Ending State violence against women in prostitution in San Francisco

Last year, a dangerous California street gang rolled up on 1,583 women and abducted them off the streets of San Francisco, tied them up, and held them against their will for days or weeks at a time. Some were robbed of money and then let go. Others were held in specially-constructed dungeons for as long as half a year before they were allowed to see the light of day again.

There has been little notice of this massive wave of violence against women in the malestream media, and little outcry, even though this same gang is still active, and is on track to abduct a similar number of women this year. Part of the reason for the neglect of this story is the fact that the 1,583 women were women in prostitution, or suspected of being in prostitution and all too many people (by which I mainly mean men, and by which I mainly mean pols, lawyers and cops) figure that assaults and disappearances are just business as usual for women in the sex trade, something that can be stamped N.H.I. and shrugged off with a blink.

The other part of the reason is that the street gang’s colors are blue, and they all carry badges, and they call these abductions arrests, the imprisonment pretrial detention or a sentence, and, even though the women they target and grab off the street through force or intimidation are just doing a job for willing customers, and threatening or attacking exactly no-one, these gangsters can count on the biggest racket of all — the protection racket known as the State — to get their back, to claim their violence is justified because it is carried out under color of The Law (as if that were somehow immune to question or challenge), and to put out well-paid mouthpieces who will insist, with a completely straight face, that when women in prostitution are being forcibly hauled off, arrested, cited, fined, jailed, and generally subjected to an attempt to forcibly destroy their livelihood, the people (mostly men) who are doing all this are actually doing it for the women’s own good.

In fact these rationalizations are no better than — really, no different from — the rationalizations that every abusive man in the world uses to pass off their controlling behavior and violence against their women as if they were expressions of love. The male-dominated State is nothing more than an abusive sociopath writ large — one that can attack women by the thousands or by the millions, and one with armies and dungeons and trillions of dollars at its disposal.

As I said last December 17th:

Any serious commitment to freedom for, and an end to violence against, women, means a serious commitment to ending violence against women who work in the sex industry. All of it. Immediately. Now and forever.

And that means any kind of violence, whether rape, or assault, or robbery, or abduction, or confinement against her will, or murder. No matter who does it. Even if it is done by a john who imagines that paying for sex means he owns a woman’s body. Even it is done by a cop or a prosecutor who calls the violence of an assault, restraint, and involuntary confinement an arrest or a sentence under the color of The Law. The Law has no more right to hurt or shove around a woman than anyone else does.

This November, eligible voters in San Francisco have an opportunity to call for peace on this front of the city government’s war against women:

San Francisco would become the first major U.S. city to decriminalize prostitution if voters next month approve Proposition K, a measure that forbids local authorities from investigating, arresting or prosecuting anyone for selling sex.

The ballot question technically would not legalize prostitution, since state law still prohibits it, but the measure would eliminate the power of local law enforcement officials to go after prostitutes.

Proponents say the measure will free up $11 million the police spend each year arresting prostitutes and allow them to form collectives.

It will allow workers to organize for our rights and for our safety, said Patricia West, 22, who said she has been selling sex for about a year by placing ads on the Internet. She moved to San Francisco in May from Texas to work on Proposition K.

Even in tolerant San Francisco, where the sadomasochism fair draws thousands of tourists and a pornographic video company is housed in a former armory, the measure faces an uphill battle, with much of the political establishment opposing it.

Some form of prostitution is legal in two states. Brothels are allowed in rural counties in Nevada. And Rhode Island permits the sale of sex behind closed doors between consenting adults, but it prohibits street prostitution and brothels.

Police made 1,583 prostitution arrests in 2007 and expect to make a similar number this year. But the district attorney’s office says most defendants are fined, placed in diversion programs or both. Fewer than 5 percent get prosecuted for solicitation, which is a misdemeanor punishable by up to six months in jail.

Proposition K has been endorsed by the local Democratic Party. But the mayor, the district attorney, the police department and much of the business community oppose the idea. They contend that it would increase street prostitution, allow pimps the run of neighborhoods and hamper the fight against sex trafficking, which would remain illegal because it involves forcing people into the sex trade.

If the proposal passes, we wouldn’t be able to investigate prostitution, and it’s going to be pretty difficult for us to locate these folks who are victims of trafficking otherwise, said Capt. Al Pardini, head of the police department’s vice unit. It’s pretty rare that we get a call that says, I’m a victim of human trafficking or I suspect human trafficking in my neighborhood.

While I certainly agree that coerced sex trafficking is an evil that needs to be seriously addressed, government officials and government cops like Captain Al Pardini, who claim to be concerned about the welfare of women forced into prostitution, refuse to talk about ways to address the systemic issues that stop trafficked women from being able to come forward and speak out or seek help about what’s been done to them (like, the State’s violence against undocumented immigrants and the threat of deportation; like, the police’s refusal to take women in prostitution seriously or treat them like human beings), and instead they apparently feel perfectly comfortable insisting that their difficulties in investigating sexual slavery somehow justify laws that grant police the power to force any woman suspected of being in prostitution off the street and into police detention, under police scrutiny, to imprison her, to force her to pay punitive fines, to conduct arbitrary police raids to go on fishing expeditions for trafficked women (e.g., at Asian massage parlors) based on nothing other than racial profiling, and so forth, and so on, all in the name of facilitating the police’s attempts to investigate a different crime that affects some subset of the women being rousted up, shoved around, arrested, questioned, fined, imprisoned, and so on, and all in order to be able to force trafficked women into the protection of the criminal law, with or without their consent. This amounts to nothing more than an argument for ensuring that the State maintains and exercises plenary police state powers over all women suspected of being sex workers, for no reason other than the alleged necessity of protecting some women in the sex industry from violence, while ignoring the many crimes that women in prostitution are never able to report to the police for fear of being arrested, and while ignoring the immense violence against all women in the sex industry that is committed by cops themselves, as part and parcel of this policy of arrest and detention. Nobody would ever accept this argument if it were directed against a class of people whose basic human rights malestream society is more accustomed to granting. (E.g., We need to be able to investigate the enslavement of migrant farmworkers; let’s outlaw farming! We need to be able to investigate medical malpractice; let’s give the cops the power to arrest any doctor and charge them with a misdemeanor!) It is only when it comes to people who powerful men regard as official non-persons that these kind of arguments get made — whether they are made against the safety and freedom of women in prostitution, or against the safety and freedom of immigrants without government papers or unauthorized drug dealers, in parallel arguments for government border laws and drug prohibition. That’s despicable, and it’s baffling to reason. If you have the chance, I’d strongly encourage you to vote Yes on Prop. K, and No on police state tactics and government violence against women.

I should say that, while I’ve given up completely on electoral politics as a primary vehicle for political change, measures like Prop. K — or Question 1 and Question 2 in Massachusetts, or State Question 2 in Nevada — are a good demonstration of why, if you’re going to put in for electoral politics, voter initiatives and direct votes on referendum questions offer a much better vehicle for doing it than throwing in for the personal political prospects of some favored (or least-worst) candidate for the elective oligarchy that is so fatuously described as our democracy. Proposition K will have a hard time passing — a similar initiative was defeated in Berkeley recently by a 2-to-1 margin — but the mere fact that completely decriminalizing prostitution in a major U.S. city has entered into the political debate, that it is being considered for passage (or. mutatis mutandis, repealing the income tax in one of the highest-tax states in the U.S., or decriminalizing possession of small amounts of marijuana, or banning all eminent domain seizures for transfer to private developers in a state with one of the most intensely state-capitalist economies in the U.S.) is an achievement in itself, compared to the way in which representative politics completely smothers all serious politics, by choking off any and all political issues outside of the established bipartisan government consensus on the acceptable range of debate. Voting libertarians take note: if you’re going to spend your time on this stuff, there’s not much hope for making a difference this way, but there’s some, and that’s better than I can say for personality politics and representative elective oligarchy.

