Derrick J Freeman was assaulted by Fintan Moore.

Derrick’s slated to be “arraigned” on Monday, April 2nd, 2012 at Keene District Court. He’s threatened with “resisting” and “violations of bail.”

Ask yourself:

Are Keene police department employees so inept, so bureaucratic, that it wasn’t yet in their database and therefore Fintan acted on stale information? There was simply no reason for the contact.
  • Was the amount of force Fintan Moore used necessary? Even if Fintan was “correct” in “serving” Derrick, is there anything justifiable about the escalation of force Fintan employed? Not too long ago similar tactics ended in the death of the bicyclist. What if that would have happened to Derrick? Would Fintan still stand by his actions?
  • What about the integrity (or lack thereof) exhibited by Timothy Peloquin,who “served” Derrick at the high school an hour or so before the incident with Moore, who had this exchange (fast-forward about half-way through clip):

Dispatcher: I don’t know if it matters or not at this point but there was some specific hours of 6:30 to 6:30 Monday through Friday. I don’t know if that makes a difference for you or not.
Peloquin: Doesn’t make a difference anymore. It says all the property all the time.
Dispatcher: Perfect. Thank you.

  • Instead of asking that ‘no trespassing order’ at the station be brought to the location, Peloquin drafted one in his cruiser, but instead of creating an accurate copy he further restrict Derrick’s “legal” rights. And his colleagues thought it was “perfect.” Do those with badges have the “right” to create and enforce “law” at their whim?
  • Even if Derrick had yet to be served, couldn’t Moore have waited for Derrick at his residence? That would still achieve the same ends, but with a safer means.

Derrick engaged in the dastardly act of singing anti-prohibition songs at state-run liquor stores. The consequence – after being “served” he was supposedly banned from such locations. Derrick’s completely peaceful action (singing) caused Moore and others to believe they had the right to initiate force against him. To drove his car toward Derrick’s bicycle. To place his asp in Derrick’s spokes. To punch Derrick. Just who is the aggressor?
  • And Moore (or at least his boss) believe they should have access and the use of an armored personnel vehicle?!

Will Moore do the right thing and apologize? While there be any repercussions for his actions? What might help mitigate such incidents from even occurring?

I have a feature-length piece up at Huffington Post looking at the myriad issues to spill out of the Collinsville, Illinois traffic stop of two Star Trek fans last December. It delves into asset forfeiture, the effectiveness of drug dogs, and how difficult it is to get rid of a bad cop.

I also wrote an accompanying sidebar in which I examined the data of one Illinois State Police K9 unit over an 11-month period in 2007 and 2008. The dog had a false alert rate of 28 percent. It rose to 74 percent if you include cases where it alerted to drugs, but police could only find “residue” or “shake.” (Which of course wouldn’t have been tested for verification.)

I suggested “Set Phasers To Violate” for the main article’s headline.

Alas, I was overruled.

Dramatic Video of Derrick J. Being Knocked off His Bike by Keene Law Enforcement

Various individuals on Facebook are encouraging people to call the Keene PD (603) 357-9815 and demand the release of Derrick J. Freeman “who was just violently arrested and assaulted by Officer Finton Moore outside the KAC for no reason.” according to Clyde Voluntaryist.

Cecelia Freechild reports from LadiesinKeene.com:

Today, my dear friend Derrick J. Freeman was attacked and beaten by Officer Moore of KPD. Derrick was riding his bike when Moore came up behind him in a cruiser. Moore flipped his lights on, then proceeded to remove Derrick from his bike by hitting Derrick with the cruiser door. Moore then got out of the cruiser & stuck his night stick in between Derrick’s spokes. Flipping Derrick and his bike over, breaking several of the spokes on his tire.

Moore then tackled Derrick, and from the video being uploaded is seen hitting Derrick. Myself, and at least 10 other activists, came to the scene to see Moore on top of Derrick, pushing him into the ground. I witnessed Moore shove Derrick’s head into the ground when Derrick tried to adjust his sunglasses.

Moore was apparently trying to serve Derrick with no trespass papers for all of Keene School District, which he was already served with this morning, about 2-3 hours before this incident. Moore refused to answer activists as to why he was kidnapping Derrick.

I’ll be following this story along with other concerned members of the community. Expect more about officer Moore.

Trayvon Martin Killed for Brown Skin, Zimmerman Released for White Skin

Some thoughts about the Trayvon Martin case:

The issue in Trayvon's case is not "race" but skin color.  The killer's face is white.  The victim's face is Black.  That's what matters.

If Zimmerman's name had been "Sanchez" and he had had brown skin, Zimmerman would probably have been arrested and called "a member of an armed and dangerous neighborhood gang called the Neighborhood Watch." 

