help or protect you so I’m really not surprised at how useless they were, but I was completely blown away by the firefighters  and EMT’s for the lack of care and professionalism they showed.