Here’s something I wrote about last year in my article for The Freeman:

Had the city government not made use of its supposed title to the abandoned land [to fence off the lot that the Umoja Village shanty-town had been built on], it no doubt could have made use of state and federal building codes to ensure that residents would be forced back into homelessness—for their own safety, of course. That is in fact what a county health commission in Indiana did to a 93-year-old man named Thelmon Green, who lived in his ’86 Chevrolet van, which the local towing company allowed him to keep on its lot. Many people thrown into poverty by a sudden financial catastrophe live out of a car for weeks or months until they get back on their feet. Living in a car is cramped, but it beats living on the streets: a car means a place you can have to yourself, which holds your possessions, with doors you can lock, and sometimes even air conditioning and heating. But staying in a car over the long term is much harder to manage without running afoul of the law. Thelmon Green got by well enough in his van for ten years, but when the Indianapolis Star printed a human-interest story on him last December, the county health commission took notice and promptly ordered Green evicted from his own van, in the name of the local housing code.

Or, hell, they might not even bother with the regulatory formalities. Sometimes the cops just roll up on you for a welfare check and then take the opportunity to steal your home.

For example, Contia Orsby is a 58 year old black woman, who has spent most of her life helping sick people and, as far as I know, never did any real harm to anybody. She’s originally from Louisiana, and now living in Occupied Portland. She used to work as a geriatric nurse, but three years ago, she hurt her back so bad on the job that she couldn’t work anymore. The hospital gave her $14,000 to live off of for the rest of her life and then pawned her off on the state welfare bureaucracy, because they could, and the state welfare bureaucracy gave her the usual waiting time of forever, because they could. (They stay paid no matter how they act, and where else is she going to go?) When the money ran out, she got some help from her church, and when that ran out, she started living in her car. Which is cramped, and unpleasant, but sometimes safer and easier than trying to find people to put you up, and certainly safer than living on the streets.

Until July 4, 2008, when a pair of Gangsters in Blue decided to roll up on her and search her as part of a welfare check. Here’s how they looked out for her welfare—by stealing her car and throwing her out on the street.

On July 4, Portland Police Bureau Officers Joseph Cook and Judy McFarlane rolled up on Orsby at 2 pm as she was slumped in her car outside an apartment complex on SE 122nd. They searched Orsby and found a pair of brass knuckles in her pocket, which she claimed she was using as a key ring. The officers charged Orsby with having a concealed weapon, driving with a suspended license, and driving without insurance. Instead of taking her to jail, they towed her car, handed her the citations and drove off, leaving her homeless on the street.

All three charges against Orsby were thrown out last Thursday, September 11, after the district attorney’s office declined prosecution.

In real life, outside of statist power-trip La La Land, if you fuck something up that doesn’t belong to you, for no good reason, you pay for it. Normally, if a pair of gang-bangers rolled up you and rousted you out of your car, against your will, when you weren’t doing anything at all to harm a single living soul, sanctimoniously claiming it was for your own good, then searched you, and rifled through your papers, then demanded to know why you were carrying a pair of brass knuckles (as if it mattered—if she were carrying them for her own protection, what’s wrong with that?), then called you a liar and declared your papers insufficient justification for your existence, and then, finally, used all this as an excuse to jack your car and threaten you with a fine you can’t pay or forced confinement in a jail—if they did all this, I say, and they got caught out, those gangsters would be in jail and they would be expected to return the car they’d stolen and pay for what they did out of their own pockets. But because these gang-bangers were Gangsters in Blue, and because they acted with the biggest gangster of all, the State Law-and-Order Protection Racket, at their back, when these charges were dropped, and the whole thing declared a big mistake, Portland Police Bureau Officers Joseph Cook and Judy McFarlane are virtually guaranteed never to suffer a single adverse consequence for their obvious, pointless, and cruel violation of poor people’s property rights. And neither they nor their bosses, the collaborationist puppet government of Occupied Portland, will do anything to make it right, beyond an Oops, our bad; in fact, they feel perfectly happy to force Contia Orsby to pay hundreds of dollars that she doesn’t have, just to recover her own property from the fence they sold it to.

CONTIA ORSBY, 58, stood with the deacon of her church on the lot of Andy’s Towing on SE 82nd last Friday afternoon, September 12. She was there to retrieve her all-white 1988 four-door Cadillac Brougham, bought five years ago for $4,700 from a used car lot up the street, during more fortunate times. It had briefly been her home, until police confiscated the vehicle on Independence Day.

Orsby had already handed over $400 to the towing firm, and $225 to get a release for her vehicle from the courthouse. Still owing $600 more, the manager of the towing company had generously cut her a deal.

He told me if I promised him $200 from my next disability check, I could come and get the car today, she said.

Too bad, because the towing firm had lost the keys: They called a locksmith, and tried to charge Orsby for the cost of cutting some new ones.

We’re doing you a favor, the manager told her. We’re only supposed to keep the car, technically, for 30 days.

Orsby refused to pay for the locksmith, and ultimately, the towing company handed over her car. Her deacon, Albert Woods, from the Emmanuel Church of God in Christ United on NE 30th, had taken the afternoon off to drive Orsby to the towing lot. He shook his head.

They wouldn’t treat her like this if she were the president, that’s for sure, he said.

It’s true, and the management were certainly acting like dicks to her. But why can they get away with that kind of behavior? Simply because, as the fence for the cars stolen by the State, they have no reason to care about making things easy on you, or Contia Orsby, or anybody else. Why should they? They get most or all of their business from people like the President, not from people like you—people who are part of the State, a monopoly outfit which pays for itself through extortion rackets and robbery just like the screwjob they pulled on Contia Orsby, and who use their positions of political power to evade taking any responsibility for their own violations of the liberty and security that their cops and their so-called Law and Order are supposed to protect. Like any other fence, this one doesn’t much care about your life or your livelihood, and he doesn’t much care about helping you recover your stolen property. He serves the racket, not you. Do away with the racket, and you’ll do away with the other petty criminals and hangers-on that take their cuts from the loot.