The reason it doesn't matter that Zimmerman is somewhat Hispanic is that Zimmerman's face is white and it is SKIN COLOR and not some amorphous and undefinable "race" that reigns supreme in America.  Let's not let fancy "racial" concepts distract us from the crucial obvious: the difference between white and brown skin.

Zimmerman should be arrested, charged and convicted because his story of having his head slammed against the pavement and of being repeatedly punched is proved false by the utter absence of bruises and his utterly relaxes demeanor and gait in the video of him entering the police station.  The mere fact that Zimmerman clearly lied about the circumstances of the shooting potentially disprove his self-defense claim, in the opinion of a reasonable juror.

After the terrible beating that Zimmerman says he suffered, why did he not request medical treatment or seek medical treatment after he was released? 

A blogger friend says evidence is coming forth to show that the police were part of an at least metaphorical corruption of justice, by intentionally disregarding facts and issues such as the above, while repressing evidence of Zimmerman's guilt.  As such, the investigation should go beyond Zimmerman to all those who sought to absolve him of guilt in an arguably clearly criminal killing. 

That would include perhaps least some of the police who responded and wrote false, misleading or incomplete reports; the police chief (who still has his job, although not in active status); the acting police chief who could order an arrest on the information being developed, the mayor and the prosecutor.  All of these parties and more have played some role in obvious lies being accepted as a defense in a murder case, because the murderer is white and the victim had brown skin and a hoodie.

The US Justice Department of the Zimmerman case must include an investigation of all those who failed to investigate, arrest, charge and prosecute Zimmerman, apparently because Zimmerman has white skin and his victim had brown skin.

I couldn't have summarized the issue more concisely than one Black blogger and civil rights activist has, as regards the Zimmerman color-aroused animosity reality:


...what was the basis of Zimmerman's suspicion? A young black man in a hoodie. What was the reason for no arrest? A young black man in a hoodie.

And, as that bloggers says, although Americans purportedly have a Second Amendment right to keep and bear arms, Blacks are regularly shot dead simply because "I thought he had a gun."  If you can be shot dead for suspicion of being armed, then you clearly have no effective right to be armed.

Zimmerman is white, so he has a de facto right in America to ride around with a nine millimeter pistol and follow Black people whose presence in "his" neighborhood he deems undesirable.  He has a right, if his impunity stands, to shoot a Black man who posed no threat beyond a conceivable threat that Zimmerman sought out by zealously pursuing another person, a stranger, in the dark.

Anyone who relentlessly pursues a stranger in the dark, without announcing any reason for doing so, should feel afraid of the repercussions.  

Yet, white people are carefully taught in American society to fear Black people, particularly Black men, regardless of where we are or how we are dressed.  If whites can shoot us whenever they fear us, then they can shoot us whenever they see us, and they can seek us out to shoot us for fear of what we might do unless they seek us out, as Zimmerman claims he did. 

They can hunt us down and kill us in "self-defense" and "defense of another," even if they simply wake up in the morning with a generalized fear of Black people and decide to respond to that fear by seeking out and confronting Black people to see if their generalized fear becomes a fear of someone specific.

Judy Sanchez says she heard someone pounding on the door of her Fitchburg, Massachusetts, apartment, and almost immediately after that someone started cutting through the door with a chainsaw. Several armed people rushed through the door forcing her and her family to the floor. It was a team of FBI agents who figured out about a half hour later they were supposed to raid the apartment next door.

Recently I posted a video of Occupy Wall Street Protestors using string and a donut to do some Cop Fishing. It seems one of CopBlock.org’s YouTube subscribers was displeased with that video. A1nitak has done two video critiques of CopBlock (both are displayed below) and I want to say that I appreciate the feedback, especially A1nitak’s, who took the time to make a video.

I would like to clarify a few things for those visiting CopBlock.org and A1nitak. CopBlock.org is decentralized. Not every video on the YouTube channel was taken by Pete or myself – as Pete and I are not “CopBlock.” We are two individuals who use CopBlock.org to share OUR own personal views on policing issues today – with our content, yet I’ve posted things I wouldn’t have made or done, as educational. When someone says ‘they’ or ‘CopBlock’ they’re talking about a website/network that shares police related content. The “goal” of CopBlock.org is to be a hub, to create a conversation, for police issues.

Lastly, if there is a person, post or video you disagree with we more than encourage you to do what A1nitak did – provide feedback. You can do this by creating a video, blog post or participating at the blog. This way “the uneducated” (as stated by A1nitak) can watch my videos, A1nitak’s and whoever else’s to formulate their own thoughts.

Even though A1nitak calls me (or CopBlock) “retarded, stupid and whatnot” – yet thinks CopBlockers are the ones who act like children (see video above) – I understand that we have different views and tactics to achieve the service of protection we’d like. It’s what I’ve said all along, it’s impossible for 300 million people to agree on what type of protection they’d want. And right now we both only have one choice, the government’s. Shouldn’t we each have the freedom to select our own protection?