I’ve said before that urban poverty as we know it is exclusively the creation of the State, and now I’ll add that this is especially true of homelessness as we know it. I don’t mean to claim that in a genuinely free society, with freed people, freed labor, and freed markets, with freedom for the poor and with no political patronage for the rich, that nobody would ever have to scratch by on short money. And I don’t mean that nobody would ever have to live without a house or apartment for a while due to short money. That would be a lot less common if people were free to scratch money together through creative hustling, to lower their fixed costs of living, and to join together for voluntary, neighborhood-based mutual aid, without having to bear the burdens of State-imposed taxes, usury laws, vagrancy laws, prohibition laws, border laws, business license laws, zoning laws, business laws, professional licensing laws, building codes, health and hygiene codes, fines and forfeitures, eminent domain land grabs and politicized development rackets, welfare bureaucrats, social workers and cops, and the rest of the whole taxation-and-regimentation government apparatus that constantly robs, cages, and busybodies poor people, all while sanctimoniously declaring that it’s all For Their Own Good, like one big welfare check on the Contia Orsbys of the world. If people were free of all that, hard times would be a lot less hard, but nobody can realistically promise an end to all tough times or shitty situations, whether by Anarchy or by any other means. Some people might lose their jobs, some people might go hungry, and some people might lose the roof over their heads. But homelessness as we know it — as a long-term, self-reinforcing downward spiral of destitution, in which hard times force people out onto the street, exposed to the elements and to danger from other people, or into overcrowded and dangerous institutional shelters — only exists because the State — the city and state governments, in particular — has a fixed policy of repeatedly sending gangs of thuggish police and busybody case-workers and bureaucratic inspectors around to hassle so-called vagrants; to subject them to constant citations, fines, arrests, and pointless humiliations; to roust them up out of any place that they settle in to stay; to violate their rights to homestead unused land, and to obstruct, invade, trash, or tow away any transitional, intermediate, or otherwise informal sort of shelter that poor people might try to arrange for themselves. It’s one thing not to be able to afford the sorts of houses and apartments and long-term rooming arrangements that journalists and economists and sociologists count as homes for the purposes of statistics and public debate. It’s quite another to be thrown out on the street without any kind of reliable shelter, and we all ought to recognize that as the child of the State. In that sense, all homelessness is forced homelessness, and all homeless people are the internally displaced refugees of the State’s ongoing War on Poverty and campaigns of economic cleansing.

That’s how Contia Orsby got served and protected by Portland cops: by being thrown out of the car that is her home, on the excuse of a bunch of petty so-called crimes with no identifiable victims, having it towed away, and then, months later, when the State magnanimously allowed her to be left the hell alone, by being forced to pay to get it back even though she was never convicted of any crime, victimless or otherwise. If you’re baffled that cops could get away with these kind of outrages, it may help to remember that in a lot of American cities, there just is no such thing as a civil police force. What we have would be better described as thuggish paramilitary units occupying what they regard as hostile territory: like any occupying force, the people they go after the first and the hardest are generally the people who are most vulnerable, and like any other occupying force there is no real recourse for anything they may choose to do on their patrols. Here as elsewhere, they are going to serve and protect us, whether we want them to or not, and if we don’t like it then they’ve got plenty of guns and clubs and cuffs to make sure they can protect the hell out of us all anyway.

These are video segments from a press conference hosted by members of the RNC Welcoming Committee and the Poor People’s Economic Human Rights Campaign. Several police agencies, ramrodded by the Ramsey County Sheriff’s department, staged massive pre-emptive raids against houses where activists were staying and against the RNC Welcoming Committee’s convergence space. Many of the imprisoned protesters continue to be held without charges. Many have been abused by their jailers, including a woman being knocked to the ground and dragged by her hair, several protesters being denied prescription or over-the-counter medications for serious medical conditions, and a 19-year-old activist named Elliot Hughes, who was beaten and tortured for over an hour because, according to the Ramsey County Sheriff’s department, he was being verbally disruptive.

Ramsey County prosecutors have formally charged eight members of the Welcoming Committee with conspiracy to riot in furtherance of terrorism. If convicted, the St. Paul 8 face up to 7 1/2 years in prison. Affadavits filed by police informants who infiltrated the Welcoming Committee allege that members of the group sought to kidnap delegates to the RNC, attack police officers with firebombs and explosives, and sabotage airports in St. Paul. These allegations have not been corroborated by any physical evidence or any other evidence independent of the testimony of police infiltrators. Members of the RNC Welcoming Committee held a press conference together with the Poor People’s Economic Human Rights Campaign in order to respond to these charges and to discuss violence against imprisoned protesters by police and jailers.

Here is what the gangsters in blue do when you mess with their game:

NEW YORK, NEW YORK — A Queens bar owner claims the NYPD is trying to run him out of business because he helped prove his patrons were framed in a fake drug-dealing sting.

Eduardo Espinoza, 36, of Elmhurst, was hit with more than a dozen violations from the 110th Precinct — including two for failing to have liquid soap and paper towels in his bar bathroom — after handing over a videotape suggesting undercover officers made up a buy-and-bust deal in his club in January.

I been harassed so much, I’m selling my business, said Espinoza, owner of Delicias de Mi Tierra on 91st Place in Elmhurst.

Every two to three weeks, there’s cops in here, searching the bar. If there’s no violation, they’ll make it up. I lost all my clients — everybody’s scared to come in my place right now.

Espinoza was working in his bar about 1:40 a.m. on Jan. 5 when undercover officers busted brothers Jose and Maximo Colon and friends Raul Duchimasa and Luis Rodriguez for allegedly peddling $100 worth of cocaine.

Queens prosecutors dropped those charges last week because of Espinoza’s security video showing that the undercover officers had no contact with them in the bar, Colon’s lawyer said.

Prosecutors and the NYPD’s Internal Affairs Bureau are investigating whether to bring charges against the officers. Investigators are also poring over the officers’ prior cases for signs of misconduct, sources said.

An NYPD spokesman said the department would look into the matter. But sources blamed the frequent police visits on community complaints.

Espinoza said he thinks police are retaliating against him because of a strange phone call he received shortly before the harassment began.

A man who identified himself as the officer who made the drug arrest in his club demanded to know if Espinoza had taped the events of that night.

I said I already gave it to the defendants, Espinoza said, He said, Oh s—t. He hung up.

Espinoza, who has owned the bar for 2-1/2 years, said he’d gotten only two summonses before this year.

Most of his summonses have been tossed — including one for having an 8-foot neon sign without a permit, he said.

He’s still fighting a $2,500 fine from the Buildings Department for being overcapacity and a summons for ignoring police orders when he tried to park outside the 110th Precinct stationhouse last month.

I knew they were innocent from the first moment, Espinoza said of the framed men. I felt so bad, I put myself in their shoes. Now [the cops] keep harassing me.

U.S. out of Las Vegas!

One of the things that I said in my speech about ALL to the Libertarian Party of Clark County, which was deliberately provocative and carefully worded, was I am here today to bring you two messages. So let me cut to the chase and deliver both of them right now. They are the point of this entire talk, and I can put them both in ten words or fewer. Here’s the first: Las Vegas will be free soil in our own lifetimes. And the second is: We are all going to make it happen. That may seem ridiculously optimistic, given the immensity, the scope, the pervasiveness, and the ruthlessness of the many-headed monster we call the modern State. I try to discuss a bit in my speech why it is not overly optimistic, focusing on the second claim — that we all, meaning not ALL or the Libertarian Party, but just about everybody in Las Vegas — can and will take part, if those of us who care about these things play our cards right, through the use of populist organizing, coalition building, direct action, and counter-economics.

But another thing that I didn’t focus on much, which I’d like to mention, is the importance of the first thing I said, when I said Las Vegas will be free soil. I said that, and not something else (the U.S. will be free soil; the word will be free soil) because I think that’s an achievable goal. It’s not that I don’t want the whole U.S., or indeed the entire earth to be free soil; it’s not even that I think either couldn’t be free soil in the forseeable future. They could; I hope they will; if I can help, I will. But Las Vegas is where I live, and where Southern Nevada ALL intends to act, and I think it’s immensely important to begin there, and not to sell yourself on the idea that action has to be directed against the largest possible targets, or, more importantly at trying to strike some decisive blow at those targets that will somehow defeat Power everywhere and forever. Real empires almost never fall that way, unless they are conquered by some outside force, usually another rising empire, and for anarchists that’s not an acceptable option. So we need to think about getting the empire to crumble, not to implode, and to help it along by chiseling wherever and as hard as we can. If we win, it will crumble in some places faster than it will crumble in others. The basic problem is that a central aim of the imperial State has always been to get people to forget, effectively, about their neighborhood, their friends, their family, and everything else actually around them, and to understand their homeland in strictly political terms, in terms of a flag and a set of lines on the map and a capital hundreds or thousands of miles away. If anarchists ever want to get anywhere, we’re going to need to break that link, to pry people’s notion of home from out the talons of the State and its notion of political citizenship. I think it does. Is the lobbyist-driven agenda of corporations, special interests, and political culture really any less distant than U.S. foreign policy? Do we have any authentic control over the decisions in our society that affect us? Or are we just treated as fungible units of polity that have only to be deftly mobilized by public relations wizards in pursuit of an agenda fundamentally alien to us? What, in other words, is the difference between our powerlessness within the borders of the U.S. and the powerlessness endured by the residents of Iraq and Afghanistan?

Instead of contrasting our experience under our government with that of its foreign victims, we might do well to compare the experiences. We’ve been taught from a very young age to distinguish American citizenship from that enjoyed by citizens of other countries, chiefly by virtue of our unique institutions of governance. But it is these same institutions that are being built in Iraq: a democratic, constitutional government with corporate control and obedience to international capital, with an established U.S. military presence to ensure stability in the region. These features are proving just as confounding to their freedom as their American counterparts are for us.

Through overwhelming military force, claims of moral privilege, and alleged threats - not unlike the P.R. which allowed the U.S. to conquer the west and the south in the 19th century and frame it as liberation - the U.S. government is imposing a democratic government and a market economy on an unwilling people. Meanwhile, the U.S. government is also continuing to ratchet up the police state at home even as it practices martial law in Iraq. Just as there were Tories and other people loyal to the crown during the American Revolution, the federal government finds plenty of lackeys in the fifty states, Iraq, Afghanistan, and indeed throughout the world to do their dirty military or paramilitary (law enforcement) work. Legislative creep and sheer audacity constantly expand the scope of lawful authority, defining down the degree of liberty an individual can expect to enjoy. Participation in the decisions that affect us is framed as a set of predetermined choices provided by the establishment rather than a direct say at the local level. And all of these features bring more and more of the world under direct control of Washington - both the world within U.S. borders and the world outside them.

For it is into Washington, in the District of Columbia, that all the spoils of these policies flow. The D.C. metro area is among the fastest growing in the nation, despite having no productive civilian industry to speak of (except perhaps I.T., but no more than any other city if you discount government contracting). Not only is it the seat of governance for the country, it is the clearing house for the international policy of most nations. By enticing Americans to “work within the system” to influence policy, citizens legitimate the process by which power and authority are steadily concentrated. An entire lobbying industry has sprung up from the need to have some say in this process; doing business in the empire has a high cost of entry, and once you get a seat at the table it’s plunder or be plundered. As more people see D.C. as the place where decisions are made, rather than local governments or foreign capitals, the amount of money and people pouring into the city will continue to grow, while localities and other countries become bureaucratic appendages of D.C. policy.

But it’s not just that Washingtonians rule over an overseas empire; it’s that domestic U.S. territory is increasingly treated as part of the conquered territory, rather than as the source of state legitimacy. Sure, we have elected representatives we send to D.C. from all over the country, but experience shows that only in the rarest of occasions do they not adopt the Beltway outlook of going along to get along with the system. Instead, they play the game to bring home as much of the spoils of empire (taxation and government contracts for further imperialism) as possible. In the process, they cease to represent their constituents in D.C., preferring to represent the Washingtonian agenda in their respective localities. They become little Paul Brehmers, advocating policies that promote the more effective rule of the domestic and foreign empire. They measure success in terms of how they can coax or coerce the locals into compliance with necessarily foreign interests.

If it is policies in Washington, D.C. that are changing this country into an empire, it is inaccurate to label the empire American. Clearly, the vast majority of Americans are not participating in it, but are merely preferred subjects in territory as occupied as that in Iraq and Afghanistan. […] If the decision-making bureaucracy, military might, and economic clout are all based in Washington, doesn’t it make sense to call this system the Washingtonian empire, rather than conflating it with the disenfranchised subjects in the fifty states? It’s no more an American empire than it is an Iraqi or Afghan one.

The Washingtonian Empire is the largest, richest, most powerful, most hierarchically distributed, and most subtly maintained in history. It is so successful that it has even managed to proceed with its agenda without much notice as to its true nature. We should stop trying to get people to take responsibility for the decisions of a foreign city-state, because this only encourages the conflation of their American identity with an alien one.

By drawing on our revolutionary, anti-colonial legacy, we can frame the American political experience as one of historically consistent subjugation. We can then find common ground with other victims of American imperialism while articulating an authentically decentralist agenda.

Social Memory Complex (2008-06-13): The empire is not American, but Washingtonian

Make sure you read the whole thing, especially Jeremy’s very salient discussion of the impact of this kind of analysis on strategy.

Let me just add that one of the most important dimensions in which to emphasize the nature of America as occupied territories is the connection with the daily lives of the most thoroughly oppressed and exploited people under the bootheels of the United States government and its praetors and proconsuls: especially black people, brown people, poor people, immigrants, people labeled crazy, women (especially the women most marginalized and criminalized by the government and civil society), etc. etc. etc. During the 1960s, the Black Panthers, the Young Lords, and many other New Left liberation groups explicitly linked the conditions and struggles of people in the brutally police-occupied, white-controlled ghettoes of the U.S. — which were founded in slavery, lynch law, apartheid, and immiserating land grabs, which were treated politically as presumptively criminal, unruly elements of the body politic, to be reformed, contained, or eradicated; which were regimented and patrolled on every street corner by the occupying paramilitary forces of the white government — with the conditions and struggles of colonized peoples throughout the so-called Third World, recognizing that just because the lines on the map separated Harlem and Watts from Johannesburg and Nairobi, the people in each had far more in common with each other than any of them had with the handful of white men sitting in the halls of power in D.C., in London, and elsewhere. The false dignity of a morally and practically meaningless imperial citizenship was dismissed; in its place was offered self-understanding for people facing the violence of colonization and solidarity with people rising up against Power in their own homelands throughout the world. In the 1970s, Detroit feminists elaborated the thought by pointing out that, in an important sense, women throughout the world constituted a Fourth World, which faced subjugation and colonization at the hands of petty patriarchs and male States, whether those sites of colonization were located in the capitals of First, Second or Third World regimes. Anarchists can and should learn these lessons well, and take the thoughts to their logical completion, by showing how the State, just as such, always and everywhere, operates as a colonizing force, against all its subjects, and for the profit of the handful of beneficiaries who constitute the ruling class. (Of course, the fact that it operates like this against us all does not mean that it operates this way against all of us to an equal degree. The point here is not cheap sympathy; it’s solidarity, especially with those who are the most trodden upon by this monster State.)

While the legacy of 1776 is worth understanding and learning from, and an important weapon to turn against the power in Washington; but so are many other things, and I think it is vital for the Libertarian Left to take up and learn from this tradition in articulating our anti-imperial theory and practice.

Here is the front page, above-the-fold story from the current issue of the Industrial Worker, on troubling news from Zimbabwe, a rich and fertile country immiserated and stripped by a century of kleptocratic armed factions — first the land-grabbing colonialists, and then an independent white apartheid government, and now a violent anti-colonial, revolutionary government, which has intoned populist slogans in order to justify government patronage to its political supporters, while assaulting all popular movements independent of the government — especially workers’ unions — on the grounds that any movement independent of, or opposed to, the anti-imperial government must therefore be a tool of white imperialism. The government that claims the right to rule Zimbabwe has, through this and other means, made itself into one of the most violently anti-worker governments in the world today.

Zimbabwe [sic] arrests unionists, opposition

Zimbabwe’s ruling party and paramilitaries are conducting a terror campaign of arrests and captive meetings of opposition supporters before the presidential run-off election on June 27.

Police arrested the union president Lovemore Motombo and general secretary Wellington Chibebe of the Zimbabwe Congress of Trade Unions (ZCTU) on May 8. Police charged them with inciting people to rise against the government and reporting falsehoods about people being killed during a May Day rally.

The General Agriculture and Plantation Workers Union of Zimbabwe has said that 40,000 farm workers are affected by the current terror campaign that has led to violence and eviction from their workplaces.

Teachers in rural classrooms are among those being targetted as MDC supporters. Two have been killed to date, with a third abducted by Zanu-PF paramilitaries. The teachers’ union has received reports that the Zanu-PF are chasing teachers out of schools, beating them, and demanding repentance fines in the form of cash, goats, and cattle, according to IRIN, a United Nations news service report. The situation in the schools resembles war zones, and there is no way teachers can report for work to face those death squads, Raymond Majongwe, president of the Progressive Teachers Union of Zimbabwe, told IRIN.

Our fear is that more could be under torture, or have been killed, said Majongwe.

The MDC has placed the death toll since the March 29 election at 43 people, with hundreds beaten and more than 5,000 people fleeing to the mountains and elsewhere to escape Zanu-PF militias.

People who have tried to file complaints to the police are, in turn, detained and interrogated, said the MDC, which means few people are coming forward.

On April 25, armed police raided the opposition Movement for Democratic Change (MDC) headquarters in Harare and arrested more than 300 men, women and children who had taken refuge there from political violence.

National and international unions have condemned the Zanu-PF for the violence against union members and party activists.

Dockworkers affiliated with the Congress of South African Trade Unions in South Africa and dockworkers in Mozambique refused to unload a ship loaded with AK-47 machine gun bullets, mortars and rocket-propelled grenades sold by China to Zimbabwe. The ship returned to China without unloading its cargo.

In a speech to the Zanu-PF’s Central Committee on May 16, Zimbabwean President Robert Mugabe said Zimbabwean democracy was stronger than ever and blamed the opposition Movement for Democratic Change (MDC) for inciting rural violence to benefit Western political and corporate interests.

Such violence is needless and must stop forthwith. Our fist is against white imperialism; it is a fist for the people of Zimbabwe, never a fist against them.

The same day, MDC leader Morgan Tsvangirai delayed his return to Zimbabwe, saying that his party alleged that the military planned to kill him and at least 36 other opposition leaders.

Tsvangirai had been lobbying neighbouring countries and the United Nations to pressure Mugabe to release and accept the election results.

While the MDC refers to Tsvangirai as the President on its web site, it has agreed to contest the presidential run-off in a bid to avoid violence such as that seen in Kenya after its election.

Despite the violence, MDC activists are gearing up for the presidential election campaign. The MDC said that 20,000 activists attended a rally in Harare.

The people are very clear on what they want. They want change. The dictatorship is dead and on 27 June we must attend its burial, said MDC parliamentarian Nelson Chamisa.

The Industrial Worker 105.04 (June 2008): Zimbabwe arrests unionists, opposition

It’s hard to know what to do in the face of this kind of violence, especially when it is so far away. There may not be much that American workers really can do other than bear witness and hope. But I do want to call special attention to the vital importance of actions like those of the dockworkers in South Africa and Mozambique — an inspiring example both of direct action on the shop floor, and also international labor solidarity. In the end, the actions of workers both in Zimbabwe and in international solidarity campaigns will matter far more than even the fairest, most transparent, most open elections ever will or ever could. What is needed is more — not just inspiring examples, but a coordinated campaign of industrial action against the entire coercive apparatus of Zanu-PF and the Zimbabwean state, to choke off their capacity to attack and terrorize workers.

What Mugabe and his apparatchiks are doing to workers in Zimbabwe is abominable, but we must never forget that the workers have more power standing with our hands in our pockets than all the combined wealth and weapons of the bosses — whether economic, social, or political.

You talk of simplification. But if you can simplify in one point, you can simplify in all. Instead of a million laws, a single law will suffice. What shall this law be? Do not to others what you would not they should do to you: do to others as you would they should do to you. That is the law and the prophets.

But it is evident that this is not a law; it is the elementary formula of justice, the rule of all transactions. Legislative simplification then leads us to the idea of contract, and consequently to the denial of authority. In fact, if there is but a single law, if it solves all the contradictions of society, if it is admitted and acceptedby everybody, it is sufficient for the social contract. In promulgating it you announce the end of government. What prevents you then from making this simplification at once?

There are a couple of different kinds of malign spontaneous orders that need to be differentiated here.

The first are malign undesigned orders that emerge, in part, from diffuse forms of violence — what I called “invisible fist” processes, as with the socio-cultural ripple effects of stranger-rape and other prevalent forms of violence against women.

The second are malign orders that don’t emerge from diffuse forms of violence, but rather from voluntary interactions. Unlike some libertarians, I believe that there are plenty of examples of these, too (for example, certain kinds of widespread credentialism and elitism that have emerged over the past century, and which have a big effect on education and on the workplace). These malign undesigned orders are often intimately connected with social orders that have coercive elements (for example, I’d say that certain pernicious forms of credentialism and managerialism, which contribute to classism and to the exploitation of working folks, have an awful lot to do with consistent government intervention on behalf of the managerial class and against the deskilled proletariat over the past century — cf. for examples my essay Scratching By at http://www.fee.org/publications/the-freeman/article.asp?aid=8204 or Kevin Carson’s Mutualist Blog at http://mutualist.blogspot.com/) — but, while intimately connected, are not identical with them (it’s likely that even without that government intervention they might live on through institutionalized cultural prejudices, unless deliberately confronted and undermined).

Libertarians and anarchists can consistently endorse the use of physical force as part of the response to the former (violent) sort of undesigned order; they can’t consistently endorse the use of physical force as part of the response to the latter (non-violent, but still ugly) sort of undesigned order.

In the second case, though, I ought to stress that not abandoning the use of force doesn’t mean abandoning the use of confrontation or hardball tactics—they just have to be carried out through tactics and institutions outside the political arena, the legal arena, or the regulatory bureaucracy. (On what should be done instead, I’m really an old Leftist at heart: I think people should form fighting unions and community organizations, build counter-institutions and mutual aid societies, use targeted and general strikes, boycotts, work-to-rule, hardball forms of social ostracism, stage sit-ins, etc. etc. etc. Forget about the government; we can do this ourselves.)

In the first case, the use of countervailing physical force in defense of self or others is defense, not aggression, so it need not offend any libertarian or anarchist sensibilities (unless one is a principled pacifist—which I’m not, and which most libertarians and anarchists aren’t either). You worry that that force will need some agreed on norms of justice and enforcement. I’m inclined to agree with that (although we might disagree on what the importance of agreement is here). But supposing that we do agree, I don’t think it tells against Jim’s point. Agreed-upon norms of justice and enforcement aren’t in and of themselves a problem for anarchism or libertarianism. The question is how the agreement on those norms is brought about: whether the agreement comes about by general acquiescence to privileged demands, or whether it comes about by means of a broad consensus among equals.

Government ensures agreement upon these norms by erecting privileged institutions which are legally empowered to force everyone else to acquiesce to the norms they propound and act on.

Anarchy, on the other hand, doesn’t mean chaos or the break-up of any agreed-upon norms of justice or enforcement. (At least, that’s not what anarchy means in the mouths of anarchists who use the term.) What it does mean is that any agreement upon those norms should be brought about through the free interactions among equals and by the emergence of a broad social consensus.

Further, anarchists generally believe that that kind of consensus can rightfully be acted on by any free association that puts reasonable norms for justice and enforcement into practice — rather than being limited to a privileged class of government-approved cops, judges, etc. The idea here being that the justice of judgments and the righteousness of enforcement are things that ought to be assessed on the merits of the conduct itself, not according to the identity or the political status of the judge or the enforcer. That is to say, that it should be considered as a matter to be resolved by appeals to the content of the norms, rather than to the political status and prerogatives of the body propounding them.

So the ideal here is not to abolish any general norms of justice or enforcement, but rather to keep the ideal of consensus on norms while detaching the crafting of the consensus from the imposition of exclusive government-granted prerogatives.

Thomas replied with some comments on professionalization and specialization in the law, which are the main thing that I want to focus on today. In part because the issue is interesting and important in itself; in part also because the way that police forces and the legal system operate today is, in many different ways, ideologically dependent on the idea that we need to turn a great deal of our lives and freedom over to a cadre of trained, specialized legal professionals for our own protection and in order to ensure justice and social peace. He wrote:

By way of reply, I argued that the need for specialized expertise and training (1) isn’t an argument for monopoly, and also (2) is itself a function of the expansiveness and authoritarianism of the State:

Probably so, although I’m inclined to think that there is, or ought to be, much LESS specialization and craft than the professionalized government enforcers and judges would have you believe. To be sure, the government laws that are on the books today are tremendously complicated and require years of specialized training and practice to even begin to get a good grip on a relatively small specialty. But I think that that’s precisely because the people who make and use the laws have a political and a professional interest in making those laws extremely complicated, and in having them cover an extremely wide and not very well defined scope of human affairs. Libertarians and anarchists believe that regularized enforcement should cover a much more precisely delimited and a much, much smaller field than it currently does, so to some extent the problem vanishes along with the laws that libertarians and anarchists believe ought to be abolished.

For example, labor relations law as it presently exists is extremely complicated — it requires making a lot of very fine distinctions, balancing many different prerogatives granted to and regulatory limitations imposed upon unions, individual employees, and employers, etc. etc. etc. It takes a lot to even understand the basics of the situation, and the tricky details of a concrete case often can’t even be resolved without hashing out the issues in bureaucratic negotiations through the NLRB or in federal court. But the complexity of the legal situation is clearly a function of its being channeled through the federal regulatory bureaucracy. That situation clearly benefits NLRB bureaucrats and professional labor lawyers; it’s much less clear that it benefits the rank-and-file workers for whose benefit this sort of thing was supposedly constructed, but who are substantially deprived of any real control over the process by putting so much of it into the hands of professional legal experts. If agreed-upon norms of justice and enforcement were (as anarchists believe that they should be) limited only to the issue of protecting innocent people from being attacked by physical force, or vindicating their rights after the fact if they should be attacked — with all the rest to be handled by free contracts between the individual parties, unregimented by a government bureaucracy, and by whatever forms of nonviolent leverage and activism that the creativity of organized workers and a fighting union might devise — then it’s much less clear what need for specialization or professionalization there would be. (There might still be a lot of need for impartial arbitrators; but impartiality is distinct from technical expertise, and is something you can get by finding any third party of good will and good sense for the duration of the arbitration; it doesn’t require a distinct class of professional arbitrators.)

Generalizing from that case, I agree with Lysander Spooner that if the realm of enforcement were strictly limited to questions of interpersonal justice, then, quote:

No objection can be made to these voluntary associations upon the ground that they would lack that knowledge of justice, as a science, which would be necessary to enable them to maintain justice, and themselves avoid doing injustice. Honesty, justice, natural law, is usually a very plain and simple matter, easily understood by common minds. Those who desire to know what it is, in any particular case, seldom have to go far to find it. It is true, it must be learned, like any other science. But it is also true that it is very easily learned. Although as illimitable in its applications as the infinite relations and dealings of men with each other, it is, nevertheless, made up of a few simple elementary principles, of the truth and justice of which every ordinary mind has an almost intuitive perception. And almost all men have the same perceptions of what constitutes justice, or of what justice requires, when they understand alike the facts from which their inferences are to be drawn.

And I would follow up your second point by urging that it is dangerous, and to some degree irresponsible, to adopt large-scale systems of law and practice that practically require ordinary citizens to abandon the questions of political and interpersonal justice to a privileged, insular, and easily corrupted class of specialists.

But, secondly, I would also argue, further, that even if the requirements of justice ARE complicated enough in some particular case that it requires some specialized training and expertise to sort them out, or where correctly applying and implementing them requires specialized training and expertise in something else (e.g., for enforcers, training and expertise in de-escalating potentially violent situations may be a form of specialization well worth having), that seems to me like an argument for leaving the field open to many specialists, who can offer their services to anyone who is interested in retaining them (e.g. many private associations for arbitration and/or defense, which people go to on the basis of choice rather than being forced to go to one in particular on the basis of fixed territorial monopolies). Not so much an argument for limiting the field to a single fixed, institutionalized class of specialists (e.g. a government court or a government police force with rigidly and exclusively defined territorial or topical jurisdictions).

The first (non-monopolistic) solution really would make the business of law a skilled trade or profession, much like watchmaking or medicine, where people go to acknowledged experts freely, but aren’t forced to choose one particular expert on the basis of political status, and can choose another, on the basis of their own considered judgment and comfort levels, or for that matter can still choose none at all, if they decide to hazard the risks and trouble of doing it for themselves.

The second, monopolistic solution doesn’t make the business of law so much like skilled trades and professions, but rather like a feudal or command economy, in which people are assigned particular experts and forced to turn matters over to that particular expert rather than another, on the basis of the political status of the experts rather than on the basis of broadly and consensually acknowledged expertise. It’s that which, as an anarchist, I really object to.

Rad Geek (2008-06-02): Comments on Worth reading

In reply, Thomas raised some fairly common counter-objections and worries, especially about the dangers supposedly posed by the devolution of policing from public control to private defense — or, to spin it another way, from government to civil society.

But the complexity of the legal situation is clearly a function of its being channeled through the federal regulatory bureaucracy. That situation clearly benefits NLRB bureaucrats and professional labor lawyers; it’s much less clear that it benefits the rank-and-file workers for whose benefit this sort of thing was supposedly constructed, but who are substantially deprived of any real control over the process by putting so much of it into the hands of professional legal experts.

This seems like blaming the chickens for the fox’s raid on the chicken coop. At least lately, the situation you refer to clearly benefits management in most NLRB disputes. I’d put down most of what’s wrong with NLRB to its being an easily subverted agency, most of the blame for that to corporations achieving via the back door of a compliant board what they couldn’t via the statutes authorizing the NRLB in the first place … and most of what’s wrong with those statutes to earlier corporate influence in making things like unionization far too difficult in the first place. Rightly administered and empowered, NLRB ought to be a counterweight to moneyed and propertied interests that have no interest in worker’s rights. The fact that it isn’t rightly administered and empowered seems to me a measure of the strength of the forces arrayed against it, not of the weakness of the idea of an NLRB itself.

The first (non-monopolistic) solution really would make the business of law a skilled trade or profession, much like watchmaking or medicine, where people go to acknowledged experts freely, but aren’t forced to choose one particular expert on the basis of political status, and can choose another, on the basis of their own considered judgment and comfort levels, or for that matter can still choose none at all, if they decide to hazard the risks and trouble of doing it for themselves.

At least for legal representation, that — in theory — is already the case, isn’t it? The problem is when the innocent can’t afford a Clarence Darrow, a Johnny Cochrane, or an F Lee Bailey to get them off but the guilty can.

I don’t see how to bid out for police functions, though, without that turning into yet another part of society baldly favoring the rich and privileged over the poor and disenfranchised. While that may be too much the case even with a police force as public monopoly, I think it would surely be worse in a “Deadwood“-type services-to-the-highest-bidder world. But maybe I’m misunderstanding you in how police functions ideally ought to work.

To which I made some counter-counter-objections, and raised what I think ought to be some obvious questions:

I’m not sure what you mean. I don’t blame rank-and-file workers for the way the NLRB functions. I blame the politicos, the “Progressive” bosses, and the conservative union bosses who pushed to create the system. (Radical unions, like the I.W.W., rightly opposed the system as an effort to promote conservative unionism and to capture and domesticate unions through a combination of government patronage and government regulation.)

Two things.

First, I have no confidence in anyone’s ability to craft a regulatory agency that successfully resists being substantially captured by the interests that it regulates. I can’t think of any example in the history of American regulatory bodies where this has been pulled off for any length of time, and I don’t think it should be particularly surprising that, since political entities respond to political incentives, they will tend to be administered in a way that systematically benefits the wealthiest and most politically-connected people.

Second, even if the NLRB were ideally administered, the system is designed from the ground up as a means of constraining union demands and restricting unions to the most conservative and least effectual methods. (Thus, the Taft-Hartley bans on secondary strikes, secondary boycotts, union hiring halls, wildcat strikes, etc. etc. etc.; thus the emphasis on a heavily regulated process of collective bargaining, controlled by very elaborate legal requirements that are often next to impossible for rank-and-file workers to understand, in place of extremely effective and very simple to understand tactics, like work-to-rule and other forms of direct action in the workplace.)

Well, not entirely — you can choose one lawyer rather than another, as long as you can afford their fees, but you can’t choose anyone as your advocate except those who have been officially approved for membership in the government-created and government-regulated lawyer’s guild. But lawyers weren’t the “experts” I was referring to; I was referring to the fact that the government forces people to take legal disputes before specific judges (with jurisdiction fixed by the issue in dispute and by accidents of geography), and excludes other no-less qualified and impartial experts from taking up the dispute simply because the privileged judge has a particular political status and the other would-be arbitrator doesn’t. If we are really talking about a form of specialized expertise here, like that of the watchmaker or of the doctor, then anyone should be able to take the case, not just a judge deemed to have that topic and that location within his bailiwick by the government.

Well, I don’t know. Isn’t that already how government policing works?

Tax funding doesn’t prevent government cops from treating poor people pretty shitty, or from acting as an instrument of class power. In fact, the fact that poor neighborhoods have no real control over who provides policing in their neighborhoods, and no way of cutting off their portion of the funding for neglectful or abusive police forces, is part and parcel of the problem.

Anyway, I’m not sure what you mean by bid out for police functions. If you mean the government outsourcing policing to private security corporations (Wackenhut, Blackwater, whatever), I’m not for that, and I don’t consider it an example of free market self-defense. I think that all government involvement in policing (whether in-sourced or out-sourced) should be abolished.

If you mean individual people choosing to cover the costs of policing, and having a choice about who, if anyone, they get police services from, then I don’t think there’s any guarantee that the result will be (even more) plutocratic policing. It’s true that, if all policing were based on free association and not on government monopoly, there might well be some policing that is done by private goon squads for hire, and those might have an incentive to favor the rich over the poor. But (1) again, I’m not convinced that they’d have more of an incentive to do so than government cops already have; and (2) there are lots of other ways of using free association to get self-defense and neighborhood defense done. For example, the Black Panthers and the Young Lords organized historically oppressed people to arm themselves, and to patrol and defend their own neighborhoods (including defending them from the predation of abusive white cops). In any case, where there are many, competing and countervailing associations that serve defensive functions, if one association becomes especially neglectful, or, worse, predatory, against marginalized people, other associations can move in to compete, or new associations can be formed, to check the first. But when policing is monopolized by a single institution, there is no real reason for them to try to please anybody outside of their firmest base of support (in the case of political monopolies, that means the ruling class—as is confirmed by how police departments already operate today). If they don’t please marginalized people, why would they care? They stay paid anyway, and there’s no countervailing force to hold them to account for their abusiveness.

My own view is that the need for any form of professional policing at all would be dramatically less in a free society than it is in the present day. (For example, in a free society there would be no drug laws, vice laws, or border laws, and thus no narcs, no vice cops, and no La Migra. There would also be much less entrenched urban poverty, because — for reasons I discuss in the Freeman article — ghettoized urban poverty as we know it is largely a function of interlocking government interventions against poor people’s survival strategies and attemtps to flourish through creative hustling; hence much less economically motivated crime, and also much less of certain kinds of antisocial behavior. So, again, this is, to a great extent, a problem that vanishes along with the needless government laws and endless government “wars” on consensual behavior, which I already favor abolishing. But, even if the demand for specialized policing were to remain just as high as it is today, I still think that it is far, far better to have a situation in which people are free to withdraw their support from abusive agencies, and where there are many acknowledged experts to keep each other in check, than a situation in which people are forced to pay for their own abuse, and in which cops are never held to account for wrongdoing by any means other than “handling it internally” and issuing the occasional “Oops, our bad”.

It’s a fairly wide-ranging discussion, and you ought to read the whole thing if you want to follow up on some of the sub-threads about, for example, organizing, class, tactics, immigration, and so on. For now, I want to highlight the discussion about specialization and professionalization in policing. On that note, I want to stress that it’s precisely those ideals in lawyering and law enforcement that lead directly to things like this, and this, and this. And, less directly but very quickly, gets us from those to this and this. And that from there it doesn’t take a very slippery slope to get down to this and this and this.

And the perceived need for specialization, professionalization, and expertise is a need which only exists because of the very system of law and enforcement it is invoked to justify. On a related note, consider this video (thanks to Jeremy at Social Memory Complex 2008-06-04: Don’t talk to the police), which provides both excellent legal advice, from the standpoint of simple self-interest, and some solid analysis of our present predicament how ordinary folks like you and me ought to relate to government cops under these conditions.

Without that system, without its politically-fabricated complexity, and without the tremendous latitude deliberately created by that complexity for government police to exercise arbitrary power in stopping, detaining, fining, and arresting suspect people — the 10,000 or more crimes that government law has fabricated, the crimes so numerous that not even the government itself can count them all anymore, and so potentially ruinous for anyone in trouble with the law that you have little choice but to regard anyone threatening to exercise their specialization and craft in the law as little more than a dangerous soldier in a hostile, occupying force — without all that, I say, there would be no basis, no need, and no call for that complexity or that arbitrary authority, or for the privileged, professionalized retinue of lawyers and enforcers who are expected today to go around navigating that complexity and exercising that arbitrary authority, in order to solve the very problems that the same complexity and arbitrary authority created in the first place.

So, there’s this poster that’s been circulating around anarchist, civil libertarian, and lefty blogs for a few months now. It’s become popular because it’s funny (in a nerdy way), and also because it makes an important point:

But, well, the awful truth is that, as with so many other things in American politics, the answer to that rhetorical question can’t really be taken for granted, because it really depends on what kind of neighborhood you live in. The poster makes an important point addressed to, and about the daily lives of, people of a particular socioeconomic class (specifically, the people who most often spend their time reading blogs). For many if not most people in other social classes, the answer really is just, You bet it will. Or, It already is. Has been for decades. Where you been?

For example, consider the cops plans for improving neighborhood safety in the D.C. Ghetto. No, I’m not using that last word as a careless synonym for slum. I am using it in the most literal sense.


D.C. police will seal off entire neighborhoods, set up checkpoints and kick out strangers under a new program that D.C. officials hope will help them rescue the city from its out-of-control violence.

Under an executive order expected to be announced today, police Chief Cathy L. Lanier will have the authority to designate Neighborhood Safety Zones. At least six officers will man cordons around those zones and demand identification from people coming in and out of them. Anyone who doesn’t live there, work there or have legitimate reason to be there will be sent away or face arrest, documents obtained by The Examiner show.

Guess who decides what counts as a legitimate reason for being in the neighborhood — the people who live and work in that neighborhood, or the government’s goon squad?

Lanier has been struggling to reverse D.C.’s spiraling crime rate but has been forced by public outcry to scale back several initiatives including her All Hands on Deck weekends and plans for warrantless, door-to-door searches for drugs and guns.

Under today’s proposal, the no-go zones will last up to 10 days, according to internal police documents. Front-line officers are already being signed up for training on running the blue curtains.

Peter Nickles, the city’s interim attorney general, said the quarantine would have a narrow focus.

This is a very targeted program that has been used in other cities, Nickles told The Examiner. I’m not worried about the constitutionality of it.

Just so we’re clear, neither am I. I couldn’t possibly care less whether surrounding poor neighborhoods with cops, giving everyone the Ihre Papiere, bitte treatment, and chopping a community up into police-occupied strategic hamlets for the purpose of a government quarantine without any probable cause whatsoever for believing that any of the individual people you will be surrounding, stopping, hassling, and threatening with jail have ever committed any crime against any identifiable victim, is or is not countenanced by the United States Constitution. Who cares? The basic problem with terrorizing and brutalizing entire neighborhoods is that it is evil and incredibly dangerous, whether or not the Constitution allows for it.

Others are. Kristopher Baumann, chairman of the D.C. police union and a former lawyer, called the checkpoint proposal breathtaking.

Shelley Broderick, president of the D.C.-area American Civil Liberties Union and the dean of the University of the District of Columbia’s law school, said the plan was cockamamie.

I think they tried this in Russia and it failed, she said. It’s just our experience in this city that we always end up targeting poor people and people of color, and we treat the kids coming home from choir practice the same as we treat those kids who are selling drugs.

The proposal has the provisional support of D.C. Councilman Harry Tommy Thomas, D-Ward 5, whose ward has become a war zone.

They’re really going to crack down on what we believe to be a systemic problem with open-air drug markets, Thomas told The Examiner.

Thomas said, though, that he worried about D.C. moving towards a police state.

But what the hell did D.C. Councilman Harry Tommy Thomas expect, anyway? You can’t go around pushing your paramilitary crack downs with rhetoric about war zones and then act all surprised when you get a police state. If you plan for an occupation, you can expect that you are going to get lock-downs and de facto martial law.

Last week, I received the following email:

I live in Eckington, a transitional neighborhood in northeast DC. I got a knock on the door this morning from a guy with ACORN (looks like a lefty community group that I’d never heard of) saying that DC police would be coming around shortly asking to search homes in the neighborhood for guns, and explaining we had the constitutional right to refuse, etc. He added that anything the police find they can use against you because you never know what a friend of a friend might have left in your house Not sure if he told me this because I had just gotten out of bed and had answered the door in my bathrobe looking disoriented, but I digress. He was handing out a packet of info from the ACLU including a nifty doorhanger you can put out that says NO CONSENT TO SEARCH OUR HOME. One of my neighbors told me the guy told them they were only doing this in poor black neighborhoods, and this notice from the ACLU that I found online seems to bear this out.

I know it’s not exactly a wrong-door no-knock raid, but I am concerned because while I certainly don’t want the police (or any other strangers) rummaging through my junk, I’m kind of afraid of what would happen if I refuse the search. I already live on one of those streets with the surveillance cams installed. Does my address get marked for being uncooperative or suspicious? I should mention of course that I don’t own any guns and have never touched anything more powerful than a bb gun.

You are free to refuse the searches. But if a regular reader of this site feels uncomfortable asserting that right, you can imagine how other people subject to these searches might feel.

The primary reason that you should oppose government immigration laws is that the system of international apartheid is based on morally despicable premises, and necessarily involves massive State violence against peaceful people. Immigration laws involve the State in discrimination against, and violation of the basic human rights of, peaceful immigrants. But that’s not all that they do. And if you understand the stupidity and the evil of immigration laws, but don’t yet feel that you personally have a reason to stick your own neck out to actively oppose them, maybe this will help change your mind.

FLORENCE, Ariz. — Thomas Warziniack was born in Minnesota and grew up in Georgia, but immigration authorities pronounced him an illegal immigrant from Russia.

Immigration and Customs Enforcement has held Warziniack for weeks in an Arizona detention facility with the aim of deporting him to a country he’s never seen. His jailers shrugged off Warziniack’s claims that he was an American citizen, even though they could have retrieved his Minnesota birth certificate in minutes and even though a Colorado court had concluded that he was a U.S. citizen a year before it shipped him to Arizona.
